CALL TO ORDER CITY OF APPLE VALLEY PLANNING COMMISSION MINUTES FEBRUARY 18, 2015 The City of Apple Valley Planning Commission meeting was called to order by Vice-Chair Burke at 7:00 p.m. Members Present: Ken Alwin, Tim Burke, Keith Diekmann, Paul Scanlan and David Schindler. Members Absent: Tom Melander Staff Present: City Attorney Sharon Hills, Community Development Director Bruce Nordquist, City Planner Tom Lovelace, and Department Assistant Joan Murphy. 2. APPROVAL OF AGENDA Vice-Chair Burke asked if there were any changes to the agenda. Hearing none he called for a motion. MOTION: Commissioner Diekmann moved, seconded by Commissioner Scanlan, approving the agenda. Ayes - 4 - Nays - 0. 3. APPROVAL OF MINUTES FEBRUARY 4, 2015. Vice-Chair Burke asked if there were any changes to the minutes. Hearing none he called for a motion. CONSENT ITEMS --NONE-- 5 PUBLIC HEARINGS A. Primrose School of Apple Valley — Public Hearing request for rezoning and zoning amendments, subdivision, and site plan permit authorization to allow for construction of a 11,700-sq. ft. day care facility on 1.65-acre lot. (PC15-03-ZSB) LOCATION: Northeast corner of Pilot Knob Road and 155th Street West PETITIONER: Primrose School Franchising Company CITY OF APPLE VALLEY Dakota County, Minnesota Planning Commission Minutes February 18, 2015 Page 2 of 4 City Planner Tom Lovelace stated the applicant is proposing to rezone the property to allow for the development of a day care facility on the east 1.65 acre of an existing outlot. This would require the creation of a new subzone in "PD-856" and the preparation of ordinance amendments that identify uses, area requirements, and performance standards for the future subzone. The applicant is proposing to subdivide the existing Out lot B, APPLE VALLEY EAST FAMILY 2ND ADDITION into a 1.65-acre lot, with the remaining 3.8 acres platted as an outlot. All existing easements would remain dedicated with this replat. A ten-foot drainage and utility easement, centered on common east/west property line shall be dedicated with this plat. In addition, all requirements set forth in the City's subdivision ordinance shall be adhered to. The north/south drive lane would directly abut the west property line. He stated staff had concerns that this drive aisle is not set back from the property line. This is something that would generally not be allowed in similar developments. The applicant should provide information on how this development would interact with future development to the west before considering a zero setback for the drive aisle. The site abuts public streets to the north, east, and south, each having a sidewalk or pathway directly adjacent to the property. Internal sidewalk connections should be made to the public sidewalks and pathway abutting the property. The four parking spaces in the southeast corner would be devoted for bus parking, which would likely be stored there overnight. It would be necessary to provide screening in that area. The applicant shall install a bike rack in accordance with City requirements. The submitted plans show the removal of a berm and the relocation of ten 5-foot tall spruce trees located along the north side of the outlot. This berm and landscaping was established to provide screening of the commercial development from the residential development to the north. Staff has concerns about the removal of this screening element and the applicant has identified a screening alternative on their submitted plans. Mr. Lovelace reviewed the Traffic Management Plan, Grading and Utility Plans, Storm Sewer Plan and Landscaping Plan. No elevations had been provided that show the trash enclosure's exterior finish. City code requires that the enclosure's finish shall be architecturally compatible with the principal building it serves. He stated cross access easements shall be recorded with the subdivision that would allow use of the drive approaches on Embry Path and 155th Street West by the proposed lot and any future lots to the west. Approval of this proposed development should include a condition that would allow the City to require the installation off the 155th Street West intersection at the property owners expense if it is determined that the Embry Path intersection cannot safely and sufficiently handle the day care facility's traffic. CITY OF APPLE VALLEY Dakota County, Minnesota Planning Commission Minutes February 18, 2015 Page 3 of 4 Commissioner Alwin commented that when this comes back to the Planning Commission he would like to see more traffic flow looked at. He asked if they carved another driveway into 155th Street West would there be a short cut created from 154th Street through the back of the parking lot. Mr. Lovelace said there would not be access off 154th Street into this development because there is an access restriction easement along the south side of 154th Street. Commissioner Scanlan inquired if future commercial development to the west would have any limitations as what can be built with this facility as far as what is allowed and not allowed. Mr. Lovelace commented that he did not think there would be any limitations but with just how it is laid out. He thought the developer would like to maximize the property to its fullest use and the City would like to see that the uses are compatible with each other. Commissioner Scanlan asked if there would be any safety concerns with the location of the play area and traffic flow and the close proximity to Emby Path with the traffic volume that may be expected when Embry Path opens. He also expressed concern of vehicles losing control and going over the sidewalk there during the winter months driving into the play area. Mr. Lovelace answered that the property would be fenced in and that school staff would be required to be with children all the times when they are outdoors. Commissioner Scanlan referenced earlier discussion about the housing development to the north and having the berm in place and stated he would like to see some alternative designs brought forth to the next meeting to allow the berm to be retained. He feels it is an important component and if it is allowed to be removed here are we opening ourselves up to the rest of the commercial properties as seeing it removed in future developments. Vice-Chair Burke opened the public hearing at 7:25 p.m. Jacob Fick, Tradition Development, discussed screening from the north and said they would continue to work with staff and bring back revised plans. It was their intent to put a road to the west that has an entrance from 155th Street and not hinder uses to the west. John Finnemore, Primrose Schools, reviewed the hours of operation and playground location in relationship to Embry Path. He commented that they may not see a high volume of traffic and that the playground would have a high fence. Commissioner Scanlan asked if more plans for bus storage, berm and playground area could be brought back to the next Planning Commission meeting. He questioned if more screening could be provided and what type of buses they planned to store on the property. Mr. Finnemore answered that the buses would be the short bus type. Commissioner Scanlan inquired where the picking up and dropping off sites would be. The school would utilize a keypad system where parents enter their child in and escort them to their classroom. Vice-Chair Burke asked if they expect all the parking stalls to be used at the same time. Mr. Finnemore answered that the drop off time is about six to ten minutes. It is quicker in the morning hours than in the evening hours due to parents talking to their child's teacher. Cars would be coming and going from those stalls. If there was any stacking it would be very minimal. Vice-Chair Burke closed the public hearing at 7:43 p.m. 6. LAND USE/ACTION ITEMS --NONE-- 7. OTHER BUSINESS A. The existing sign is located within the ROW as a result of the dedication, not as a result of the Church's action. o The requested variance confers no special privilege to the property. o The sign will not negatively impact adjacent properties or deter future development of vacant lands. Project Summary /Issues Mount Olivet Assembly of God Church, located at 14201 Cedar Avenue, requests a variance in order to replace their existing church sign with an updated 49 sq. ft. ground sign. The sign is currently located within the Cedar Avenue right -of -way and must be relocated. The church is concerned that the sign will not be visible if it is set back 13' from the Cedar Avenue right -of -way line because of recent right -of -way dedications and the resulting large boulevard area. The church is requesting a three foot (3') variance to construct the sign 10' from the Cedar Avenue right -of- way line, outside the drainage & utility easements. In order to obtain a variance, a sign variance request must meet all of the following conditions: (a) Special conditions exist which are peculiar to the land, structure, building involved and which are not applicable to other lands, structures or buildings in the same district; (b) The special conditions and circumstances do not result from the actions of the applicant; (c) A literal interpretation of the provisions of these regulations would deprive the applicant of rights commonly enjoyed by other properties in the same district and the terms of these sign regulations; (d) That granting the variance requested would not confer on the applicant any special privilege for a use not common to other lands, structures or buildings in the same district; and (e) The proposed use of the property shall have an appearance that will not have an adverse effect upon adjacent properties and there will be no deterrence to development of vacant land. The City has reviewed several sign variance requests resulting from the Cedar Avenue upgrade project, including Applebee's, BP, and Holiday. The change in right -of -way location on an already developed property presents unique challenges. Mount Olivet Church was required to dedicate additional right -of -way for Cedar Avenue in 2006 when the property was re- platted to construct the Youth and Family Centre building. The additional dedication resulted in the existing sign being located within the newly dedicated right -of -way. While the existing sign is able to stay in its current location, a new sign is required to meet the setbacks from the new ROW line. The church states that they are concerned that because the existing parking lot along Cedar Avenue is now located very close to the right -of -way line (again, as a result of the right -of -way dedication) the view of the new sign will be blocked if it is set back 13'. Setting the sign back 10' from the property line will ensure it is outside all drainage and utility easements while helping to improve visibility. Budget Impact None. Attachment(s) 1. Joseph McCormack Business Manager 952 • jrnQcormack@themount.org mount Mount Olivet Assembly of God would like to request a variance for the location of our new digital sign. 1 have attached drawings of the sign and the location we would like to locate the sign. The reasons for the variance request are: With the 18 foot set back from our new property line (based on the recent widening of Cedar Avenue) we are limited to placing the sign in the large grassy area on the North East corner of our lot. This location limits the visibility of our sign in a few ways. a. South bound Cedar traffic would only get a very short chance to view anything on the sign due to the large pine trees located along the road side on the property directly across 142nd street (on the South East corner of 142nd and Cedar). b. North bound Cedar traffic would be ok when there are zero vehicles in the parking lot. When there are vehicles in the parking lot it would have almost zero visibility since the 13 foot set back is set behind the parking spots that run along the Cedar side of the lot. So the vehicles would block most of the sign. c. Currently we do a large free summer community festival each year to bless that Apple Valley community and use the space where the sign would have to be placed without the variance. It would be right in the middle of the area we use for large blowup and other items for this event. d. When we built our new Youth and Family Centre on the South East end of our property in 2008, we built in electrical right in the area we are requesting the variance for a future sign installation. There is currently no electrical in the area the sign would have to be placed without the variance. This will cause us to incur a pretty large cost to run electrical to that location. e. We have considered installing the sign on the small hill directly in front of the Youth and Family Centre along Cedar in the landscaping) however, that location would be completely blocked by the new trees that were put in along the side walk along Cedar avenue. Due to these items we can not find a better place (besides the location of the old sign which is on the wrong side of the new property line) that will allow the sign to have the best visibility from both directions of traffic and save us extra cost incurred by new electrical runs. ITEM: COMMISSION MEETING DATE: SECTION: Project Summary /Issues From September 30 — October 1, 2014, Apple Valley was the site of a new initiative called Vitalocity! Vitalocity! is an effort led by the private market to better incorporate aging - friendly principles into Apple Valley's social, economic, and physical infrastructure. The initiative was led by a partnership consisting of the City in conjunction with several corporate and non -profit leaders in the field of aging including Ecumen, BusinessLab UK, Perkins -Eastman Architecture firm, Kendal Corporation, IBM, Sodexo, Nestle, and the World Health Organization (WHO). The three -day workshop, which was open to residents and businesses, was designed to help develop a "roadmap ". Participants in the workshop identified four math areas of focus that were further broken into nine themes common to aging - friendly communities. The themes include: • Housing • Outdoor Spaces and Buildings • Transportation • Communication and Information • Safety • Civic Participation and Employment • Social Participation • Community Support and Health Services • Respect and Social Inclusion The partnership has developed strategies that would help Apple Valley realize a community that would be more welcoming and easier to navigate for both older and younger residents. The initiative could also serve as a framework for the City's 2040 Comprehensive Plan update, which will be completed in 2019. The partners would like to meet on April 15, 2015, to present their findings and receive feedback on the suggested strategies. The April 15 workshop will likely include other City advisory committees. A draft presentation has been prepared, but staff comments are currently being incorporated.
