HomeMy WebLinkAbout2025/05/22 CITY OF APPLE VALLEY Dakota County, Minnesota May 22, 2025 Minutes of the regular meeting of the City Council of Apple Valley, Dakota County, Minnesota, held May 22, 2025, at 7:00 p.m. PRESENT: Mayor Hooppaw; Councilmembers, Bergman, Grendahl, Hiebert, and Melander. ABSENT: None. City staff members present were: City Administrator Lawell, City Clerk Scipioni, City Attorney Hills, City Engineer Anderson, Community Development Director Benetti, Parks and Recreation Director Carlson, Deputy Police Chief Dahlstrom, Police Chief Francis, Assistant City Administrator Grawe, Human Resources Manager Haefner, Fire Chief Nelson, Public Works Director Saam, and Associate Planner Stroeing. Mayor Hooppaw called the meeting to order at 7:00 p.m. Everyone took part in the Pledge of Allegiance to the flag. Approval of the Agenda Mr. Lawell noted the applicant for item S.E. requested the item be moved to the June 12, 2025, regular City Council meeting. MOTION: of Grendahl, seconded by Hiebert, approving the agenda for tonight's meeting, removing Item 5.E Cannabis Microbusiness Text Amendments, which will be considered at the June 12, 2025, meeting. Ayes - 5 -Nays - 0. Audience Mayor Hooppaw asked if anyone was present to address the Council, at this time, on any item not on this meeting's agenda. Michael Bogerd announced he will be opening a new restaurant in Apple Valley called Chicken Salad Chick. Consent Agenda Mayor Hooppaw asked if the Council or anyone in the audience wished to pull any item from the consent agenda. There were no requests. MOTION: of Melander, seconded by Grendahl, approving all items on the consent agenda with no exceptions. Ayes - 5 -Nays - 0. Consent Agenda Items A. Adopt Resolution No. 2025-79 setting public hearing at 7:00 p.m. on June 12, 2025, to consider On-Sale Wine and 3.2 Percent Malt Liquor License application from Spice Village, LLC, 7520 149th Street W. C. Adopt Resolution No. 2025-80 approving State Gambling Premises Permit for Eastview Hockey Association to conduct lawful gambling at Revolve Hall/Whiskey Inferno/Minnesota Burger Company, 14889 Florence Trail. D. Approve 2025 Fuel Dispensing Facility Permit for Holiday Stationstores, LLC, d/b/a Holiday Stationstore #2746584, 15550 Cedar Avenue. E. Approve appointment of City Representatives to the Minnesota Valley Transit Authority (MVTA) Board of Commissioners and Technical Work Group. F. Receive 2024 Police Department Annual Report. G. Surplus Parks Equipment 1. Declare miscellaneous City property and unclaimed property to be surplus. 2. Approve agreement with SLA Auctions, LLC, to hold an online auction. H. Adopt Resolution No. 2025-81 receiving Feasibility Study for PFAS Removal Project 2024-137, PFAS Treatment Facility Study. I. Adopt Resolution No. 2025-82 approving plans and specifications for Project 2024- 102, Utility Improvements (Hayes Trail/Longridge Park), and authorizing advertisement for receipt of bids on June 17, 2025, at 2:00 p.m. (2023 Parks Bond Referendum). J. Adopt Resolution No. 2025-83 approving plans and specifications for Project 2025- 154,Neighborhood Parks Improvements, and authorizing advertisement for receipt of bids on June 12, 2025, at 2:00 p.m. (2023 Parks Bond Referendum). K. Approve grant agreement with the Board of Water and Soil Resources for two Watershed Based Implementation Fund Projects: FY25 EVR-P55 Zoo Blvd. Pond and FY25 Black Dog WMO Targeted Pretreatment Sumps. L. Adopt Resolution No. 2025-84 awarding agreement for Project 2025-104, Johnny Cake Ridge Road (147th to 140th Street) Improvements,to McNamara Contracting, Inc. M. Approve purchase of Traffic Signal Controller Cabinet for Project 2025-104, Johnny Cake Ridge Road (147th to 140th Street) Improvements. N. Approve First Amendment to Joint Powers Agreement with Dakota County for Bike and Pedestrian Plan Update. O. Approve Change Order No. 1 to agreement with Kusske Construction Co, LLC, for Project 2025-127, 140th Street(Pilot Knob to Erickson Park) SS Improvements, and approve acceptance and final payment. P. Approve acceptance and final payment on purchase order with Webber Recreational Design, Inc., for branding and play features for Project 2024-187, Family Aquatic Center Improvements (2023 Parks Bond Referendum). Q. Approve claims and bills. R. Approve the personnel report. End of Consent Agenda CITY OF APPLE VALLEY Dakota County, Minnesota May 22, 2025 Page 3 Regular Agenda A. Music in Kelley Park Apple Valley Arts Foundation representatives Mary Hamann-Roland,Nicole Junker, and Shelli Ricci provided information about the 2025 Music in Kelley Park concert series. Mayor Hooppaw read the proclamation. The Council thanked the Apple Valley Arts Foundation for providing this great community event and the MVTA for providing transportation. MOTION: of Hiebert, seconded by Grendahl,proclaiming "Music in Kelley Park" on June 20 and 27; July 11, 18, and 25; August 1, 8, 15, and 22; and September 6 and 13, 2025, and declaring it a community festival. Ayes - 5 -Nays - 0. B. Poppy Days Proclamation Ms. Gina Dierfeldt, 1st Vice President of the Apple Valley American Legion Auxiliary,Unit 1776, was present and read the proclamation. MOTION: of Grendahl, seconded by Bergman, proclaiming May 23, 2025, as "Poppy Day" and May 2025 as "Poppy Month" and asking citizens to pay tribute to those who have died in war in the name of freedom. Ayes - 5 -Nays - 0. C. Memorial Day Proclamation Mr. Bernie Baumann, Post Commander of the Apple Valley American Legion, Post 1776, introduced this item, discussed the importance of Memorial Day, and read the poem In Flanders Fields by John McCrae. Mayor Hooppaw read the proclamation proclaiming May 26, 2025, "Memorial Day" and invited everyone to the Memorial Day ceremonies at 8 a.m. at Lebanon Cemetery and 10:00 a.m. at the Apple Valley American Legion Memorial. MOTION: of Grendahl, seconded by Hiebert, acknowledging the Federal Proclamation of May 26, 2025, as "Memorial Day" and asking citizens to remember those who were casualties and injured in the various wars and police actions of the United States. Ayes - 5 -Nays - 0. D. Planned Development No. 975 (PD-975) Impervious Surface Amendment Ms. Stroeing stated Erik and Amy Edstrom, 6085 158th Court West, have requested a zoning code text amendment to "PD-975", Zone 1 (Planned Development No. 975). The request is to consider amending the impervious surface coverage requirements for lots that are 9,999 sq. ft. or less in area to allow an additional 10% impervious surface coverage if an on-site stormwater management facility is approved and utilized to mitigate the additional impervious surface. A public hearing for the requested amendment was held at the May 7, 2025, Planning Commission meeting. All public CITY OF APPLE VALLEY Dakota County, Minnesota May 22, 2025 Page 4 comments received have been in support of the amendment. The Planning Commission had no comments or concerns and recommended approval of the amendment as drafted by a 4-0 vote. MOTION: of Melander, seconded by Bergman, to pass an Ordinance amending Article 32, Planned Development No. 975 of the City Code by amending impervious surface requirements. Ayes - 5 -Nays - 0. E. Cannabis Microbusiness Text Amendments At the request of the applicant, this item was moved to the June 12, 2025, regular City Council meeting. Communications Mayor Hooppaw and Councilmember Grendahl thanked the Chamber of Commerce, staff, and attendees of the State of the City Address. Ms. Scipioni provided an overview of the City's new agenda, minutes, and packets website. In honor of Public Works Week, Mr. Lawell highlighted the responsibilities of the Public Works Department and thanked them for their valued service to the community. Calendar of Upcoming Events MOTION: of Grendahl, seconded by Melander, approving the calendar of upcoming events as included in the Deputy City Clerk's memo, and noting that each event listed is hereby deemed a Special Meeting of the City Council.
