HomeMy WebLinkAbout03/22/1984CITY OF APPLE VALLEY Dakota County, Minnesota March 22, 1984 Minutes of the meeting of the City Council of Apple Valley, Dakota County, Minnesota, held March 22nd, 1984, at 8:00 o'clock p.m. at the City Hall. PRESENT: Councilmembers Holton, Humphrey and Savanick; Clerk Asleson. ABSENT: Mayor Branning. Acting Mayor Holton called the meeting to order at 8:00 p.m. The Councilmembers and everyone in attendance took part in the pledge of allegiance to the flag. MOTION: of Humphrey, seconded by Savanick, approving the agenda for to- APPROVE AGENDA night's meeting as amended. Ayes - 3 - Nays - 0. MOTION: of Savanick, seconded by Humphrey, approving all items on the consent agenda with no exceptions. Ayes - 3 - Nays - 0. CONSENT AGENDA VARIANCE LOT 18, BLK 1, TIMBERWICK 5TH CONSENT AGENDA ITEMS MOTION: of Savanick, seconded by Humphrey, granting a setback variance for Lot 18, Block 1, Timberwick 5th Addition, to allow a struc- ture to be erected to within 20 feet of the front property line due to topographic reasons as recommended by the Planning Com- mission. Ayes - 3 - Nays - 0. MOTION: of Savanick, seconded by Humphrey, adopting Resolution No. 1984- RES. 1984-40 40 approving an agreement with the State of Minnesota for use BREATH TEST of an Intoxilyzer 5000 breath test instrument and breath alcohol EQUIPMENT simulator and authorizing the City Administrator and Police Chief AGREEMENT to sign the agreement. Ayes - 3 - Nays - 0. MOTION: of Savanick, seconded by Humphrey, approving an agreement with Golf Car Midwest to supply 20, 1982 Yamaha golf carts at Valley- wood Golf Course for the 1984 season at $13,700. Ayes - 3 - Nays - 0. 1984 GOLF CART AGREEMENT CIGARETTE & BEER LICENSES HIRE PARTTIME EMPLOYEES AUDIENCE DISCN. MOTION: of Savanick, seconded by Humphrey, approving 1984 cigarette and on-sale 3.2 beer licenses for Apple Valley Golf Course at 8661 West 140th Street. Ayes - 3 - Nays - 0. MOTION: of Savanick, seconded by Humphrey, approving hiring the parttime employees listed in the memo from the City Administrator dated March 19, 1984. Ayes 3 - Nays - 0. END OF CONSENT AGENDA ITEMS Acting Mayor Holton asked if anyone was present to address the Council at this time on any item not on this meeting's agenda. There was no one present to speak. MOTION: of Savanick, seconded by Humphrey, approving the minutes of the MARCH 8, 1984 meeting of March 8th, 1984, as written. Ayes - 3 - Nays - 0. MINUTES CITY OF APPLE VALLEY Dakota County, Minnesota March 22, 1984 Page 2 MOTION: of Humphrey, seconded by Savanick, adopting Resolution No. 1984- RES. 1984-41 41 approving the final plat and development agreement for SUNSHINE EST. Sunshine Estates and authorizing the Mayor and Clerk to sign FINAL PLAT the same. Ayes - 3 - Nays - 0. MOTION: of Savanick, seconded by Humphrey, adopting Resolution No. 1984- RES. 1984-42 42 receiving the preliminary engineering report for Project SET HEARING 84-11, Sunshine Estates sanitary sewer, water and storm sewer PROJ. 84-11 trunk improvements, and setting a public hearing on it at 8:00 p.m. on April 26, 1984. Ayes - 3 - Nays - 0. John Gretz reviewed the Planning Commission report dated March 16, 1984, on Morning- view Heights which is a proposed replat of property originally planned for 10 fourplex buildings. The replat would provide for 20 duplex buildings. MOTION: of Savanick, seconded by Humphrey, approving the preliminary plat of Morningview Heights, as recommended by the Planning Commission, and directing preparation of a development agree- ment for consideration. PRELIM. PLAT MORNINGVIEW HEIGHTS Councilmember Savanick asked to see sketches of the buildings proposed for this subdivision. The motion was temporarily laid on the table while the sketches were obtained. John Gretz reviewed the agreement for temporary installation of traffic signals at Cedar Avenue and County Road 46 attached to his memo dated March 14, 1984. Acting Mayor Holton asked how long the signals would be temporary? Mr. Gretz said the County is requesting FAU funding for improving the road in 1987. MOTION: of Humphrey, seconded by Savanick, approving Traffic Control Signal Agreement No. 84-02 with Dakota County and Lakeville for installation of temporary signals at Cedar Avenue and County Road 46 and authorizing the Mayor and Clerk to sign it subject to receipt of a written estimate of engineering and inspection costs from the County. Ayes - 3 - Nays - 0. SIGNAL AGREE- MENT CEDAR & CR 46 Bill Allen, of U.S. Homes, showed sketches of the back-to-back duplex buildings pro- posed for Morningview Heights. Maintenance will be done by the homeowners' association. Councilmember Humphrey asked if this plan would require more lawn maintenance than the fourplexes? Mr. Allen said there is very little change in the amount of green space. Councilmember Savanick asked who would be members of the association? Mr. Allen said the existing four plex area and these duplexes would be part of the same association. The motion was taken from the table and a vote was taken. Ayes - 3 - Nays - 0. MORNINGVIEW HEIGHTS VOTE John Gretz reviewed his memo dated March 15, 1984, concerning road construction pro- jects Dakota County is submitting for Federal funding in 1987. Acting Mayor Holton asked if the projects should be prioritized by the City? Mr. Gretz said it would be difficult to do because some project are part of other projects in the County and some depend on projects other than County projects being installed. CITY OF APPLE VALLEY Dakota County, Minnesota March 22, 1984 Page 3 MOTION: of Savanick, seconded by Humphrey, adopting Resolution No. 1984- RES. 1984-43 42 endorsing submittal by Dakota County for Federal Aid Urban ENDORSE COUNTY funds in 1987 of Project 23-24, Cedar from Whitney south; Project FAU PROJECTS 38-09, CR 38 between Johnny Cake and CSAH 31; Project,42-34, CSAH 42 from Pennock west; and Project 31-20, CR 31 from CR 38 north. Ayes - 3 - Nays - 0. Councilmember Savanick said the County Road 42 improvements are very important to the City and if it is not funded, the City should investigate other methods of funding. Councilmember Humphrey asked the City Administrator to prepare a separate resolution emphasizing the importance of County Road 42 for the Council to consider at its next meeting. MOTION: of Savanick, seconded by Humphrey, adoptihg Resolution No. 1984- RES. 1984-44 44 rejecting bids received February 16, 1984, for water meters, REJECT METER approving revised specifications for water meters to be purchased BIDS & READ- over a three-year period and authorizing advertisement for bids VERTISE to be received at 2:00 p.m. on April 19, 1984. Ayes - 3 - Nays - 0. Jori Gurban reviewed his memo dated March 19, 1984, concerning the need for a second parking lot in Redwood Park. Councilmember Humphrey suggested the plans include a path from the proposed parking lot to the building. MOTION: of Humphrey, seconded by Savanick, authorizing the City Engineer to prepare plans and specifications for an additional parking lot in Redwood Park. PREPARE PLANS REDWOOD PARK PARKING LOT Councilmember Savanick asked if landscaping would be included? Mr. Gurban said the City Forestor would be preparing a plan. Councilmember Savanick also asked that where the road in the park joins the path be more clearly defined to prevent vehicles from driving on the path. Vote was taken on the motion. Ayes - 3 - Nays - 0. MOTION: of Savanick, seconded by Humphrey, adopting Resolution No. 1984- 45 declaring April 1984 as "Registration Awareness Month" and urging young men to register with the Selective Service System in accordance with the Military Selective Service Act. Ayes - 3 - Nays - 0. RES. 1984-45 REGISTRATION AWARENESS MONTH RECEIVE BURNS- VILLEAMBULANCE LETTER TORNADO AWARE- NESS WEEK 1983 ANNUAL POLICE REPORT The Council received a letter dated March 9, 1984, from the Mayor of Burnsville advising of the decision for Burnsville to operate its own ambulance service effective October 1, 1984, and requesting considera- tion of a mutual aid agreement with Divine Redeemer Ambulance Serivce. No action was taken at this time. The Council received a memo from Police Chief Rivers dated March 15, 1984, related to Tornado Awareness Week, March 25 through 31, 1984. Chief Rivers reviewed some of the activities which will occur during that week. The Council received the Police Department's 1983 Annual Report and Chief Rivers said he would be interested in comments from the Council after the Report has been reviewed. Ayes - 3 - Nays - 0. SET INFORMAL MEETING TIME CLAIMS & BILLS MOTION: of Savanick, seconded by Humphrey, to pay the claims and bills, checks numbered 31032, 36709 through 36812 and 36823 through 36909, in the total amount of $1,i56,i75.02. Ayes - 3 - Nays - 0. MOTION: of Savanick, seconded by Humphrey, to adjourn. Ayes - 3 - Nays - 0. The meeting was adjourned at 8:40 o'clock p.m.
