ABSENT: None. Mayor Branning called the meeting to order at 7:00 p.m. The Councilmembers and everyone in attendance took part in the pledge of allegiance to the flag. MOTION: of Fitzsimmons, seconded by Holton, approving the agenda for- APPROVE AGENDA tonight's meeting as amended. Ayes - 4 - Nays - O. MOTION: of Fitzsimmons, seconded by Holton, approving the minutes of the AUG. 25,1977 meeting of August 25th, 1977, as written. Ayes - 4 - Nays - 0. MINUTES Mayor Branning called the Rublic Hearing on 1977 Assessment Roils to order at 7:05 o'clock p.m. and noted the affidavit of publication. Mr. Asleson gave background information on the proposed assessment rolls. (Councilmember Savanick attended at this time.) No. 126 - Greenleaf 11th Addition utilities (partial) in the total amount of $102,986.15. No. 127 - Greenleaf 11th Addition and Property Underwriters Addition utilities in the total amount of $303,670.03. No. 128 - Timberwick 3rd Addition utilities in the total amount of $23,498.80. No. 129 - Academy Village and Cedar Park School area utilities and storm sewer in the Trams Union Development in the total amount of $282,060.02. No. 130 - Street Improvements in Academy Village and Whitney Drive in. the total amount of $87,181.55. No. 131 - Chateau Estates utilities in the total amount of $215,562.44. No. 132 - LaPaz 2nd and Palomino Lakeside Meadows 3rd, 4th and 6~h Additions utilities in the total amount of $97,898.16. No. 133 - Chateau Estates, LaPaz 2nd, Timberwick 3rd and Palomino Lakeside Meadows, 3rd, 4th and 6th Additions street improvements in the total amount, of $22,142.80. 7No. 135 - Sidewalk improvements on Garden View Drive from County Road 42, north, to Westview School in the total amount of $28,581.04. Mrs. Stephens, on Elm Drive, questioned their property being assessed for sidewalks on Garden View Drive. Mr. Asleson explained the assessment district concept used for this assessment. The Mayor called for any questions or comments from the Council, Staff and the public. There being none, the hearing was declared closed at 7:15 p.m.- MOTION: of Holton, secondedby Fitzsimmons, adopting Resolution No. RES. 1977-177 1977-177 adopting and nonfirming Assessment Roils 126 through ASSESSMENTS 135 as presented. Ayes - 5 - Nays - 0. MOTION: of Hayes, seconded by Savanick, adopting Resolution No. 1977-178 RES. 1977-178 applying to the League of Minnesota. Cities for two.bocce ball ~BOCCE BALL sets under the Governor's Program to Promote Bocce Ball gETS APPLICATION Councilmember Pitzsimmona asked what kind of field would be required to play bocce ball. Mike Bassett said there are special courts for it, but the game can be played on the grass anywhere too. Vote was taken on the motion. Ayes - 5 - Nays - 0. MOTION:of Holton, seconded by Savanick, granting a temporary waiver of platting at 13200 Pilot Knob Road subject to platting when a building permit is requested for the second parcel and a 75-foot road right-of-way for Pilot Knob Road as recommended by the Planning Commission. Ayes - 5 - Nays - 0. TEMP. WAIVER , OF PLATTING 13200 PILOT KNOB MOTION: of Holton, seconded by Hayes, granting a temporary waiver of platting for Lot 8 of Block 1 in Palomino Lakeside Meadows 4th Addition, moving the east lot line 4 feet, subject to platting when a building permit is issued for Lot 9, as recommended by the Planning Commission. Ayes - 5 - Nays - 0. TEMP. WAIVER OF PLATTING MEADOWS 4TH MOTION: of Hayes, seconded by Holton, granting a sideyard setback 950 CORTLAND variance of 21 feet from Cooper Lane for a garage addition VARIANCE at 950 Cortland Drive South as recommended by the Planning Commission. Ayes - 5 - Nays - 0. MOTION: of Savanick, seconded by Fitzsimmons, granting a sideyard 916 ORIOLE setback variance of 2.8 feet from the property line at VARIANCE 916 Oriole Drive for a garage addition as recommended by the Planning Commission. Ayes - 5 - Nays - 0. The Mayor called the public hearing on Project 76'13, Longridge Development Improvements, to order at 7:30 p.m. and noted the affidavit of publication. Keith Gordon reviewed the proposed utility andstorm sewer improvements, Thompson Construction will. be installing the streets. This development includes a water reservoir in the southwest corner and Mr. Asleson asked whether Phase 1 could be built before it is constructed? Mr. Gordon said the water reservoir would not be needed until later stages of the development, but it takes about 18 months to Construct and if it were begun in spring, it should be complete about the same time as Phases 2 and 3. Mr. Asleson asked about sanitary sewer easements through the property to the east to the treatment plant. Mr. Gordon said they plan to run the sewer along the edge of that property, but the easements have not yet been obtained. Mr. Asleson reviewed possible financing for the water reservoir. The Mayor called for any other questions or comments from the Council, Staff and public. There being none, the hearing was closed at 7:40 p.m. MOTION: of Hayes, seconded by Savanick, directing the Engineer to PRELIM. REPORT prepare a preliminary report for construction of Garden View GARDEN VIEW DR. Drive from Whitney Drive, south, to 160th Street. Ayes - 5 - Nays - 0. MOTION: of Hayes, seconded by Holton, adopting Resolution No. 1977-179 RES. 1977-179 approving plans and specifications for Project 77-7, Cobble- PROJ. 77-7 stone Lakeview Addition, Garret Avenue and LaPaz 2nd Addition PLANS & SPECS (Phase 2) street and sidewalk improvements, and authorizing advertisement for bids to be received October 11th, 1977, at 2:00 p.m. Ayes - 5 - Nays - 0. MOTION: of Hayes, seconded by Holton, adopting Resolution No. 1977-180 approving plans and specifications for Project 77-2(3), Nordic Woods 2nd Addition street and sidewalk improvements, and authorizing advertisement for bids to be received October 11th, 1977, at 2:00 p.m. Ayes - 4 - Nays - 1 (Fitzsimmons). RES. 1977-180 PROJ. 77-2(3) PLANS & SPECS CITY OF APPLE VALLEY Dakota County, Minnesota September 8, 1977 Page 3 Mr. Asleson noted the City received a petition fromNordic Properties to do the street grading in this project and that wasincluded in the plans and specifications. The Council discussed consideration ofinsta!ling sidewalk along the south side of 132nd Street in the future. MOTION: of Holton, seconded by Hayes, adopting Resolution No. 1977-181 approving plans and specifications for Project 77-2, Hidden Ponds Addition street improvements, and approving Change Order No. 2 to Project 76-20(1) in the amount of $28,328.00 to install the project. Councilmember Holton said if the street remains a cul de sac and no east-west street con- nects it, sidewalks should be required in the future. Vote was taken on the motion. PLAN GRANT APPL~CATION RES. 1977-189 LAWCON GRANT APPLICATION MOTION: of Hayes, seoomded by Savanick, adopting Resolution No. 1977- 190 authorizing staff to submit an application for Outdoor Athletic Court Development Funds of $107,430 for tennis courts included in the park bond referendum. Ayes - 5 - Nays - 0. MOTION: of Holton, seconded by Hayes, adopting Resolution No. 1977-191 RES. 1977-191 requesting Dakota County Board of Commissioners to prepare CO. RD. #42 & preliminary estimates for improvements to County Road42 from 40 PRELIMINARY Cedar Avenue east and to County Road 40 (140th Street) from ESTIMATES Cedar Avenue east and the Council will-hold public hearings after such estimates have been received. Mayor Branning said road construction was discussed with the County Commissioners and the City asked for improvements to 140th Street from Galaxie Avenue, east to County Road 33. The County suggested continuing 140th Street through to Cedar Avenue and the City agrees this should be looked into. This is the reason the City is asking for a preliminary report on it. Councilmember Holton commented the street is proposed to be four lanes undivided. Councilmember Savanick said she does not believe the portion of 140th Street from Cedar to Galaxte should be built. Jerry Decker asked what the definition of an arterial street is? Councilmember Hayes said it is similar to Garden View Drive South or Galaxie Avenue. Mr. Decker said if the County goes to the expense of making a study, it will push to construct the street. The Mayor said the City will be holding public hearings on it and would have to approve construction before the street could be built. Roger Persons asked what the definition of the property is now? It is City publtc right-of-way property. Mr. Persons asked to have the Planning Commission address the use of this property. Donald Janaszak said when he bought his house, the realtor told him this was park property. It has always been shown on maps as a right-of-way. Bob Lewis asked what a collector street is? Similar to Whitney and Garden View Drives. John Vose said when the County does the report it should include a study of origination and destination use of the street. He said he has quite a bit of information on this which he could furnish. Lynne Kline read a quote from the Apple Valley Free Press on the County-City meeting. MOTION: of Hayes, seconded by Holton, to call for a vote on the above motion. Councilmember Holton said the facts Shouldbe obtained before this discussion is continued further. After the City has the report, it will have answers to the questions. Vote was taken. Ayes - 3 - Nays - 2 (Fitzsimmons and Savanick). Vote was taken on the original motion. Ayes - 4 - Nays - 1 (Savanick). MOTION: of Holton, seconded by Fitzsimmons, setting an informal meet- S MEETINGS lng on the 1978 budget September 15, 1977, at 7:00 p.m.; a special meeting to canvass the election results September 29, 1977, at 7:00 p.m.; set an informal meeting on the Comprehensive.Plan September 29, 1977, at 7:30 p.m. and October 6, 1977, at 7.00 p.m a special meeting to consider adoption of the 1978 Budget and CITY OF APPLE VALLEY Dako%a County, Minnesota September 8, 1977 Page 5 tax levy, all at City Hall. Ayes - 5 - Nays - 0. TRANS MERC LICENSE MOTION: of Holton, seconded by Fitzsimmons, approving a transient merchant license for Boy Scout Troop 205 for five years to sell fund raising items. Ayes - 5 - Nays - 0. MOTION: of Fitzsimmons, seconded by Holton, approving an Agreement with Norman Vogelpohl and School District 196 regarding a transfer of land in The Highlands and authorizing the Mayor and Clerk to sign it. Ayes - 5 - Nays - 0. HIGHLANDS LAND AGREEMENT Annual reviews for Richard Asleson, Michael Bassett and John Gretz were tabled. MOTION: of Holton, seconded by Hayes, approving hiring Neal Haustein as a parttime employee at the Liquor Store effective September 10, 1977, at $2.85 per hour. Ayes - 5 - Nays - 0. HIRE LIQUOR EMPLOYEE Mayor Branning said there will be a meeting September 9th at 2:00 p.m. at the Zoo offices on the Zoo Barton-Aschman Report. City Staff will be attending and the Council requested that John Voss attend also. MOTION: of Savanick, seconded by Fitzsimmons, to pay the claims and bills, CLAIMS. & BILLS checks numbered 3919 through 3930, 3932 and 5883 through 6016, in the total amount of $271,526.07.
