Minutes of the special meeting of the City Council of Apple Valley, Dakota County,
Minnesota, held June 6th, 1985, at 8:00 o'clock p.m. at the City Hall pursuant to
due call and notice thereof.
PRESENT: Mayor Branning; Councilmembers Goodwin, Holton and Humphrey; Administrator
Asleson and City Clerk Mueller.
ABSENT: Councilmember Savanick.
Mayor Branning called the meeting to order at 8:00 p.m.
MOTION: of Goodwin, seconded by Holton, approving abatements of real
estate property taxes, as recommended by the Dakota County
Assessor, for parcels numbered 01-16401-110-01, 01-20510-140-01,
01-20510-150-01, 01-20510-160-01 and 01-20510-170-01. Ayes -
4 - Nays - 0.
TAX ABATEMENTS
The Council received Rick Kelley's memo dated June 6, 1985, concerning CARROLLTON
final approvals requested for the Carrollton Estates development. Mr. ESTATES
Gretz said several items remain to be agreed on before final action--
Installation of an eight-foot wide pathway, instead of sidewalk, along Hayes Road,
145th Street and Pennock Avenue which is acceptable to the developer. Length of
the City's option on the library/park site; the City requested 10 years, the devel-
oper offered five years with the stipulation the City not exercise it for three
years. The developer does not agree with the berm and landscape requirements for
the commercial area along County Road 42.
Mr. Kelley reviewed the six zones contained in the proposed planned development
ordinance and their variations from the zoning ordinance. Zone 1 - small lot single
family detached. Zone 2 - moderate density multiple residential. Zone 3 - insti-
tutional or high density multiple residential. Zone 4A - retail business with
minimum 50,000 square foot building required initially; maximum of four peripheral
uses and prohibits fast food, service stations and garage bays; maximum hnilding
height is 20 feet; and berming and plantings along County Road 42 are specified.
Zone 4B - free standing retail business and no driveway access to Pennock Avenue.
Zone 5 - limited business with larger lots and 40-foot setback from]the single fam-
ily area. Overall, the street rights-df-way are reduced to 50 feet for residential
streets and 64 feet for collector streets with standard width driving surfaces.
Mr. Winkler, the developer, said he was not aware fast food was prohibited in Zone 4A and
would like to have one or two allowed. His intent is for a center similar to Apple
Valley Square and they are allowed there. He thought the five-year option on the
institutional site was acceptable to the City; 10 years is too long for him to hold
it open. He believes the landscaping and berming along County Road 42, as proposed,
would block the view of the building. A berm is all that would be necessary to
screen the parking lot. Mr. Gretz showed photos of the Goodyear building along
Cedar Avenue and said this is what had been envisioned by the requirements.
Mr. Gretz said a five-year option on the institutional site was discussed early on,
but 10 years is what the City would want. With a three-yemr moratorium on exercis-
ing a five-year option, the City would really only have two years in which to act.
The Carrolls intend to occupy the farm site for three years and that is one reason
for not acquiring the site now.

The Council discussed the option term and Mayor Branning suggested exercise of the
option based on completion of some specified portion of the development. It was
generally agreed the term would be 10 years or when building permits have been is-
sued for 75 percent of the units. This was acceptable to Mr. Winkler.
The Council said it generally agreed with the landscaping recommended along County
Road 42. Mr. Winkler said Apple Valley Square does not have the trees required
here and wants to promote development, but this could be a detriment. Mayor
Branning said this development faces a residential area and believes the land-
scaping will be attractive. If it becomes the deciding factor when something is
to be constructed, the Council might be willing to look at changing the require-
ment then.
Mr. Kelley said fast food uses have not been permitted in the other two commercial
area planned developments (Apple Valley Commercial and Southport) and that is why
only Class I restaurants are allowed. Mr. Winkler said he would like one or two
fast food restaurants permitted. Ne has no particular restaurant in mind, but
would like the option available and it could be restricted to the Pennock Avenue
side only.
MOTION: of Goodwin, seconded by Holton, adopting Resolution No. 1985-
111 amending the City's Comprehensive Guide Plan for Carrollton
Estates, as recommended by the Planning Commission, subject to
approval by the Metropolitan Council..Ayes - 4 - Nays - 0.

MOTION: of Holton, seconded by Goodwin, readopting Ordinance No. 341 ORDINANCE 341
amending Appendix A of the City Code by establishing Planned CARROLLTON EST.
Development Designation No. 341 for Carrollton Estates with P.D. ZONES
Zones 1, 2, 3, 4A, 4B and 5, as recommended by the Planning
Commission and allowing fast food uses in Zone 4A only as a con-
ditional use north of the 149th Street alignment. Ayes - 4 -
Nays - 0.
MOTION: of Holton, seconded by Humphrey, adopting Resolution No. 1985-
112 approving the final plat and Development Agreement for
Carrollton Estates (containing 93 single family lots) with
installation of an eight-foot wide pathway along Hayes Road,
145th Street and Pennock Avenue in lieu of sidewalk and auth-
orizing the Mayor and Clerk to sign the same. Ayes - 4 -

AGREEMENT
MOTION: of Goodwin, seconded by Holton, approving a Supplementary
Agreement for Carrollton Estates related to parks, ponds, ease-
ments and road right-of-way not included in Phase I and
providing the City would make a decision on exercising its
option on the institutional property when building permits
have been issued on 75 percent of the units, not to exceed 10
years, and authorizing the Mayor and Clerk to sign the same.

MOTION: of Humphrey, seconded by Goodwin, to pay the claims and bills,
checks numbered 31087, 31088, 43049 through 43054, 43056 through
43118, 43127 through 43200 and 43203 through 43211, in the total
amount of $1,493,072.32. Ayes - 4 - Nays - O.
CLAIMS & BILLS
Consideration of setting a date for the sale of the City's tax increment bonds was
tabled until June 10, 1985.
MOTION: of Holton, seconded by Goodwin, to adjourn. Ayes - 4 - Nays - O.
The meeting was adjourned at 9:06 o'clock p.m. The Council then continued with
its regular informal meeting.
