July 10, 1985
Minutes of the special meeting of the City Council of Apple Valley, Dakota County,
Minnesota, held July 10th, 1985, at 8:00 o'clock p.m. at the City Hall pursuant to
due call and notice thereof.
PRESENT: Mayor Branning; Councilmembers Goodwin, Holton, Humphrey (attended at
8:18 p.m.) and Savanick; City Administrator Asleson and City Clerk Mueller.
ABSENT: None.
Also present were City Attorney James Sheldon, Community Development Director John
Gretz and Parks & Recreation Director Jon Gurban.
Mayor Branning called the meeting to order at 8:05 p.m. and noted it was for the
purpose of discussing lawsuits related to Fischer Sand & Gravel operations in
Apple Valley. Mr. Sheldon advised the Council that if the meeting is closed to
the public, under the attorney-client privilege, all matters discussed cannot be
revealed to any one; the Council may only discuss the matters Which are the sub-
ject of the meeting; and it cannot take any formal action during the closed meeting.
MOTION: of Goodwin, seconded by Holton, to close the meeting to the
public, under the attorney-client privilege, for the purpose of
discussing lawsuits related to Fischer Sand & Gravel operations
in Apple Valley. Ayes - 4 - Nays - 0.

The meeting was closed at 8:09 p.m. There were no members of the public or press
in attendance. Councilmember Humphrey attended during the meeting at 8:18 p.m.
MOTION: of Holton, seconded by Humphrey, to reopen the special meeting.
Ayes - 4 - Nays - 1 (Savanick).
REOPEN MEETING
The meeting was reopened at 10:05 p.m. There were no members of the public or
press present. It was noted that a report on the status of the litigation would
be given at the regular City Council meeting on July 11, 1985.
MOTION: of Holton, seconded by Goodwin, to adjourn~ Ayes - 5 - Nays - 0.
The meeting was adjourned at 10:06 o'clock p.m.
