PRESENT: Mayor Hooppaw; Councilmembers Bergman, Grendahl, and Melander. ABSENT: Councilmember Hiebert. City staff members present were: City Administrator Lawell, City Clerk Scipioni, City Attorney Hills, City Engineer Anderson, Community Development Director Benetti, Parks and Recreation Director Carlson, Deputy Police Chief Dahlstrom, City Planner Dill, Police Chief Francis, Assistant City Administrator Grawe, Human Resources Manager Haefner, Liquor Manager Heyne, Liquor Assistant Manager Nichols, and Public Works Director Saam. Mayor Hooppaw called the meeting to order at 7:00 p.m. Everyone took part in the Pledge of Allegiance to the flag. Approval of the Agenda MOTION: of Grendahl, seconded by Bergman, approving the agenda for tonight's meeting, as presented. Ayes - 4 - Nays - 0. Audience Mayor Hooppaw asked if anyone was present to address the Council, at this time, on any item not on this meeting's agenda. Consent Agenda Mayor Hooppaw asked if the Council or anyone in the audience wished to pull any item from the consent agenda. There were no requests. MOTION: of Melander, seconded by Grendahl, approving all items on the consent agenda with no exceptions. Ayes - 4 - Nays - 0. Consent Agenda Items A. Approve the minutes of the regular meeting of September 11, 2025. B. Adopting Resolution No. 2025-135 setting a public hearing at 7:00 p.m. on October 23, 2025, for a new On -Sale Intoxicating Liquor and Special License for Sunday Liquor Sales, for Brick & Bourbon Apple Valley, LLC, 14883 Florence Trail. C. Adopt Resolution No. 2025-136 supporting Minnesota suburban transit providers D. Approve issuance of 2025 License to Sell Tobacco or Tobacco Products to Holiday Stationstores, LLC, 15550 Cedar Avenue. E. Approve the Truth in Taxation supplemental insert. F. Approve reduction of financial guarantee. L. Approve release of Natural Resources Management Permit financial guarantee. M. X. Approve Change Order No. 5 to agreement with Jerry's Transmission Service, Inc., d/b/a North Central Emergency Vehicles, for 2025 Fire Engine, Triple Combination Pumper. Y. Approve Change Order No. 16 for Project 2021-172, Police Garage Z. Approve Change Order No. 1 to agreement with McNamara Contracting, Inc., for Project 2024-153, Pickleball Court Expansion at JCRPW (2023 Parks Bond Referendum). AA. Approve Change Order No. 1 to agreement with Kunkel Eclectic, Inc., for lighting installation for Project 2024-153, Pickleball Court Expansion at JCRPW (2023 Parks Bond Referendum). BB. Approve Change Order No. 35 to agreement with Terra General Contractors, LLC, d/b/a Terra Construction, for Project 2024-187, Family Aquatic Center Improvements (2023 Parks Bond Referendum). Approve Change Order No. 1 to agreement with Kraus -Anderson Construction Company for Project 2024-190, Kelley Park Renovation (2023 Parks Bond Referendum). EE. Approve acceptance and final payment on agreement with Hawkins, Inc., for Project 2025-146, 2025 Outdoor Pool Water Management. FF. Approve claims and bills. GG. Approve the personnel report. HH. Approve First Amendment to Purchase Agreement for the City -Owned "Fraser Parcel" (Lot 2, Block 1, Fraser Addition). End of Consent Agenda Regular Agenda A. Proclaim October 5 through 11, 2025, as "Fire Prevention Week" and authorize activities planned at fire stations. Chief Nelson read the proclamation and shared information about the 2025 Fire Prevention Week open houses and activities. The theme for this year is "Charge into Fire SafetyTM: Lithium - Ion Batteries in Your Home". MOTION: of Grendahl, seconded by Bergman, proclaiming October 5 through 11, 2025, as "Fire Prevention Week" and authorizing activities planned at fire stations. Ayes - 4-Nays-0. B. Valley Station Apartments Ms. Dill stated the applicant, Real Estate Equities (REE), requests amendments to Appendix F, Article 18, Planned Development No. 507, and Site Plan/Building Permit Authorization to allow construction of Valley Station Apartments, a five -story, 144-unit affordable workforce housing apartment development on Lot 1, Block 2, Carroll Center 4th Addition. Ms. Dill provided an overview of the application as described in the staff memo. MOTION: of Bergman, seconded by Melander, to pass an Ordinance amending Article 18, Planned Development No. 507. Ayes - 4 - Nays - 0. MOTION: of Melander, seconded by Grendahl, to adopt Resolution No. 2025-141 approving Planned Development Agreement. Ayes - 4 - Nays - 0. MOTION: of Melander, seconded by Bergman, to adopt Resolution No. 2025-142 approving Development Agreement. Ayes - 4 - Nays - 0. MOTION: of Bergman, seconded by Melander, to adopt Resolution No. 2025-143 approving Site Plan Review and Building Permit Authorization. Ayes - 4 - Nays - 0. Communications Mr. Hedberg provided an overview of the 2026 budget process and shared that a Budget Open House will be held November 18 from 4 to 6 p.m. at the Apple Valley Municipal Center. Mr. Heyne and Mr. Nicols shared information about an upcoming Food and Wine Pairing Event to be held on October 7 at Revolve Hall. Chief Francis shared that there will be an open house at the Police Operations Building on September 30 from 5 to 7 p.m. Councilmember Grendahl thanked staff for hosting another successful Fall Clean -Up Day. Mayor Hooppaw thanked all the staff who were involved with updating the Apple Valley Bike Pedestrian Plan. Calendar of Upcoming Events MOTION: of Grendahl, seconded by Bergman, approving the calendar of upcoming events as included in the Deputy City Clerk's memo, adding the October 7, 2025, Food and Wine Pairing, and noting that each event listed is hereby deemed a Special Meeting of the City Council.
