PRESENT: Mayor Garrison; Councilmembers Kelly and Savanick; Clerk Asleson. ABSENT: Councilmembers Branning and Overgard. Mayor Garrison called the meeting to order at 7:35 p,m. The Councilmembers and everyone in attendance took part in the pledge of allegiance to the flag. MOTION: of Kelly, seconded by Savanick, approving the agenda for tonights APPROVE AGENDA meeting as amended. Ayes - 3 - Nays - O. MOTION: of Kelly, seconded by Savanick, approving all items on the consent CONSENT AGENDA agenda with no exceptions. Ayes - 3 - Nays - 0. CONSENT AGENDA ITEMS MOTION: of Kelly, seconded by Savanick, adopting Resolution No. 1982-6 designating the Dakota County Tribune as the official newspaper of the City for 1982. Ayes - 3 - Nays - O. RES. 1982-6 NEWSPAPER RES. 1982-7 BANK DEPOSITORY RES. 1982-8 ADDITIONAL BANK DEPOSITORIES TRANS. MERCHANT LICENSE MOTION: of Kelly, seconded by Savanick, adopting Resolution No. 1982-7 de- signating the First State Bank of Apple Valley as the official depository for 1982 for the City's payroll and checking accounts and certificates of deposit and accepting deposit collateral. Ayes - 3 - Nays - 0. MOTION: of Kelly, seconded by Savanick, adopting Resolution No. 1982-8 de- signating additional depositories for 1982 for City investment funds at First National Bank of St. Paul, First Federal Savings & Loan of Hastings, Community State Bank of Apple Valley, Twin City Federal Savings and Loan, Midwest Federal Eagan Branch, First National Bank of Minneapolis and Northwestern National Bank of Minneapolis. PERMITS dominium units on part of Outlot B of Hamlet I and a variance for OUTLOT B, the number of required parking spaces as shown on the site plan HAMLET I with occupancy subject to replatting the property as recommended by the Planning Commission. MOTION: of Kelly, seconded by Savanick, granting a 12-month extension to the special use permit for Central Telephone Company to park a trailer for switching equipment at its building on Garden View Drive and Walnut Lane until December of 1982. Ayes - 3 - Nays - 0. MOTION: of Kelly, seconded by Savanick, approving a revised final plat and development agreement for Morningview subdivision and authorizing the Mayor and Clerk to sign the same. ON AGENDAS END OF CONSENT AGENDA ITEMS MOTION: of Kelly, seconded by Savanick, approving the minutes of the regular meeting of December 22, 1981, and the special meeting of January 7, 1982, as written. Ayes - 3 - Nays - 0. MOTION: of Savanick, seconded by Kelly, to place an audience discussion item with a 10-minute time limit, for items not on the agenda, as a regular item on future meeting agendas. Ayes - 3 - Nays Mayor Garrison asked if there was anyone in the audience who wished to speak at this time. There was no one. Mayor Garrison called the public hearing to order at 7:41 o'clock p.m. ON-SALE LIQUOR on the application of Cedar Valley A & W, Inc., d/b/a Apple Valley Green- PUBLIC HEARING streets, for an on-sale and Sunday liquor license and noted receipt of the affidavit of publication of the hearing notice. Mr. Asleson said the application is for the location of 7543 West 147th Street and is in order. Gerald Huston, repre- senting the applicant, was present and said they are remodeling the building and plan to open in March. The Mayor asked for questions or comments from the audience. There were none and the hearing was closed at 7:44 p.m. Mayor Garrison called the public hearing to order at 7:45 o'clock p.m. on Project 81-17, Cedar Avenue upgrading between 140th Street and Whit- ney Drive, and noted receipt of the affidavit of publication of the hearing notice. The Council received a letter, dated January 5, 1982, from Dorothea N. Russell objecting to the improvements. PROJ. 81-17 CEDAR AVENUE PUBLIC HEARING Mr. Asleson distributed cost estimate information on the project, dated January 14, 1982, and reviewed this information with the Council. The total project amount is $2,629,782 of which $1,678,657 will he Federally funded, $449,895 paid by the County and $501,230 paid by the City. He also reviewed pro forma assessment costs to property abutting the road and said after the bids are received January 18, 1982, the actual costs will be known. John Gretz reviewed the detours to be used during the construction of both County Road 42 and Cedar Avenue. Mayor Garrison then asked for questions and comments from the public. (See details of questions and answers attached). After everyone present had been given an opportunity to comment, the hearing was closed at 8:15 p.m. MOTION: of Garrison, seconded by Savanick, adopting Resolution No. 1982- RES. 1982-9 9 appointing Councilmember Kelly as Acting Mayor for the year ACTING MAYOR 1982. CITY OF APPLE VALLEY Dakota County, Minnesota January 14, 1982 Page 3 The Council received a memo from John Gretz, dated January 4, 1982, concern- ing a telephone request for flooding a skating rink in Palomino Park. The resident said a petition would be presented to the Council at this meeting. The Mayor asked whether the person was present at the meeting and the person was not. No action was taken SKATING RINK CHULYAK PLAN- NING COM. RES'IG. ORD. NO. 264 LIQUOR IN PARKS_ RES. 1982-10 MID-WINTER FEST VALLEY BIKE & SKI PARTY PERMIT The Council received a letter of resignation from Michael Chulyak from the Planning Commission, effective February 1, 1982, and requested that the Mayor send a letter to him thanking him for his service. MOTION: of Kelly, seconded by Savanick, passing Ordinance No. 264 amending Section 14.5-3 of the City Code to permit liquor in parks only when a party permit has been issued by the City Council. Ayes - 3 - Nays - 0. MOTION: of Savanick, seconded by Kelly, adopting Resolution No. 1982-10 proclaiming the week of February 1 through 7, 1982, to be "APPLE VALLEY MID-WINTER FEST '82". Ayes - 3 - Nays - 0. MOTION: of Savanick, seconded by Kelly, granting a party permit, under Code Section 14.5-3(g), to Valley Bike & Ski, Inc., for a wine and cheese party at Lebanon Hills Golf Course on February 5, 1982, in connection with the Mid-Winter Fest activities. Ayes - 3 - Nays - 0. Consideration of an appointment to fill a vacancy on the Paratransit Committee was tabled until January 28, 1982. MOTION: of Savanick, seconded by Garrison, adopting Resolution No. 1982- 11 supporting the acquisition of the Rollins property by Dakota County and urging the County Board to grant final approval for the acquisition based on the condemnation award. Ayes - 3 - Nays - 0. RES. 1982-11 ROLLINS PROPERTY The Council discussed the League of Minnesota Cities Legislative Conference LMC LEGISLATIVE scheduled for January 27, 1982, and Councilmember Savanick said she would CONFERENCE attend during the day and Councilmember Kelly said she would attend during the evening. Mr. Astesonwas asked to contact the City's Legislators and ask them to attend also. The Council received the 1982 League of Minnesota Cities Proposed Legislative Policies and concurred with them. MOTION: of Kelly, seconded by Savanick, adopting Resolution No. 1982-12 approving the plans and specifications for Project 80-16, South- port and Southport East Utilities, and authorizing advertisement for bids to be received at 2:00 p.m. on February 24, 1982. Ayes - 3 - Nays - 0. RES. 1982-12 PROJ. 80-16 PLANS & BIDS SET SPECIAL MEETING There were no parttime employees to be hired. MOTION: of Kelly, seconded by Savanick, setting a special closed meeting at 7:30 p.m. on February 18, 1982, at the City Hall, under the attorney-client exception to the open meeting law, regarding the Apple Valley Red-E-Mix (Fischer Gravel) litigation. Ayes - 3 - Nays - 0. CITY OF APPLE VALLEY Dakota County, Minnesota January 14, 1982 Page 4 MOTION: of Savanick, seconded by Kelly, setting a special meeting at 7:30 p.m. on March 18, 1982, at the City Hall to review the City's Master Sanitary Sewer and Water Plans. Ayes - 3 - Nays - 0. SET SPECIAL MEETING The Council received a memo, dated January 14, 1982, from Police Chief Rivers concerning traffic conditions since 4-way stop signs were instal- led at the intersection of 140th Street and Cedar Avenue. He recommends no change. 140TH & CEDAR STOP SIGNS CLAIMS & BILLS MOTION: of Kelly, seconded by Savanick, to pay the claims and bills, checks numbered 23694 and 25898 through 25999, in the total amount of $1,096,785.27. Ayes - 3 - Nays - 0. MOTION: of Kelly, seconded by Savanick, to adjourn. Ayes - 3 - Nays - 0. The meeting was adjourned at 8:36 o'clock p.m. CITY OF APPLE VALLEY Dakota County, Minnesota January 14, 1982 Detail of Questions and Answers at Public Hearing on Project 81-17, Cedar Avenue. Jim Heidemann asked about driveway access to his property during construction. Mr. Gretz said some type of access will be maintained for him. Joe Graeve asked how long the construction will take? Mayor Garrison said the contract is written to be completed by the end of the 1982 construction season except for some cleanup work in Spring of 1983. Robert Levine asked about access to the northwest quadrant of Cedar and County Road 42? Mr. Gretz said he would review the plans with him. Duane Barth asked if his property would have assessments for both utilities and the road? Mr. Asleson said it would be assessed for the road only. Vurl Warmoth, of Mt. Olivet Church, asked which assessment class the church property is in? Mr. Asleson said Class 1, with Industrial and Commercial. Robert Levine asked about assessments to the Apple Valley Center property? Mr. Asleson said it would be assessed only for the road. Jim Heidemann asked which assessment class his property is in? Mr. Asleson said part of it is in Class 2, Multiple, and 100 feet is in Class 3, Single Family with Access. Glen Galles asked for an explanation of the assessment policy. Mr. Asleson reviewed the policy and said it is the same as was used for the County Road 42 project. Vurl Warmoth asked for the estimated amounts of the assessments to the church property and said he is concerned about the ability of the church to pay these assessments. Mr. Asleson said the assessments are estimated at $11,000 for utilities and $3,900 for the road and would be spread over 15 years. Gerald Puckett said the church had previously paid some utility assessments and asked what those were. Mr. Asleson said those were utility trunk assessments and these assessments are utility lateral charges.
