Minutes of the special City Council meeting, City of Apple Valley, Dakota County, Minnesota
held October 6, 1977, at 7:00 o'clock p.m.
PRESENT: MaYor Branning; Councilmembers Fitzsimmons, Hayes, Holton, and Savanick; Clerk
Asleson.
ABSENT: None.
Mayor Branning called the meeting to order at 7:05 p.m. The purpose of the special Council
meeting was to continue review ofvarious 1978 Departmental Budgetsand to consider adopt-
ion of a tax levy resolution for taxes payable in 1978. It was noted that the City Council,
following proper public,notice, had met formalty on September 20th, 1977, at which time
they had reviewed, in detail most of the General Fund Budget and the Budget reviews at
this meeting would include further consideration of items held over on the General Fund,
as well as review and consideration of the detaiisof other City operating budgets.
MOTION: of Fitzsimmons,.NO SECOND, to approve the:Forestry budget in the
amount of $82,015. Motion died for lack of a second.
MOTION: of Hayes, seconded by Branning, to approve the Forestry Budget FORESTRY BUDGET
in the amount of $58,615. Ayes - 4 - Nays - 1 (Holton).
MOTION: of Holton, secondedzby Hayes, to aPprove the Fire Department FIRE DEPT.
Budget in the amount of $42,690, with account 4100 hefng BUDGET
adjusted to $3,600 and account 4210 being reduced to O.
Ayes - 5 - Nays - 0.
MOTION: of Hayes, seconded by Holton, approving the Police Department POLICE DEPT. : budget in the amount of:$455,000. Ayes - 4 - Nays - 1 (Savanick).BUDGET
C0uncilmember savanick noted that she was voting no on this department: budget because of
her concern that the over all City budget apparently would be resulting in a tax levy
increase that she considered too large.
MOTION: of Savanick, NO SECOND, to adopt the Park Department budget in the
amount of $158,000 Motion died for lack of a second.
MOTION: of Fitzsimmons, seeonded byHolton adopting the Park Department PARK DEPT.
budget in the amount of $169,383. BUDGET
MOTION: of Branning, seconded by Savanick, amending the foregoing motion by
deleting the $3,800 shoWn in account 4540 for bleachers at the
Westview Building; Ayes , 5 - Nays - 0.
Vote was taken on the original motion as amended. Ayes - 4 - Nays - 1
(Savanick).
MOTION: of Hayes, seconded by Branning, approving the Recreation Dept. RECREATION DEPT.
budget in the amount ·of $36,000. Ayes - 5 - Nays - O. BUDGET
MOTION: of Hayes, seconded by Holton, approving the Golf Course budget in GOLF COURSE
the amount of $267,797 including the allOcation of $5,000 of said BUDGET
amount to be authorized as an expenditure in 1977 for thepurpose
of renting equipment to make grading improvements on the driving
range on Hole 15 and on certain additional tees in accordance
with the memorandum to theCouncil dated October 6, 1977.

MOTION: of Hayes, seconded by Holton, approving the Arena Operating ~ARENA OPERATING
budget in the amount of $186,533. Ayes - 5 - Nays - 0. BUDGET
The City Clerk then reviewed with the Council the requirements related to adoption of the
tax levy resolution and the overall budget. It being noted that State Law requires the
tax levy resolution to be filed on or before October 10th of each year, with the Gounty
Auditor, and it being further noted that Revenue Sharing Regulations require adoption by
the Council of an overall City budget showing how Revenue Sharing Funds relate Co the rest
of the budget. The Council then proceeded to review the draft of the tax levy resolution
which, in accordance with the Staff proposed budget, was in the total amount of $1,142,135
The City Clerk was requested to. determine the corrected amount for the tax levy resolution
based on the reduction in the Forestry budget approved by.the Council. TheClerk advised
that the reduction of $23,400 in the Forestry budget would result in the special levy for
Forestry being reduced from $53,510 to $38,100, it being noted that the February budget
assumes reimbursement from the State of Minnesota of 35 percent of its total, with the
other 65 percent being derived from the tax levy. Of the revised budges amount of
$58,615, 65 percent is $38,100.
MOTION: of Holton, seconded by Hayes, approving Resolution No. 1977-RES; 1977-204
204 approving the 1977 tax levy for collection in 1978 in TAX LEVY
the amount of $1,126,725, with such amount reflecting the
$15,410 reduction in the special levy for Forestry purposes
discussed above.
The Council requested that the City Clerk provide information as to what a tax levy in
this amount would mean to the owners of various valued homes in theCity. The City Clerk
stated he could only make, what he considered to be relatively close estimates because
the final impact of fiscal disparities is now known and,. fUrthermore, the valuation of
personal property in Apple Valley is now known. Based on the information available, the
Clerk advised that the estimated mill rate for 1978 would be 19.72 compared to 16.064
for 1977. The Clerk further Commented that the 1977 Minnesota Legislature Changed the
method of determining assessed value on homesteaded property and, therefore it was likely
the assessed valuation against which the mill rate applies would be lass for most homes in
the City in 1978. The Clark further commentedlthat the combination of the reduced assessed
valuation and the increased mill rate would likely result in a tax increase of approxi-
mately $45.00 for a home with a market value of $50,000. The $45.00 change consists of
approximately $15.00 for operating coStS and $30.00 for debt service.
Vote was taken on the motion. Ayes - 5 - Nays - 0.
The Mayor stated Dakota Electric Association was hosting a meeting on the evening of
October llth, 1977, for the purpose of,advising municipal officials, in its service area,
of current operating policies of Dakota Electric and to receive input from municipal
officials.
The Mayor announced he, along with other Councilmembers, had received copies of corres-
pondence concerning 140th'Street and that a group Of Apple Valley residents would be
meeting informally with the Dakota County Board on October Llth at 11:00 a.m. and
suggested as many Councilmembers as possible attend.
The Mayor announced the appointment of Mr. Harold Tuset as Apple Vallay's United Nations
Chair for United Nations Week, being the week of October 24th, as proclaimed by Governor
Rudy Perpich.
