Minutes of the special meeting of the City Council of Apple Valley, Dakota County,
Minnesota, held December 20th, 1984, at 8:00 o'clock p.m. at the City Hall pursuant
to due call and notice thereof.
PRESENT: Mayor Branning; Councilmembers Goodwin, Holton, Humphrey and Savanick;
Clerk Asleson.
ABSENT: None.
Mayor Branning called the meeting to order at 8:00 p.m. for the purpose of holding
a hearing on the issue of whether or not the liquor license of Shonrik Development,
Inc., d/b/a R. Berry's, should be suspended. The Council received the Stipulation
labled "City Exhibit 1" and proceeded with the hearing. The official transcript of
the proceedings are on file as prepared by John T. Kirby, Metropolitan Court
Reporters.
MOTION: of Savanick, seconded by Holton, adopting Resolution No. 1984-
204 imposing a suspension of the liquor license of Shonrik
Development, Inc., d/b/a R. Berry's, for a period of from 5 to
15 days, to be determined by the Council, but staying the sus-
pension for a period of six months unless an incident occurs
during that time which gives rise to a similar conviction.
MOTION: of Humphrey, seconded by Savanick, amending the motion by speci-
fying the suspension period to be 5 days and be imposed within
30 days of a conviction.
MOTION: of Goodwin, seconded by Holton, amending the amendment by chang-
ing the suspension period to 3 days. Roll Call Vote: Humphrey -
no; Savanick - no; Holton - yes; Goodwin - yes; Branning - no.
Amendment Failed.

MOTION: of Humphrey, seconded by Holton, to adjourn. Ayes - 5 - Nays - 0.
The meeting was adjourned at 9:30 o'clock p.m.
