HomeMy WebLinkAbout09/27/1981CITY OF APPLE VALLEY Dakota County, Minnesota September 29, 1981 Minutes of the special meeting of the City Council of Apple Valley, Dakota County, Minnesota, held September 29, 1981, with due call and notice thereof, following a closed meeting under the attorney-client exception to the open meeting law. PRESENT: Mayor Garrison; Councilmembers Branning, Kelly, Overgard and Savanick; Clerk Asleson. ABSENT: None. Mayor Garrison called the meeting to order at 9:24 p.m. The Mayor stated that the Council had been meeting with its attorneys, David Graven and Larry Wertheim, on the Apple Valley Red-E-Mix, Inc., vs. City of Apple Valley litigation. MOTION: of Overgard, seconded By Kelly, authorizing the firm of Holmes and Graven to appeal the Court decision, dated September 17, 1981, in the matter of Apple Valley Red-E-Mix, Inc., vs. City of Apple Valley. Mr. Graven stated that the Council had held a closed meeting, as permitted by law, which began at 7:30 p.m. tonight. He said he had advised the Council at the be- ginning of that meeting that if they discussed anything other than the matter of the litigation, he would leave the room. He stated that they had not discussed any- thing else and he advised them that their decision should be made at a public meeting. Mr. Graven also said that any public discussion of what was discussed at the closed meeting would cause the loss of the attorney-client privilege. Mayor Garrison said the Council's action to appeal also authorizes the attorneys to take whatever steps are necessary to protect the public's interest in this matter. Vote was taken on the motion. Ayes - 5 - Nays - 0. MOTION: of Savanick, seconded by Branning, to adjourn. Ayes - 5 - Nays - 0. The meeting was adjourned at 9:29 o'clock p.m.
