HomeMy WebLinkAbout08/29/1978SPCCITY OF APPLE VALLEY Dakota County, Minnesota August 29, 1978 Minutes of the special meeting of the City Council of the City of Apple Valley, Dakota County, Minnesota, held August 29th, 1978, at 9:00 o'clock a.m. PRESENT: Mayor Branning; Councilmembers Fitzsimmons, Hayes, Holton and Savanick; Clerk Asleson. ABSENT: None. The City Council was convened for the purpose of holding a hearing under the City's personnel ordinance on the termination of employment of Police Officer Dwayne F. Bronk, said hearing having been requested by Mr. Bronk. Mr. McMenomy, City Attorney, requested that the start of the hearing be delayed for a short time inasmuch as the court reporter was not yet present. Following arrival of the court reporter, Mr. McMenomy outlined to the Council a proposed settlement that had been arrived at in the negotiations earlier on this date between himself and Larry Severson, Mr. Bronk's attorney. The City Council then debated the proposed settlement recommendation set forth by Mr. McMenomy with which Mr. Severson indicated concurrence on behalf of his client. MOTION: of Hayes, seconded by Branning, as full and final settlement between the matter between the City of Apple Valley and Dwayne Bronk. That the City agree to pay Mr. Bronk the amount of three months salary based on the salary rate in effect at the time of his termination. That there shall be deducted from that amount any amounts previously paid to Mr. Bronk for court appearances on behalf of the City. That all matters in Mr. Bronks personnel file dated after November 15, 1977, shall be removed from his file, placed in a separate file, which file shall be private under the Minnesota Data Privacy Act, and shall be in the custody of the responsible authority. Further, that of the amount to be paid to Mr. Bronk, fifty per- cent shall be paid now, and the balance shall be paid upon completion of all required court appearances for the City of Apple Valley for matters that involved him during his employment. Finally, Mr. Bronk is to forward to the City a letter of resignation. Ayes - 5 - Nays - 0. Following the vote on the motion, Mr. McMenomy interpreted the Council's motion for clarification purposes and asked Mr. Severson if he agreed with the motion and the interpretation that he had given and Mr. Severson indicated that he did agree wit~ the motion and the interpretation; said information being contained in the proceed- ings transcript prepared by Jeffrey F. Lang, a court reporter, a copy of which is attached to these minutes. MOTION: of Hayes, seconded by Savanick, to adjourn the meeting. Ayes - 5 - Nays - 0. The meeting was adjourned at approximately 11:05 o'clock a.m.
