Minutes of the meeting of the City Council of Apple Valley, Dakota County, Minnesota,
held June 6th, 1977, at 7:~0 o'clock p'.m.
PRESENT: Mayor Branning; Councilmembers Fitzsimmons, Hayes (attended until 10:50 p.m.),
Holton (attended at 9:49 p.m.) and Savanick; Clerk Asleson.
ABSENT: None.

Academy Village with the understanding the City's fiscal FINANCING
consultant, Juran & Moody, Inc., will be working out the final
financial details of thebond's.
Roger Wing, s and Steve Mattson of Juran & Moody, Inc. were present and reviewed the
municipal bond financing concepts and procedures. Academy Village is asking for a total
of $8,000,000 in financing and intend to get approval of the first 14 four-plexes this
year. The financing would be for the entire development of four-plexes, eight-plexes
and apartments. As each request for financing comes in for each building, the Council
would have t0 adopt a final resolution on that building. The Mayor said, after review-
ing more information on this concept he agrees it should be tried.
Vote was taken on the motion. Ayes - 3 - Nays - 1 (Savanick).
Steve Mattson reviewed a proposal for issuing advance refunding bonds which had originally
been proposed in September 1976. Before the City could issue the bonds at that time,
the FederalGoverement changed'regulationspertaining .to thistype off,bonding and those
new regulations had to be reviewed by financial agencies, before bonds could be sold.
It is proposed to include eight bond issues in the advance refunding procedure for a
total of $5,645,000. Mr. Al Vagstad of First National Bank of St. Paul was present
and explained the procedure of using the new bond issue to pay off existing bond issues
via government securities and the Process of escrowing the funds. The net result is a
savings in interest to the, City.
MOTION: of Hayes, seconded byFitzsimmons, adopting Resolution NO. 1977-
97 authorizing the sale of $5,645,000 Advance Refunding Bonds
for Wednesday,.June 29th, 1977, at 6:45 p.m.; bids will be
received by the City Clerk at ll:00 a.m, on June 29th 1977,
and opened at that time; and setting a special Council meeting
for June 29th 1977; at 6:45p.m. Ayes - 4 - Nays - 0.

The Council discussed the location of the pylon sign and the flag pole. The restaurant
will not have a building sign, only the pylon sign. The owner of the proposed building,
who was present, asked the Council to consider the sign now, but not the flag pole.
MOTION: of Hayes, seconded by Savanick, amending the above motion by inclUding a
variance for a pylon sign to be located 100 feet from Cedar Avenue and
30' feet from County Road 42 as recommended by the Planning Commission,
but not a flag pole. Ayes - 4 - Nays - 0.
Vote was taken on the above motion as amended. Ayes - 4 - Nays - 0.
MOTION: of Hayas, seconded by Branning; deferring discussion on the - PERKINS FLAG
location of a flag pole for Perkins Restaurant and consider
it in relation to the new sign ordinance. Ayes - 4 - Nays - 0.
Project 76-19, Garden View Drive widening, sidewalks on Garden View Drive north of
Westview, and Utility, street and sidewalk improvements in Academy Village. The Mayor
called the public hearing to order at 8:19 p.m. and noted the affadavit of publication.
Robert Rosene showed the locations of the proposed improvements on the map and explained
the formula for computing the estimated assessments for sidewalks. The Mayor called for
questions and comments from Couneilmembers and Staff. Mr. Asleson said he had received
calls from residents in the Palomino Lakeshore Addition asking why they should pay for a
sidewalk on Garden View Drive. He reviewed alternatives of assessing it using the asses-
ment district concept,assessing the total cost only to abutting propertyowners Or not
installing the improvement at all. The Mayor called for questions and comments from
the audience. (See detail of questions and answers attached.) After everyone present
had been given an opportunity to be heard, the Mayor declared the hearing closed at
9:10 p.m.
Consideration of ordering Project 76-19 was tabled until June 23rd, 1977.
Project 77-2, Utility and Street Improvements for Palomino Hills Seventh Addition,
Heritage Hills Third Addition, Hidden Ponds Addition and Nordic Woods Second Addition.
The Mayor called the public hearing to order at 9:18 p;m. and noted the affadavit of
publication. Robert Rosene showed thelocations of the four developments on the map
and gave the estimated costs of the sewer, water, storm sewer and street improvements,
all of which will be paid by the developments. The Mayor called for any questions

Nordic Properties, asked for a Copy of the Engineer's preliminary report and was given
one. Mr. Asleson said the portion of trunk storm sewer to be installed in Hidden Ponds
Addition must be installed before the street is paved. The cost will be paid by the
City's trunk storm sewer fund, because it drains the property to the.southeast of this
addition to the pond in the addition, and be assessed back to this adjacent.property
when it. develops. After everyone present had been given an opportunity to be heard,
the Mayor declared the hearing closed at 9:26 p.m.

Project 77-4, Essex Avenue Street Improvements, The Mayor called the public hearing to
order at 9:27 p.m. and noted the affidavit of publication. Robert Rosene showed the
location of the Small section of Essex Avenue, east of Pilot Knob Road, to be improved,
on. the map. The cost estimate is $19.90 per front fooT. The Mayor called for questions
and comments from the Councilmembers, Staff and audience. Mr. Asleson said the City
will be paying for a portion of the street because its liquor store abuts the street.
In order for the City to pay this cost, it must gQ through the bidding process and that
is the reason for this small project. The City Attorney has been negotiating for a
street easement with. the property owner on the south side of Essex Avenue but has
notyet received it. Jim Sheldon said he suggests the City also pUrchase the property
for the easement on the north side of the street, if it must purchase the property on
the south side, and assess the entire cost of.the easement to both properties. Cal
Merriman asked when the project would be done, because some curb cuts will have to
be made. Mr. Asleson said since this is such a small project, he suggests doing all
of it now and making any curb cuts later. Thompson Construction will be constructing
the balancleof the street in July and this should coincide with that. The Council
received a letterfromMr. Merriman requesting delaying sidewalk installation.
After everyone present had been given an opportunity to be heard, the Mayor declared
the hearing closed at 9:36 p.m.
MOTION: Of Hayes, seconded by Savanick, adopting .Resolution No. 1977-99
ordering Project 77-4, Essex Avenue Street and Sidewalk Improve-
ments and authorizing paying $800 for a street easement to the
property owner on the south side for .43 acre and paying a pro
rata share to the property owner on the north side for a street easement,

Robert Rosene described the proposed Street improvements for Hayes Road, which included
completing the east haIf of Hayes Road; an overlay over the entire Street Surface, side-
walks and some st0rm Sewer; The 0nly assessment prosed for the property owners on the
west side of Hayes Road is sidewalk, by the special assessment district process. The
street improvements for the east side of Hayes Road are proposed to be assessed to the
abutting property. The Mayor called for questions and comments from the Councilmembers,
Staff and audience. (See detail of questions and answers attachedl) Councilmember Hayes
left at 10:50 p.m. After everyone Present had been given an Opportunity to comment on
both portions of the public hearing, the Mayor declared the hearing closed at 11:20 p.m.

Councilmember Fitzsimmons said the ParkC0mmittee did not know if it could have a quorum
for a joint meeting with the Councii on june 29th and would like to meet with the Council
on June 22nd. The Mayor said they would probablyneed another meeting With the Park
Committee after June 29th and they Could hold the June 29th MeetingWith those present.
The Council discussed traffic problems at the intersection of Pilot Knob Road and County
Road 42 and the accidents that occurred there. Mr. Asleson said the County has installed
oversized stop signs already. The Mayor said he would like the County to considerin-
stalling a flashing light at the intersection. Councilmember Holton suggested maybe
this intersection should have four-way stop signs. Staff was asked to discuss these
things with Dakota county.
MOTION of Holton, seconded by Fitzsimmons, to pay the Claims and CLAIMS & BILLS
bills, checks 'numbered 3834 through 3836 and 4980 through 5041,
in the amount of $26,351.78. Ayes - 4 - Nays - 0.
The meeting was temporarily adjourned at 11:34 p.m. and the Mayor declared a continuation

Mike Bassett reported on the V.A.A.'s usage of neighborhood parks for practice, which
was approved on a trial basis by the Council at its last meeting. He said it appeared
to be parking well at most parks and the V.A.A. would like to continue it.

Mr. Asleson reviewed 1977 amendments to the State Levy Limitation Laws permitting City
Councils to increase the levy limit base by ten percent for taxes levied in 1978. He
reviewed comparisons of the 1977 tax levy and. an estimated 1978 tax levy using the
increased levy limit base. He also listed the steps required if the Council wished to
implement this increase, including publication of the notice and alpublic hearing on
July 25, 1977.
MOTION: of Holton, seconded by Hayes, adopting Resolution No. 1977- PES. 1977-103
103 setting a public hearing at 7:00 p.m. on July 25th, 1977, LEVY LIMIT
on a proposed permanent levy limit base adjustment in an amount BASE HEARING
not to exceed $86,376.00. Ayes - 3 - Nays - 0.
Discussion of the State Aid Street Program was tabled.
Mr. Asleson commented on meetings between Apple Valleyand Burnsville during the past
year about Lake Alimagnet's level and water quality. The Engineers and Homeowners
Association have made some recommendations on this. The State informed Mr. Rosene that
it has about $18,000 in grant money available for this type of project for the fiscal
year ending June 30 1977. It also said this program will not be renewed next year.
Mike Bassett said he understands there are some restrictions placed on lakes when
Department of Natural Resources funds are used; and he will get more details on this.
MOTION: of Hayes, seconded by Holton, authorizing Staff to prepare a PREPARE GRANT
grant application to:the State for funds to be used for the APPLICATION
Lake Alimagnet outlet, aeration tame or rearing pond for ALIMAGNET LAKE
Council consideration at its next meeting. Ayes - 3 - Nays - 0.
MOTION: of Hayes, seconded by Holton, approving a transient merchant TRANS. MERC.
license for Jewel Home Shopping Service. Ayes - 3 - Nays - 0. LICENSE
The Council discussed establishing procedures related to adoption of ordinances.
Mr. Asleson suggested it should be in the form of a resolution outlining the steps. The
Council said it didn't want to limit the steps by adopting a resolution, but rather have
a written policy of procedures to, generally, be followed.
James Kelly and J. M. Kelly of J. M, Kelly Co., Inc. presented a proposal for a clubhouse
at the City's golf course. Jim Kelly reviewed the plans and layout of the building to
include a cocktail lounge, restaurant, pro. shop and locker rooms. Jack Kelly described
their ideas for the exterior of the building. He also gave backgrouhd information of the
company and business experience of the members of the company. They estimate the build-
ing will cost $700,000 to $750,000. They would ask the City to issue $500,000,in ind-
ustrial revenue bonds and they will be financing the-balance. Other items in the proposal
include requesting a deed for the property on which the building will sit, an easement
over the driveway and parking lot for access to the building and, possibly, abatement of
real estate taxes for the first two years. They intend to manage the facility themselves.
Mayor Branning asked the Staff to review this proposal and make a recommendation:to the
Council at its June 23rd meeting. 'He also asked the Kelly's to furnishlfinancial state-
ments to the City.

Detail of Questions and Answers from Public Hearing on Project 76-19.
Councilmember Fitzsimmons.said, when she requested another public hearing on this project
including thePalomino Lakeshore Addition the area to be assessed, she believed the
sidewalk on Garden view Drive would be used by the children from that area Walking to
school. She has since found out that the children from this area are bussed to school
beCause of the distance to the schools.
Don Romain; 405 Reflection Road, asked what frontage is propOsed to be assessed to the
Palomino Lakeshore Addition? Mr. Rosene said only the sidewalk along the platted lots
of the Addition on the west side of Garden View Drive and the cost will be about $6.00
per foot. Mr. Romainasked who will be paying for the rest of the sidewalk? Mr. Rosene
Said development agreements on the other platted areas, except the Lakeshore, Palomino
Lakeside Estates and Timberwick 3rd Addition, prOvide for payment by the developers. The
total cost of the sidewalk assessment for the Lakeshore Addition is estimated at $9,500,
spread over 57 lots.
Ge0rgeMaurer, Reflection Road, asked Why thesldewalkis being installed? The Mayor
explained the poIicy of having sidewalks On both sides of collector streets. Mr. Maurer
asked what benefit Reflection Road gets from a sidewalkon Garden View Drive? He said
they are already paying to have their children bussed.to school, in taxes, and read
figures from the School District on the cost of it. Mr. Maurer gave the Council a letter
from James Moser giving his comments on the hearing since he could not be present.
The following questions were asked: 'Why doesn't the City put sidewalks on both sides of
every street in the City? 'Why do properties on the east side of Garden View. Drive have
agreements covering the cost of the sidewalk and not others? Will the speed limit-on
Garden View Drive be lowered after sidewalks are installed? Don Anderson questioned
the timing of instaIling sidewalk on the west·side Of Garden View·Drive from 140th Street
to County Road #'38 since there is no development yet? Don Romain asked if the people
were misled on who would pay for the cost of the improvements at the last public hearing
on this project?' He also asked, who will sh0el snow from the sidewalks?
Harvey Henjum asked what the policy is on riding bicycles on sidewalks? Is a provisio~
for a bike path along Garden View Drive being made? Has there ever been an accident
on Garden View Drive involving a Child walking to school? Tom Meyer asked who will
shovel snow from the sidewalks?
Mayor Branning said the City has adopted a policy of installing sidewalks on both sides
of collector streets because those streets carry heavier traffic. The benefit to property
in the Lakeshore Addition from the sidewalk is the same as compared to Redwood and Juniper
benefitting from the sidewalk on Garden View Drive to the south. Councilmember Fitzsimmons
said she has changed her stand on benefit to the Lakeshore Addition property because she
believed those children would be using the sidewalk to walk to school. Councilmember
Savanick asked what the distance to the schools are? The exact distances aren't known,
but the Lakeshore Addition is less than one mile from Westview School so the school
children would not necessarily continue to be bussed. She said she understood the reason
the children were being bussed to the High School is because the street is dangerous and
said the School District should be asked if sidewalks are installed, whether those
children can walk to school.
Mayor Branning said requiring sidewalks on both sides of every street would not be
fiscally responsible. Sidewalks are required where traffic warrants them and collector
streets are designed to carry more traffic than residential streets.

Mr. Asleson said the Lakeshore Addition was developed before the City began using develop-
ment agreements to cover costs ofsome improvements. The development agreements for
Timberwick '3rd and Palomino Lakeside Estates did nOt include sidewalks because they were
small additions and none of the lots had driveway accesses directly to Garden View Drive.
The question was asked why the property on Reflection Road should pay for the sidewalk
and isn't it a double standard, assessing property that abuts sidewalk and property
that doesn't? Mayor Branning said the decision on how the cost of the improvements will
be assessed, if they are installed, has not yet been made.
After constructionon Garden View Drivehas been completed, the City will have to request
the State Highway Department to take a survey on the street to determine the speed limit.
The speed limits are set by it, not by the City. When the curb and gutter have been
installed, GardEnView will go from a rUral to an urban type street and this may make a
difference.
In answer to the question on timing, Mayor Branning said sidewalk on the east side of
Garden View has been petitioned for and installing sidewalk on the west side will
complete the system. The Council has Not misled people.in who witl be paying.for the
improvements. The people who were at the first public hearing were also notified of
this public hearing, and some of them are here.
The Highway Department has established rules saying bicycles should be ridden on streets.
The City has not established a POlicy on whether bicycles can be ridden on sidewalks.
The City does not yet have an approved trail Systems but it is working on one which will
be part Of the ComprehensivePlan.
Marie HenjUm aSked·what is planned for a future road to I35E with sidewalks and bike
paths? That does not relate to this hearing, but will be part of the overall Plan.
There have been three accidents on Garden View Drive involving.pedestrians The City's
ordinance on snow shoveling states the property owner abutting the sidewalk must shovel

Detail of Questions and Answers from Public Hearing on Project 77-1.
Councilmember Fitzsimmons asked if cost figures were available on what has been spent
to maintain the streets, in the Woods Additions and pUmp storm water during the past
couple of years? John Gretz said he could not Rut together figures on those costs
because records are not kept on how much material and how much time is spent on each
street. The costs 'have involved storm water pu/nping in the spring, and street grading
in the summer.
Councilmember Savanick said this is being proposed as a temPorary street surfacing. How
long will it be before utilities will be available in the area? Mr.Rosene said that
is unknown now, but probably five to ten years because about one and one-half miles of
sanitary sewer work will be necessary to extend it to that area. Savanick asked if the
Schneider property on the west side of Pilot Knob Road developed, would it affect the
Woods area? Mr. Rosene said if utilities were installed in the Schneider property,
that would, bring the water closer but sanitary sewer would have to come from the south
to serve the Woods area.
Jim Frisbee questioned the amount of money actually spent for maintenance in the Woods
areal He asked if this could be two projects, storm sewer and street surfacing?
Mr, Rosene said it would be possible to, do thestorm sewer work without doing the street
surfacing, but the street surfacing could not be done unless the storm sewer work is
done also.
Phyllis Lemay asked if the outlots the City has for street right-of-way will be paved
also? Mr.Rosene said.no.
Sarah Mardell asked what the storm sewer work only would cost? $22,200. How deep will
the ponds be? Mr. Rosene said he does not have that information yet, but noexcavation
is proposed to be done in the ponds. It is proposed to install pipe out!ets for the
ponds, but the elevations would be determined when actual working plans are drawn.
Dick Fulson said the ponds should not bea problem of the people who live there, but
the City's problem. Jim Frisbee asked what these improvements would increase taxes?
He also asked if the City would be willing to partioipate in the cost of the street
surfacing? Will the assessments he spread over 28 or 30 lots? Mr. Fulson asked what
the improvements would increase the valuation of the property?
Mr. Asleson said when the Woods area was platted, the ponds were shown, but outlets
for the ponds were probably not discussedbecause they were not needed at that time.
Mayor Branning cosented on the City's policy of using storm water holding ponds rather
than'installing a lot of storm sewer pipe the City doesn't oWn the ponds. Mr. Frisbee
said the ponds are privately owned and when lots are sold, the property owners agree
not to fill the ponds. Mr. Rosene commented on property within drainage areas contribut-
ing to storm water problems.
Mr. Asleson said the AsseSsor would probably not immediately revalue the propertY after
the improvements were made. All property in the City, was increased by ten Percent in
value for next year. The additional value the improvement would have for the property
would be reflected in, perhaps, an increased selling price of the property with paved
streets.

Mr. Asleson said there is no precedent for the City participating in the cost of surfac-
ing streets. If the City paid part of the cost, the money comes from general tax money
and, in effect, everyone in the City would be helping pay for street surfacing in:the
Woods area. The assessments would be proposed over 28 lots, the two lots the Citylhas
for street right-of-way would not be pavOd at this time. Mr. Frisbee said.he believes
the city doesn't want to maintain the gravel roads anymore. The residents there are
satisfied to have it remain a gravel road.
Irene Daberkow asked how much the City spent over the last two years maintaining these
streets?' John Gretz said he does not have detailed records on this kind of expenses. He
also said money is not really the question, and believed the expenses have not been too
greatl The purpose of the hearing is whether the residents want to continue with gravel
roads.
Michael Mardell asked if the COuncil. considered the alternative of not installing the
improvements? Mayor Branning asked for a show of hands on how many people wanted 'storm
sewer, street surfacing or neither. MOst people present wanted neither. Mr. Asleson
commented on pumping ponds and said as the City grows, it may not always be able to
respond as quickly to the problem as it haS in the past. The Mayor said the city is
trying to determine when the right time is to install the improvements. Del Anderson
said shouldn't that be when it can be a permanent improvement. Sarah'Mardell said they
had a problem with storm water last year when their home was under construction, but now
that the lot has been sodded, they don't anticipate the problem with runoff.
Gerry Patterson presented a petition signed by residents of the Hayes Road-Stress Lane-
Walnut Lane area requesting the Council to table consideration of improving Hayes Road
and installing sidewalk until the Planning Commission has reviewed it and prepared
documentation as to whether it should be improved Mike Patterson asked what is planned
over the gastine? Mayor Branning said the comprehensive Plan showed proposed land use,
but the Owner's of the property have not given the City a development plan. He also
asked if the existing road is going to be torn up? No, the east half will be completed
and an overlay put over the existing west half.
Harvey Henjum asked how the improvements are prop0sed to be assessed? Mr. Rosene showed
a map with the estimated cost per lot for the Sidewalk only via the assessment district
method. Don Romain asked why sidewalk is not going to be on both Sides of Hayes Road?
He also asked about a traffic signal at Hayes Road and County Road 42. Rev. Wold asked
if there will be any assessments to the residents along Hayes Road and, if so, how much?
Bob Nelson, Walnut Circle, asked why he is being assessed for sidewalk on Hayes Road?
Jean Bakken, Stress Lane, asked the same question and said they have no direct access to
Hayes Road and the re direct route to the high school for them is Garden View Drive.
Doug Hanson, Oakwood Road, asked the same question. Cheryl BiandO asked if it is:
necessary to make these improvements, and why can't the other roads, which have already
been improved, be used? Bob Carroll asked if the assessments to his property would
be under "Green Acres"? Jim Boreki asked if there is a proposal for sidewalk along the
east side of Hayes Road? Yes, on both sides. The sidewalk will be five:feet wide. He
asked how wide it is in front of the high school? Mr. RoSene said he believed it is
five feet wide.
Stan Trom asked if the boulevard trees would be saved? Gerry Patterson asked if the
Council has considered the alternative of closing the present Hayes Road and constructing
a street over the gasline? Joe Shirk said he believes it is inappropriate to consider
improving Hayes Road now because of the traffic problems with its intersection at County

Road 42. Signals should be considered if the improvement is made. He asked what else
is proposed for safety on the street such as stop signs or. speed bumps? He also
questioned the alignment of the curb on the northern part of Hayes Road.
Mike Patterson suggested people might use Hayes Road, after it is improved, to bypass
traffic at the County Road 42 and Cedar intersection. Louise Malmgren asked why the
street is proposed robe 44 feet wide? The question was asked what. criteria was used
to figure assessments on the property for those who will not even be using the street?
Joe Shirk said when I35E is constructed, traffic will probably he relieved on Hayes
Road somewhat because out of town traffic will not have to use County Road 42 to get
to the high school. Ed. Fritz asked if sidewalks will be on both sides of Hayes Road?
Don Romain asked if Hayes Road is a collector street?
Mayor Branning commented on previous consideration given to improving Hayes Road two
years ago. He explained the assessment district concept proposed to be used for
assessing the .cost of the sidewalk on the west side of Hayes Road. Mr. Asleson said
the street improvements are proposed to be assessed to the Carroll property, the Fire
Station and the park. He said the Council was on record from the last public hearing
that the lots on Hayes Road would not be assessed for additional street improvements.
The proposed assessment for sidewalk has been computed together with sidewalks on
Garden View Drive from County Road 42 to Westview School. This is actually a part
of that public hearing. The amount of the proposed assessment has been computed based
on the distance the property is from Hayes Road and Garden View Drive; for the area
involved in the hearing tonight, it is $90 to $80 per lot.
The Mayor said a traffic signal for the Hayes Road-County Road 42 intersection has been
discussed, but chances are slim it would be installed because there is not enough
traffic. Most likely the intersection will be limited to right turns in and out only
in the future. Councilmember Holton commented on discussions of constructing a street
over the gasline easement, several years ago, and connecting it to McIntosh Drive on
the south side of County Road 42. It was decided then that it would not be practical
because of the grade change and the fact that several houses would have to be moved.
Dave Snobeck said one solution would be to close the Hayes Road intersection with
County Road 42 and continue it around to the service drive.
The Mayor said the assessments to the lots are for sidewalks only. The property owners
in South Apple Valley have already paid for sidewalks in that area. He also said he
did not believe making deadend streets was the answer to problems because almost every-
one would like to live on a deadend street. The City has encouraged use of other
streets for access to the high school. Mr. Carroll was told "Green Acres" deferrment
would apply. The Mayor also said the boulevard trees will be saved where possible and
the sidewalk shifted around them.
The Council has had the policy of being against installing speed bumps, and stop signs
are not to be used for controlling speed, but other safety measures will have to be
reviewed. It was noted that if Hayes Road is improved, it will be a straight through
street from County Road 42 to 140th Street.
Mr. Rosene said aligning the curbing along the park where it would connect to the exist-
ing curbing would make a slight jog in the road, but it would not he a difficult
problem. With respect to the problem of people using Hayes Road to bypass traffic
at the intersection of County Road 42 and Cedar Avenue, it can't be guaranteed what
people will do, but they would have to make two left turns by going that way. The

street is proposed to'be 44 feet wide becaUse the Street in front of the high school is
44 feet wide and this would line up, but the final decision has not been made.
Mrs. Bakken asked what the.street assessments would be? She was told the property
on the west side of Hayes Road would not be assessed for the street improvements only
the sidewalk on the west side. The comment was made that if sidewalks are being
proposedfor the children's Safety, the city should pay for it because installing the
street creates the problem. Councilmembsr Savanick said the school created part.of
the problem when it put the high school Where it did. Judy Shirk asked why Hayes Road
couldn't be barricaded? Councilmember Holton asked Bob Nelson, who is a member of the
Fire Department, how this would affect the Fire Station? He said the Fire Station
has direct access to County Road 42 and could use that. Mr. Snobeck said by improving
Hayes. Road, the traffic problems will be worse. Erv Linson said he would ask the
Council to consider diver traffic by using the service drive to Hayes Road and Closing
the intersection with c0unt~Road 42, .Marie Henjum said there are no sidewalks along
the service drive at County ROad 42 so children crossing at Garden View Drive from
South Apple Valley still have to Walk on the street.
