HomeMy WebLinkAbout2026-07-09 Regular Meeting Minutes July 9, 2026, City Council Regular Meeting Minutes Minutes of the regular meeting of the City Council of Apple Valley, Dakota County, Minnesota, held July 9, 2026, at 7:00 p.m., at the Apple Valley Municipal Center. Present: Mayor Hooppaw, Councilmembers Bergman, Hiebert, and Melander Absent: Grendahl City staff members present were: City Administrator Lawell, City Clerk Scipioni, City Attorney Bauer, City Engineer Anderson, Community Development Director Benetti, Parks and Recreation Directory Carlson, Deputy Police Chief Dahlstrom, Police Chief Francis, Assistant City Administrator Grawe, Human Resources Manager Haefner, Finance Director Lemarr, Fire Chief Nelson, and Public Works Director Saam. 1. Call to Order and Pledge Mayor Hooppaw called the meeting to order at 7:00 p.m. Everyone took part in the Pledge of Allegiance to the flag. 2. Approve Agenda Motion: of Bergman, seconded by Melander, approving the agenda for tonight's meeting as presented. Ayes-4- Nays—O. 3. Audience Mayor Hooppaw asked if anyone was present to address the Council, at this time, on any item not on this meeting's agenda. James Johnson, Dakota County Public Health Opioid Prevention Coordinator, spoke regarding programs offered by Dakota County to support opioid prevention and upcoming events to highlight Overdose Awareness Month. 4. Consent Agenda Mayor Hooppaw asked if the Council or anyone in the audience wished to pull any item from the consent agenda.There were no requests. Motion: of Hiebert, seconded by Bergman, approving all items on the consent agenda with no exceptions. Ayes-4- Nays—O. Consent agenda items A. Approve Agreement for Lozier Display Shelving and Installation with AA Equipment Company, Inc. N. Approve professional services agreement with I &S Group, Inc., d/b/a ISG Inc., for development of a Community Center Business Plan O. Approve statement of work with InvoiceCloud, Inc.,for the provision of credit card biller ID numbers P. Approve agreement with Pro-Tec Design, Inc.,for installation of security cameras and card readers as part of Project 2024-186, Community Center&Senior Center Connection and Renovation (2023 Parks Bond Referendum) Q. Adopt Resolution No.2026-88 accepting easements for Project 2026-130, Apple Valley 11th and 12th Additions Electrical Conversion Phase 2 R. Adopt Resolution No.2026-89 awarding agreement for Project 2026-130, Apple Valley 11th and 12th Additions Electrical Conversion Phase 2 S. Approve Change Order No. 4 to agreement with Kraus-Anderson Construction Company for Project 2024-190, Kelley Park Renovation (2023 Parks Bond Referendum) T. Approve Change Order No. 1 to agreement with Keys Well Drilling Company,for Project 2024-136A,Well 16 Recommissioning, and approve acceptance and final payment U. Regular Agenda A. Proclaim July 2026 as"Park and Recreation Month" Mr. Carlson highlighted the work done by the Parks and Recreation Department and thanked its staff for all they do for the community. Mr. Carlson read the proclamation Motion: of Hiebert, seconded by Melander, proclaiming July 2026 as"Park and Recreation Month"in the City of Apple Valley. Ayes-4- Nays—O. B. Interim Ordinance Authorizing a Study and Imposing a Moratorium on Data Centers Mr. Benetti provided an overview of the proposed resolution and ordinance. Mayor Hooppaw called the public hearing to order at 7:15 p.m. to consider the proposed resolution and ordinance.The Mayor asked for questions or comments from the Council and the audience. Mary Rue, 8163 137th Ct., asked clarifying questions regarding the proposed ordinance. Mr. Benetti answered Ms. Rue's questions. The hearing was declared closed at 7:17 p.m. Motion: of Bergman, seconded by Melander, adopt Resolution No. 2026-90 authorizing an interim use study regarding the planning, development, and regulation of data centers. Ayes-4- Nays -O. Motion: of Bergman, seconded by Melander, passing Ordinance No. 1158 instituting a moratorium that restricts the establishment of new data centers, expansion of existing data centers, and/or development of property for a proposed data center during the interim use study. Ayes -4- Nays - O. 6. Communications Mr.Anderson provided information about upcoming road closures. Chief Nelson stated the Fire Department is hiring paid-on-call firefighters. He encouraged community members to apply by July 17. The Mayor and Council thanked community members, local organizations, and City staff for all their efforts creating another wonderful Freedom Days celebration. 7. Calendar of Upcoming Events Motion: of Bergman, seconded by Melander, approving the calendar of upcoming events as included in the Deputy City Clerk's memo, and noting that each event listed is hereby deemed a Special Meeting of the City Council.
