Minutes of the meeting of the City Council of Apple Valley, Dakota County, Minnesota,
held April 28th, 1977, at 7:00 p.m.
PRESENT Mayor Branning; Councilmembers Fitzsimmons, Hayes and Holton; ClerkAsleson,
Councilmember Savanick.
ABSENT: Councilemember Savanick
Mayor Branning called the meeting to order at 7:00 p.m. The Councilmembers and everyone
in attendance took part in the pledge of allegiance to the flag.
MOTION: of Fitzsimmons, seconded by Branning, approving the agenda for APPROVE AGENDA
tonight's meeting as amended. Ayes - 2 - Nays - 1 (Hayes)
(Holton Abstained).
MOTION: of Fitzsimmons, seconded by Hayes, approving the minutes of the 'APRIL 14, 1977
meeting of April 14th, 1977, as written. Ayes - 4 - Nays - 0. MINUTES
Considerationof the proposed Forest Park development was tabled. Councilmember
Fitzsimmons said, when this Proposal was ·referred back tO the Planning Commission
at the CoUncil's April 14th meeting the Council did not say the Planning Commission
had to make a recommendation by tonight's meeting. This fact was evidently not
relayed to the Planning Commission by Staff and at least one member expressed a wish
to her for more time to consider it. John Voas said, because this item was scheduled
on the Council's tentative agenda, he thought the Council wanteda recommendation for
this meeting. He also said if any Planning Commission member wanted more time to
consider it before making a recommendation, nothing was said at last night's meeting.

a 14-foot-by 21 foot tent for the Golf Course for $932.90

MOTION: of Fitzsimmons, seconded by Branning, approving the purchase
of a sound system for the Council Meeting Room from Collins
Interconnect for the low quote of $2,512.00.

Councilmember Holton said he believes thispurchase may 5epremature and is hotheaded
yet. It was noted this system will be adequate to serve an expanded area, if and when
the Council Room is remodeled. Councilmemher Fitzsimmons said it is needed now, it
is very difficult to hear from the audience.
Vote was taken on the motion. Ayes - 3 - Nays - 0 Holton Abstained).
John Gretz reviewed the proposed general alignment for County Road 38 across Apple Valley
from County Road 5 in Burnsville to Pilot Knob Road which was approved by the County
Board at its last meeting. Mr. Art Lehman, who lives on Cedar Avenue where proposed
County Road 38 Will intersect it, was present and said he is concerned about, the
alignment because it crosses his property. Mr. Gretz said he would have to discuss
his concerns with the Highway Department when it acquires land for the road right-of-way.
John Voss said the Highway Department will be holding.public hearings on the road design
this fall and Mr. Lehman will probably be advised of these hearings.

Consideration of Fischer Sand & Gravel's request to move its processing plant was tabled.
The Council discussed a proposed ordinance rezoning parts of Valley Commercial Park First
Addition from B-3 to B-4 so the uses will be compatible with those already existing in
the area. The Mayor expressed some concern bn whether the businesses in the area con-
curred with this rezoning.

Mr. Asleson said City staff has not prepared a schedule of hours involve~ for them in
updating the Comprehensive Plan. He said this would be a priority item, and workload
permitting, time would be spent on this as needed.
The Council discussed the proposed contract with Urban Planning & Design for the
Comprehensive Plan update and the amount of time necessary for the revision. Mr. Voss
said new legislation stating the requirements to be detailed in comprehensive plans
calls for much more information than was included' in the existing City's Comprehensive

Plan and that is part of the reason more time is involved. Councilmember Fitzsimmons
questioned taking nearly two-years to do the update. Mr. Voss said the time limit on
submitting it to the Metropolitan Council is three years, or 1980. The Mayor said it
would not necessarily have to take that long and, according to the schedule proposed
by urban Planning, a land use sketch plan could be adopted as early asSeptember of
1977 and used as a guide until the complete revision isadopted. The Mayor asked the
Councilmembers to review thepropoaed contract further and address their concerns at
the next meeting.

Mr. Asleson reviewed the City's State-Aid Street Program from 1974 to 1977. He detailed
the construction which has occurred and the funding used to accomplish it. He told the
Council, after making this review, it appears theCity has approximately $604,000 avail-
able for State-Aid Street Construction.

Councilmember Hayes reported on theDakota County League of Munictpalities meeting of
April 27th. They discussed ambulance service, and requested the,County~Board, to consider
a County-wide subsidy for County ambulance service. The League appointed a committee to
study this further and make a recommendation to the County Board. The League also dis-
cussed S. F. 1078, concerning Metropolitan Tcansit funding, and requested an amendment
to the bill that Dakota County be dropped from the transit taxing district if service to
it is discontinued. The League adopted a motion stating elections should remain as they
are in even numbered years.

Mayor Branning said any of the Councilmembers who are going to attend the opening
ceremony of the Walk for the Whale on Saturday, April 30th, 1977, should enter at
Gate 2 of the Zoo. The opening ceremonies will be held at 8:00 a.m.
A review of the details of the March 1977 sewer backup was tabled.
MOTION: of Hayes, seconded by Holton, to pay the claims and bills,
checks numbered 3784 through 3796 and 4604 through 4696, in
the total amount of $1,558,455.70. Ayes - 4 - Nays - 0.
