Roll call vote: Ayes – 6 – Nays – 0. B. Fraser 1st Addition Chair Kurtz opened the public hearing. Associate Planner Stroeing provided a brief presentation. Commissioner Scanlan asked about traffic possibly decreasing with the proposed zoning change from residential to limited business and asked for clarification on the use of the pond to the west. Associate Planner Stroeing stated that an office use would generate more traffic than a residential use. It is unlikely that this site would ever be allowed for high density residential due to the existing site conditions, the City’s vision, and zoning requirements. The pond to the west is a regional area storm water pond. Commissioner Scanlan asked if any modifications would need to be made to the pond area. Associate Planner Stroeing stated that storm water is always considered with new developments and nothing has been brought forward at this time. The current request is only for a Comprehensive Plan Amendment. There are no proposed changes to Lot 1. Chair Kurtz said that this proposal seems like a best-case scenario for the residents near this lot. Resident, Dr. Angie Lauer-Schaeppi (260 Strese Ln.), asked if it would be an option to leave the lot as is and more of a naturally preserved area. Associate Planner Stroeing stated that the site was targeted to be developed by 2030 in the Comprehensive Plan and was never intended to sit vacant. The property was originally subdivided by Fraser, and the City sold the north half to Fraser and it was intended that they would buy it in the future to expand. When the City began the RFP process, Fraser did not have interest in buying the lot. With no further comments or questions, Chair Kurtz closed the public hearing. Summary: The City is initiating an amendment to the 2040 Comprehensive Plan Land Use Map to redesignate 2.19 acres of property (Lot 1) from "HD" (High Density Residential 12+ units/acre) to "C" (Commercial), and 1.21 acres of property (Lot 2) from "SIHD" (Suburban Intensive High Density Residential 24 to 48 units/acre) to "C" (Commercial). The subject properties are located at the northwest corner of 147th Street West and County Road 42 - Lot 1 and Lot 2, Block 1, Fraser 1st Addition. Lot 1 is the existing property of Fraser Living Facility (a/k/a Apple Grove Court). Lot 2 is a City-owned vacant property. Both properties are zoned for "LB" Limited Business, which is inconsistent with the HD and SIHD land use designations. The purpose of the amendment is to bring the land use designations into conformance with the existing LB zoning. The public hearing for this comprehensive plan amendment was held at the November 19, 2025, Planning Commission meeting. All public comments and questions were answered by staff at the hearing. Background: When the City reviews an amendment to the Comprehensive Plan, it has the most discretion to determine whether the use is appropriate for the location and consistent with the development vision of the area. Lot 1 and Lot 2 were designated from C to HD with the 2030 Comprehensive Plan Update. Lot 2 was then designated to SIHD with the 2040 Comprehensive Plan Update. It is a requirement and best practice to align a property's zoning and land use designation. The properties were never rezoned from LB to align with the updated residential land use designations. Staff does not anticipate that Lot 1 and Lot 2 will be developed as high-density residential in the future due to existing site conditions, zoning requirements, and the City's vision of the area. Lot 1 is the current site of a 17-unit assisted care facility for adults with disabilities. This is an allowed conditional use under the LB zoning district. Lot 1 received a conditional use permit (CUP) for the facility in 1999. The existing use of the Fraser-owned property as an assisted care facility and the approved CUP will not be affected by this proposed amendment. Staff have sent correspondence to the property owner of Lot 1 regarding the proposed update. No comments have been received from Fraser Living on the proposed amendment. Lot 2 is a vacant City-owned parcel. This property is currently under a purchase agreement with Northland Real Estate Group. The City Council approved this purchase agreement with the developer's intent of developing the property with a use allowed under the LB zoning district. The proposed amendment is in alignment with the anticipated future development of the property. Future development of Lot 2 will be presented to the Planning Commission and City Council for consideration. Apple Valley's 2040 Comprehensive Plan provides the following guidance (but not limited to) for Commercial and Limited Business developments: • The City uses the zoning ordinance to regulate the intensity and characteristics of development. Lower-intensity districts include Limited Business and Neighborhood Commercial. • The Limited Business designation is reserved for general offices and businesses that exclude retail activities. Business operations usually occur within an enclosed building and are generally limited to weekdays. • Limited Business uses are located adjacent to the retail core of the downtown and may act as a transition to residential neighborhoods. • Significant traffic attracted by the site development shall be generally limited to the morning and evening peak hours with modest levels of off-peak activity. There are no concerns, and summaries have been provided below. Traffic 1. The intersection of 147th St W and CSAH 42 is proposed to be reconstructed as a ¾ access (left turn prohibited for vehicles entering CSAH 42) in 2027 by Dakota County. This was considered as part the traffic analysis. The full traffic study is attached. 2. To estimate the difference in the trip generation between the existing and proposed zoning, a trip generation estimate was developed for the a.m. and p.m. peak hours and a daily basis. The estimate, shown in Table 1, was developed using the ITE Trip Generation Manual, 11th Edition. Results of the trip generation estimate indicate that the current zoning is expected to generate 28 a.m. peak hour, 32 p.m. peak hour, and 378 daily trips. With the proposed rezoning, the lots are estimated to generate 41 a.m. peak hour, 52 p.m. peak hour, and 511 daily trips. This results in the rezoned properties generating an additional 13 a.m. peak hour 20 p.m. peak hour and 133 daily trips. The main objectives of the study are to estimate the current trips occurring or that are currently allowed through zoning and compare with the trips expected with the future re-zoning of the lots. The following information provides the assumptions, analysis, and study recommendations offered for consideration. Proposed Zoning Changes There are currently two (2) lots that are proposed to be rezoned as shown in the picture below. North Lot South Lot 150th Street/CSAH 42 Apple Grove Court Zoning Study November 12, 2025 Page 2 of 6 • The northern lot includes the current Apple Grove Court, a housing development by Fraser. o This lot is currently 2.19 acres and zoned High Density Residential (12+ units per acre). There are currently 17 residential units on site. o It is proposed to be re-zoned to Commercial with Limited Business. o It is not expected that this site will redevelop in the near future, as this building was recently constructed. • The southern lot is currently empty. o This lot is currently 1.21 acres and zoned Suburban Intensive High Density (24 to 48 units per acre). o Under the current zoning, it is expected that there could be up to 58 units of housing on the southern lot. o It is proposed to be rezoned to Commercial with Limited Business. The maximum building coverage is 20 percent. o With Limited Business, this could include office and professional services (offices, clinics, banks, daycare). No retail or over the counter sales are permitted. o Under the future zoning, it is expected that there could be up to approximately 11,000 square feet of office type use. o Given the land uses that could be included on site, the most trip intensive use is expected to be a Medical/Dental Office type use. The site generated trips under the existing roadway configuration are shown in Figure 2 for the a.m., p.m., and daily trips. In addition to being distributed under the existing roadway configuration, it is expected that at the CSAH 42 (150th Street) and 147th Street intersection, there will be an access modification to a three-quarter access that restricts side-street left-turns in the near future. A site generated trips estimate is shown in Figure 3 with the access modification. Given the expected travel times and the movements that are impacted, it is expected that southbound left-turning vehicles that were at 147th Street will now be re-routed and utilize Pennock Avenue to turn southbound left onto CSAH 42. Summary: The City is initiating the review of a site plan/building permit authorization for a 10,000 square foot addition to the Apple Valley Community Center (AVCC) and Apple Valley Senior Center (AVSC). The building addition will connect and create a common entrance to AVCC and AVSC. The building addition will include a common entrance and lobby area, coffee lounge, indoor play area, and party rooms. This project is part of the 2023 voter-approved Parks Referendum. AVCC and AVSC are located at Hayes Park (14601 Hayes Road). There are currently three existing buildings on the Hayes Park property: Wings Arena (f/k/a Hayes Arena), AVCC, and AVSC. AVCC and AVSC will be connected into one building; Wings Arena will continue to exist as a separate building. There has been recent construction of other site improvements at Hayes Park, which were approved through a separate building permit and did not require Planning Commission review. These site improvements include updated athletic fields, trails, stormwater ponds, and additional parking. The outdoor park facilities are shared with Westview Elementary and ISD 196 through a joint agreement. Section 153.20 of the City Code provides that no building permit shall be granted for the construction of any building/structure on a property which is not platted. The City Council granted the temporary waiver of platting for the City's park properties, including Hayes Park, that are not platted as adopted by Resolution No. 2024-33. The plat for Hayes Park will be reviewed by the Planning Commission and City Council in the future. Background: Comprehensive Plan: The Hayes Park property is guided "P" (Parks & Open Space). The P designation applies to all existing public parks, public playfields, trail corridors, and golf courses. The plans for this project are consistent with the land use designation. Zoning: The property is zoned "P" (Institutional). Recreational buildings are allowed as permitted use in this zoning district. The applicable minimum area requirements are included in the chart below. Other recently constructed site plan improvements, as noted in the summary, were reviewed by staff with the building permit. The 10,000 square foot addition will connect the south side of AVSC to the northwest side of AVCC. The impacted area will include the removal of an existing outdoor playground, landscaping, utilities, portion of trail, and parking that is directly adjacent to AVCC and AVSC. All removals will be replaced and/or reconfigured to accommodate the building addition. The existing parking area near AVCC and AVSC will be redesigned to better serve the facility. There are currently 109 parking stalls. The proposed site plan shows the removal of 13 parking stalls for a total of 96. Staff has no concerns with the parking changes. Architectural Plans & Elevations: The primary building materials of the building addition include architectural precast wall panels with a custom pattern, and glass. Secondary materials include prefinished metal soffit and trim, and a composite metal cladding. The proposed materials and material colors will complement the existing buildings. The architectural plans also include a roof plan that shows the location of rooftop units and associated screening. All units will be screened by adjacent parapet walls or screens immediately surrounding the equipment. The elevations show a metal louver mechanical screening surrounding a rooftop unit on the south end of the addition. All screening mechanisms are required to be at least the height of the adjacent unit(s). Staff will review the building permit to confirm the height of units and associated screening to ensure all screening requirements are met. Landscaping: Fourteen trees that are within the construction zone of the building addition will be removed. An additional 69 trees, as well as various shrubs, grasses, and perennials, will be planted around the new common entrance. Additionally, approximately 181 trees will be planted across Hayes Park and Westview Elementary as part of the approved Hayes Park Youth Athletic Complex project. Staff will review the building cost to ensure that the 2.5% landscaping requirement is met when the building permit is submitted. Recommended Conditions of Approval:The following conditions are recommended for approval of the site plan/building permit authorization: 1. If the building permit is not paid for and issued within one (1) year of the date of approval, the approval shall lapse. 2. The property shall be platted so as to identify the real property as lot and block, and said approved final plat shall be recorded with the Dakota County Recorder’s Office no later than the Building Official’s issuance of the certificate of occupancy as directed by Resolution No. 2024-33. 3. Construction shall occur in conformance with the site plan, dated November 14, 2025, including parking lot paving and a non-surmountable concrete curb and gutter. 4. Construction shall occur in conformance with the landscape plans, dated November 14, 2025, (including sodded/seeded public boulevard area up to each street curbline); subject to submission of a detailed landscape planting price list for verification of the City’s 2½% landscaping requirement at the time of building permit application. 5. Construction shall occur in conformance with the elevation plans, dated November 14, 2025. 6. Construction and all site improvements shall be subject to all conditions outlined in the City Engineer’s memo dated December 11, 2025, on file with the City. 7. Construction and all site improvements shall be subject to all conditions outlined in the Building Official’s memo, dated December 4, 2025, on file with the City. 8. All necessary mechanical protrusions visible to the exterior shall be screened or handled in accordance with Section 155.346 (3) (a) (b) of the city code. 9. Site grading shall occur in conformance with a Natural Resources Management Plan (NRMP) which shall include final grading plan to be submitted for review and approval by the City Engineer; subject to the applicant submitting a copy of the General Storm Water Permit approval from the Minnesota Pollution Control Agency pursuant to Minnesota Rules 7100.1000 - 7100.1100 regarding the State NPDES Permit prior to commencement of grading activity. 10. Infiltration areas shall be constructed in conformance with City standards. 11. Site and building lighting shall consist of downcast, shoebox lighting fixtures or wallpacks with deflector shields which confines light to the property and shall be installed in conformance with Section 155.353 of the city code. 12. Approval of a signage plan is not included with this site plan and building permit authorization. A separate application and signage plan in conformance with the sign regulations must be submitted for review and approval to the City prior to the erection of any signs. 13. Construction and earthmoving activities shall be limited to the hours of 7:00 a.m. to 7:00 p.m. Monday through Friday. Weekend construction hours shall be limited to Saturdays during the hours of 8:00 a.m. to 5:00 p.m. 14. Prior to issuance of a building permit, a construction staging and construction personnel parking plan shall be submitted and approved by the City. 15. Earthmoving activities shall not occur when wind velocity exceeds thirty (30) miles per hour. Watering to control dust shall occur as needed and whenever directed by the Apple Valley Building Official or Zoning Administrator. 16. Issuance of a Building Permit and a final Certificate of Occupancy is contingent upon the project being constructed in conformance with all the preceding conditions as well as all applicable performance standards of the current zoning regulations. 17. The ongoing use and occupancy of the premises is predicated on the ongoing maintenance of the structure and all required site improvements as listed in the preceding. No alteration, removal, or change to the preceding building plans or required site improvements shall occur without the express authorization of the City. Site improvements which have deteriorated due to age or wear shall be repaired or replaced in a timely fashion. Budget Impact: The project is part of the 2023 Parks Referendum.
