Minutes of the special meeting of the City Council of Apple Valley, Dakota County,
Minnesota, held September 30, 1981, with due call and notice thereof, at the
City Hall.
PRESENT: Mayor Garrison; Councilmembers Branning, Kelly and Savanick (attended at
5:42 p.m.); Deputy Clerk Mueller.
ABSENT: Councilmember Overgard.
Mayor Garrison called the meeting to order at 5:35 p.m. Steve Mattson was present
and commented on proposed Federal legislation which will prohibit or restrict the use
of industrial-commercial revenue bond financing. He said no official statements have
been issued, but the best information available is that this financing must have final
approval by October 1st and be completed by October 15th. Mr. Mattson said Note 33
of the Academy Village project can be completed under these deadlines, but none of the
other projects, which have already received preliminary approval by the City, appear
to be far enough along with their financing to be completed.
Tom Heiberg was present and said Note 33 is for a fourplex on Lot 6, Block 2, Academy
Village, to be purchased by S & T Partnership. He said the Partnership includes Mr.
Mattson and himself at this time because the original buyer for the building was not
able to complete the purchase and another buyer has not yet been found. Mr. Mattson
said the attorneys had determined there was no conflict of interest for him when he
purchased another fourplex in Academy Village, which he has since sold, but if the
Council would prefer that someone else be in the partnership, that could be done.
Mayor Garrison said he would rather have Mr. Heiberg find someone else for the partner-
ship to avoid any possible conflicts.
MOTION: of Branning, seconded by Kelly, adopting Resolution No. 1981-174
approving Academy Village Commercial Development Note No. 33 on
Lot 6, Block 2, Academy Village. Ayes - 4 - Nays - 0.

Mr. Mattson said he will be watching the proposed legislation and keep the Council
informed on its results.
Deputy Clerk Mueller advised the Council that an error has been found in the hearing
notice for Assessment Roils 180, 181 and 182 and asked that the public hearing be
rescheduled so corrected notices could be given. There are no changes in any of the

175 rescinding Resolution No. 1981-166 and approving proposed
Assessment Roils 180, 181 and 182 and setting a public hearing
on them at 7:30 p.m. on October 29, 1981, at the City Hall.
