PLANNING COMMISSION MINUTES
July 17, 2024
1. CALL TO ORDER
The City of Apple Valley Planning Commission Meeting was called to order by Chair Kurtz
at 7:00 p.m.
Members Present: Jodi Kurtz, Paul Scanlan, David Schindler, Phil Mahowald, Becky
Sandahl, Jeff Prewitt, and Douglas Hlas
Member(s) Absent: None
City staff members attending: Community Development Director Tim Benetti, Planner Alex,
Sharpe, City Attorney Bob Bauer, and Department Assistant
Breanna Vincent.
2. APPROVAL OF AGENDA
Chair Kurtz asked if there were any changes to the agenda. – None.
MOTION: Commissioner Schindler moved, seconded by Commissioner Scanlan,
approving the agenda. Roll call vote: Ayes - 7 – Nays – 0.
3. CONSENT ITEMS
A. Approval of Minutes of June 5, 2024
MOTION: Commissioner Scanlan moved, seconded by Commissioner Schindler,
approving the minutes of June 5, 2024. Roll call vote: Ayes - 7 – Nays – 0.
4. PUBLIC HEARING
A. Homshuk & Bodega 42 Interim Use Permit for Corn Roaster
Chair Kurtz opened the public hearing.
Planner Sharpe provided a brief presentation.
Commissioner Scanlan asked if there were any venting requirements since it will be near
residential areas.
Planner Sharpe stated that there is no smell and venting is not needed. This may be a
consideration for when the ordinance is amended but is not a concern for the interim use
permit.

Commissioner Scanlan asked if the loss of parking is a concern.
Planner Sharpe stated that they have one extra parking space and the roaster will use two
spaces. Since it is a temporary use, an interim use permit can overcome that and allow staff
to see the impact. There is on-street parking available, as well as parking spaces north of
Gabella.
Chair Kurtz asked if the primary customers are pedestrians or those inside the restaurant.
Planner Sharpe deferred to the applicant but stated that in his experience, most of the
customers are not from inside the restaurant. Most people walk up and pay at the roaster.
Commissioner Prewitt asked if the expectation is that the permit would renew each year or
would they need Planning Commission approval.
Planner Sharpe stated that staff would look to amend the ordinance so that the interim use
permit would not be needed yearly.
The applicant, Fernando Mellado (6999 152nd St W.), was present for questions and
comments.
With no further comments or questions, Chair Kurtz closed the public hearing.
Although action is not typically taken on the night of an item’s public hearing,
commissioners chose to make a motion.
MOTION: Commissioner Scanlan moved, seconded by Commissioner Schindler, to
recommend approval of an interim use permit for an outdoor corn roaster at 6999
152nd St W., subject to conditions outlined in the draft resolution. Roll call vote:
Ayes – 7 – Nays – 0.

The next Planning Commission meeting is scheduled for Wednesday, August 7, 2024,

If the Planning C ommission concurs, the following motion would be recommended:
Recommend approval of a variance reducing the setback for a vestibule addition from 50' to
38' from C edar Avenue based on the findings listed below and subject to the conditions listed
below.
F indings:
1. T he property is zoned LB ("Limited Business"). T his zone requires a 50' building
setback from Cedar Avenue.
2. T he building is in the southeast corner of the subject property. T he southeast corner of
the building abuts the 50' building setback.
3. T he building was constructed in 1993 as a realty office. T he property is now owned by
ISD 196 and is used as an education facility. T he current layout of the building was
established and is consistent with what was permitted in 1993.
4. T he applicant is requesting a variance to reduce the building setback from C edar
Avenue from 50' to 38' to construct a vestibule addition to increase security and manage
visitors at the facility.
5. T he existing entrance is located on the north side of the building. T his entrance limits
security and visitor management because it provides direct access to the elevator and
primary stairs in the building.
6. T he existing, secondary east entrance does not provide direct access to the elevator or
stairs. A secure vestibule addition at the east entrance would limit access to restricted
areas and allow staff to direct visitors.
7. A reduced building setback would not be inconsistent with the Cedar Avenue area.
Multiple buildings along the C edar Avenue corridor have setbacks of less than 50'.
8. No significant trees are planned to be removed from construction of the vestibule.
C o ndi ti ons (See the attached draft resolution, subject to City Attorney review and
approval):
1. Construction shall occur in conformance with the site plan received J uly 2, 2024, on file
in City offices.
2. Construction shall occur in conformance with the elevation plan received August 1,
2024, on file in C ity offices.
3. No trees shall be removed, except as authorized as part of the N RMP.
S UM M ARY:
Independent School District 196 is requesting a setback variance from C edar Avenue to
construct a vestibule addition at the C edar Valley Learning C enter (C VLC ) located at 14420
Glenda Dr.
T he C VLC building is situated in the southeast corner of the property with the vestibule
addition proposed to be located on the east side of the building. T he vestibule will encroach
up to 12' into the 50' building setback.
C VLC provides educational services and classes for all ages -- children to adults. T he
vestibule addition will be used to secure the building and manage visitors.
B AC K G RO UND:
Existing C onditions: T he C VLC building was originally permitted in 1993 as a realty office.
T he layout of the building, including the elevator and primary stairs, was established and is
consistent with what was permitted in 1993. District 196 has been making physical alterations
and additions to existing buildings to increase security at its facilities. C VLC provides
educational services for varying age groups and has multiple classrooms throughout the
building. T he current north entrance includes a vestibule area with direct access to an
elevator and the primary stairs. T he existing entrance is not secure and allows visitors to
access areas of the building without checking in with staff.
Reason for Variance Request: To secure the building, the District would like to add a secure
vestibule to the secondary east entrance. T he vestibule cannot be constructed without
encroaching into the 50' building setback. T he existing primary entrance cannot be secured
without additional measures to remove access to the elevator and stairs. T he applicant states
the most functional option to enhance security and manage visitors would be to re-establish
the east entrance with the vestibule addition.
Cedar Avenue Reduced Building Setbacks: Buildings along C edar Avenue have varying
setback distances due to differing zoning district requirements and approved variances. A
reduction in a Cedar Avenue building setback would not be unprecedented.
Definition of "Practical Difficulties":
T he applicant proposes to use the property in a reasonable manner not permitted by the
zoning provisions of the code;
T he plight of the applicant is due to circumstances unique to the property not created by
the applicant; and
T he variance, if granted, will not alter the essential character of the locality.
Economic considerations alone do not constitute practical difficulties.
Factors for Finding a Practical Difficulty: In order to grant a variance, the C ity considers the
following factors to determine whether the applicant established that there are practical
difficulties in complying with the provision(s) of this C hapter (Chapter 155, Zoning):
1. Special conditions apply to the structure or land in question that are particular to the
property and do not apply generally to other land or structure in the district or vicinity in
which the land is located;
2. T he granting of the proposed variance will not be contrary to the intent of this chapter;
3. T he special conditions or circumstances do not result from the actions of the
owner/applicant;
4. T he granting of the variance will not merely serve as a convenience to the applicant, but
is necessary to alleviate practical difficulties in complying with the zoning provisions of
this C ode; and
5. T he variance requested is the minimum variance necessary to alleviate the practical
difficulty.
Summary of Findings: T he north entrance limits building security and visitor management.
T he secondary east entrance would remedy this issue by adding a secure vestibule addition
that allows staff to check in visitors and deny access to other areas of the building. T he
proposed vestibule would encroach a maximum of 12' into the 50' C edar Avenue setback
area. Multiple buildings abutting C edar Avenue have setbacks reduced from 50'.

Cedar Valley Learning Center Secure Entrance Addition Variance Request
As part of the Independent School District #196 May 9, 2023 successful bond referendum, several
District facilities will receive security improvements which, in some instances, include physical
alterations and additions to existing building. The Cedar Valley Learning Center (CVLC) located at
14420 Glenda Drive, Apple Valley, Minnesota 55124 has been identified as one of the District’s
facilities that is in need of physical alterations to improve building security and visitor
management.
The primary scope of work at the CVLC includes a new secure vestibule entrance addition to allow
building administration to better manage daily visitors and overall building security. The first
choice would be to construct the new secure entrance vestibule at the current main entrance on the
north elevation of the building adjacent to the existing parking lot, however, this option presents
significant functional challenges. The existing primary stair and elevator are located immediately
inside of the main entrance doors, within the existing vestibule. Currently, the stair and elevator
allow visitors to move freely to the lower level of the building without needing to directly check in
with building staff, this is the primary security issue of the existing facility. Any vestibule addition
at the existing main building entrance will not improve upon this primary dysfunction.
Based on the existing building conditions and security improvement needs of the District, the
proposed location of the new secure entrance vestibule, as outlined in the submittal drawings, will
re-establish the original east building entrance located adjacent to Cedar Avenue. As this approach
developed, it became immediately clear that any addition to the east side of the existing building
would encroach upon the 50 foot setback requirement along Cedar Avenue. In light of this, we
have determined that the east building entrance is the only fiscally and functionally feasible
location to build a new secure entrance vestibule and herby request a variance to the 50 foot setback
requirement.

A RESOLUTION APPROVING A VARIANCE FOR A REDUCED SETBACK FROM
CEDAR AVENUE TO CONSTRUCT A VESTIBLE ADDITION AT CEDAR VALLEY
LEARNING CENTER LOCATED AT 14420 GLENDA DRIVE AND ATTACHING
CONDITIONS THERETO
WHEREAS, pursuant to Minnesota Statutes 462.357 the City of Apple Valley has
adopted, as Title XV of the City Code of Ordinances, zoning regulations to control land uses
throughout the City; and
WHEREAS, pursuant to the City’s said regulations, a “variance” is an exception granted
by the City Council from the literal provisions of the zoning regulations when a practical difficulty
is shown to exist due to unique conditions on the property which do not apply to the area in
general; and
WHEREAS, Independent School District 196 is the owner of property located at 14420
Glenda Drive, and legally described as Lot 3, Block 1, Bor-Nel, Dakota County, Minnesota
(“Property”); and
WHEREAS, Independent School District 196 operates an educational facility on the
Property, specifically the Cedar Valley Learning Center; and
WHEREAS, the Independent School District 196 made application for a variance to
reduce the building setback from Cedar Avenue from 50’ to 38’ in order to construct a vestibule
addition on the east side of the building, fronting Cedar Avenue; and
WHEREAS, the Apple Valley Planning Commission reviewed the variance request at its
meeting held on August 7, 2024, and recommended approval of the variance request based on
the following findings:
1. The property is zoned LB (“Limited Business”). This zone requires a 50’
building setback from Cedar Avenue.
2. The building is in the southeast corner of the subject property. The southeast
corner of the building abuts the 50’ building setback.
3. The building was constructed in 1993 as a realtor office. The building is now
owned by ISD196 and is used as an education facility. The current layout of the
building was established and is consistent with what was permitted in 1993.
4. The applicant is requesting a variance to reduce the building setback from
Cedar Avenue from 50’ to 38’ to construct a vestibule addition to increase
security and manage visitors at the facility.

5. The existing entrance is located on the north side of the building. The security
and visitor management into the building from this north entrance cannot be
provided because the entrance provides direct, unrestricted access to the
elevator and primary staircase in the building.
6. The existing, secondary east entrance does not provide direct access to the
elevator or stairs. A secure vestibule addition at the east entrance would limit
access to restricted areas and allow staff to direct visitors.
7. A reduced building setback would not be inconsistent with the Cedar Avenue
area. Multiple buildings along the Cedar Avenue corridor have setbacks of less
than 50’.
8. No significant trees are planned to be removed from construction of the
vestibule.
9. Security and visitor management needs of the learning center cannot be met at
the existing north entrance due to the elevator and primary staircase at the
entrance which must be allow unrestricted access for staff, students, and
authorized visitors. The existing east entrance can provide security and visitor
management by constructing a vestibule addition. A secure vestibule addition
on the east side of the property cannot be constructed without encroaching into
the 50’ building setback from Cedar Avenue because of the proximity of the
existing building to the setback. These facts constitute a practical difficulty
warranting the setback variance.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Apple Valley,
Dakota County, Minnesota, that the variance to reduce the building setback of a vestibule
addition from Cedar Avenue from 50’ to 38’ on the property located at 14420 Glenda Drive,
and legally described as Lot 3, Block 1, Bor-Nel, Dakota County, Minnesota, is hereby
approved, subject to all applicable City Codes and standards, and the following conditions:
1. If the Building Permit is not paid for and issued within one (1) year of the date
of approval, the variance approval shall lapse.
2. The approval of the variance is subject to the issuance of and compliance with
the building permit and Building Code requirements for the construction of the
east vestibule addition.
3. Construction shall occur in conformance with the approved site plan received
in City offices July 2, 2024, on file in City offices.
4. Construction shall occur in conformance with the elevation plan received in
City offices August 1, 2024, on file in City offices.

5. Site grading shall occur in conformance with a Natural Resources Management
Plan (NRMP) which shall include a final grading plan to be submitted for review
and approval by the City Engineer.
6. No trees shall be removed, except as authorized as part of the NRMP.
7. Construction shall be limited to the hours of 7:00 a.m. to 7:00 p.m. Monday through
Friday. Weekend construction shall be limited to 8:00 a.m. to 5:30 p.m.
Saturdays.
8. Earthmoving activities shall not occur when wind velocity exceeds thirty (30)
miles per hour. Watering to control dust shall occur as needed and whenever
directed by the Apple Valley Building Official or Zoning Administrator.
9. Issuance of a Building Permit is contingent upon the project being constructed in
conformance with all the preceding conditions, as well as all applicable
performance standards of the current zoning regulations.
10. The ongoing use and occupancy of the premises is predicated on the ongoing
maintenance of the structure and all required site improvements as listed in the
preceding. No alteration, removal, or change to the preceding building plans or
required site improvements shall occur without the express authorization of the
City. Site improvements which have deteriorated due to age or wear shall be
repaired or replaced in a timely fashion
BE IT FURTHER RESOLVED that issuance of the building permit is subject to a finding
of compliance of the construction plans with the Minnesota State Building Code, as determined
by the Apple Valley Building Official, and with the Minnesota State Uniform Fire Code, as
determined by the Apple Valley Fire Marshal.
