LAND USE/ACTION ITEMS CITY OF APPLE VALLEY PLANNING COMMISSION MINUTES JANUARY 7, 2015 The City of Apple Valley Planning Commission meeting was called to order by Chair Melander at 7:00 p.m. Members Present: Tom Melander, Ken Alwin, Tim Burke, Keith Diekmann, Paul Scanlan and David Schindler. Members Absent: Brian Wasserman. Staff Present: City Attorney Michael Klemm, Community Development Director Bruce Nordquist, Planner Kathy Bodmer, Assistant City Engineer David Bennett, and Department Assistant Joan Murphy. Chair Melander asked if there were any changes to the agenda. Hearing none he called for a motion. MOTION: Commissioner Alwin moved, seconded by Commissioner Diekmann, approving the agenda. Ayes - 6 - Nays - 0. 3. APPROVAL OF MINUTES DECEMBER 17, 2014. Chair Melander asked if there were any changes to the minutes. Hearing none he called for a motion. Caribou Coffee Drive-Thru — Additional discussion and feedback related to a revised design proposal of a conditional use permit and site plan/building perrnit authorization to allow OF APPLE VALLLY Dakota County, Minnesota Planning Commission Minutes January 7, 2015 Page 2 of 3 a drive-thru in connection with Class III Restaurant in Planned Development 290, Zone 4. (PC14-17-ZCB) LOCATION: 14638 Cedar Avenue PETITIONER: Caribou Coffee Company fanner Kathy Bodmer stated the Planning Commission is requested to review two new plans that had been submitted by Caribou Coffee, 14638 Cedar Avenue, for a conditional use permit for a drive-thru lane in conjunction with a Class III Neighborhood Restaurant. The Commission is encouraged to take feedback and respond to questions from the Cedar Marketplace businesses related to revised plans from Caribou Coffee. The Planning Commission discussion is requested because, although a public hearing is not required, Caribou's plans have been refined since the time of the Planning Commission's review of the project. The two plans were distributed to the Apple Valley Chamber of Commerce and the tenants in the shopping center, to solicit feedback. Ms. Bodmer stated that the Planning Commission reviewed and recommended approval of Caribou's CUP request at its October 15, 2014 meeting. On December 11, 2014, at the Informal Meeting, the City Council raised several questions and concerns about the drive-thru lane design and its potential impact on traffic and businesses within the Cedar Marketplace parking lot. In response to the City Council's feedback, Caribou Coffee prepared a revised Site Plan ("Option C") which provided a dedicated queue lane that is separated from parking lot traffic. By reducing the size of the parking lot landscape islands, the property owner was able to increase the number of parking spaces available by four (346 spaces to 350 spaces). The only feedback from the Cedar Marketplace tenants was from the manager of FedEx that stated she liked the Option C Plan. Discussion followed. Jerry Roper, Caribou Coffee, made a public statement that they would withdraw their Option A Plan that was submitted on October 15, 2014, and replace it with the Option C Plan. MOTION: Commissioner Burke moved, seconded by Commissioner Diekmann recommending approval of Option C Plan subject to all the conditions in the previous motion for the Caribou Coffee drive-thru provided the applicant withdraws his Option A Plan. Ayes - 6 - Nays - O. 7. OTHER BUSINESS A. Looking back at 2014 and forward to 2015. Community Development Director Bruce Nordquist reviewed Planning Commission highlights from 2014 and stated it had once again been a busy and successful year. Discussion followed. A motion to recommend approval of a site plan to allow for the establishment of a seasonal outdoor garden sales center subject to the following conditions: • The seasonal outdoor garden center shall be conducted in conformance with the approved site plan, dated December 30, 2014. • The seasonal outdoor garden center in the parking lot shall be allowed to operate from April 1 to September 1 of each year. • Only live plant materials, bagged soils, and plant food shall be allowed to be displayed in the outdoor garden sales center area. • The seasonal sales area in the parking lot shall be delineated by a cedar wood split -rail fence. • Construction and maintenance of the greenhouse and garden center area shall be in accordance to the all applicable City's building and fire codes. • All bulk materials shall be required to be stored on pallets and that the stacking of pallets shall not be allowed. • All materials shall be kept outside of all parking lot drive lanes located along the east side of the property. • All areas should be kept in neat, organized rows and the premises shall be kept free of trash and other debris. • No signage shall be allowed to be affixed to the greenhouse and perimeter fence. The applicant is requesting approval of an outdoor display area to allow for a 3,240-sq. ft. (36 -ft. x 90 -ft.) temporary garden center in the northwest comer of parking lot yearly from April 1 to September 1. The display area will be bounded by a temporary 3 -ft. high cedar split - rail/concrete block fence and will include an 800 -sq. ft. greenhouse. The subject property is located in zone 1 of Planned Development No. 646. The purpose of this planned development zoning district is to provide for an integrated mix of shopping center, retail business, limited business, general business, and limited industrial uses. Outdoor display, sales or storage in conjunction with a permitted use is allowed as a permitted accessory use, subject to review and approval by the City Council. The applicant is requesting that the following items be allowed to be Goods to be displayed in the area: • Perennials in pots and packs • Trees potted in containers • Shrubs potted in containers • Bagged soils on palletized displays • Limited selection of plant foods • Landscape timbers Staff has some concern about allowing landscape timbers to be stored in this area. This material is much bulkier than the other materials, which would likely require vehicles to pull up next to the garden center to load the timbers. This could create a conflict with other customer traffic to and from the center. Pick up of this type of material is more appropriate in the existing outdoor yard. Therefore, staff is recommending that this type of material not be allowed in the center area. Establishment of the garden center will result in the loss of 20 of the existing 458 parking spaces. The current number of parking spaces exceeds the minimum required parking for a building material sales store. The facility will still exceed their parking requirements even with the temporary removal of parking for the garden center. The applicant is proposing to erect an 800 -sq. ft. temporary greenhouse in the garden center area. They have provided a picture of the greenhouse but no building details. The City's Fire Marshal and Building Inspections Division have reviewed the submitted information. Their comments are included in the attached memos. All applicable fire and building codes shall be strictly adhered to. The tent must be flame retardant and a copy of this must be given to fire official at time of inspection. 4. Submit an interior floor plan showing compliance with requirements to provide accessible routes. • Membrane covering must be tested to meet NFPA 701. Provide certification from manufacturer that materials have been tested to meet or exceed this standard with submittal.
