Minutes of the special meeting of the City Council of Apple Valley, Dakota County,
Minnesota, held December 29th, 1977,-at 5:00 o'clock p.m.
PRESENT: Mayor Branning; Councilmembers:_Fitzsimmons, Holton, Hayes .(attended at
5:12 p.m.) and Savanick (attended at 5:17 p.m.); Clerk Asleson.

Mayor Branning called the meeting to order at 5:05

Consideration of a request for reduction in a letter of credit amount for the Highlands

MOTION: of Holton, seconded by Fitzsimmons, approving the contract with :LAKE WATER

for the period October 1, 1977, through September 30, 1978, at -CONTRACT
a cost to the City of $1,600, and authorizing the Mayor and

MOTION: of Holton seconded by Hayes, adopting-Resolution No. 1977-262
transferring $5,220.66 of Antirecession ·Fiscal Assistance Pro-
gram funds to the Golf Course Fund. Ayes - 4 - Nays - 0.

Clerk Asleson said MACRO has asked for a clarification of the park and ponding dedication
requirements remaining in that planned development. A portion of the 77.2 acres has been
platted as Greenleaf 11th Addition and 33.29 acres remain.
MOTION: of Hayes, seconded by Hoiton, adopting Resolution No. 1977-263 RES. 1977-263
determining that park and ponding dedication on the 33.29 acres MACRO PARK
of MACRO property in Section 25 shall be an amount not to ex- DEDICATION
ceed 12 percent land or $3,300 per acre and this option shall
continue until March 12th, 1985. Ayes - 5 - Nays - O.
The Council received the Memorandum Findings, Conclusions and Order for Judgment in
Bankruptcy Proceedings of Ralph Tharp.
MOTION: of Savanick, seconded by Molton, directing the City Attorn&y
to Appeal the decision in the Tharp bankruptcy proceedings
giving the Trustee in Bankruptcy the part of the original
medical center property in Dr. Thapp's name to be used for
the benefit of the creditors. ~

DECISION
The Council discussed the history of the land transfer, on part of which is the existing
medical clinic, and the intent that the land be used for medical purposes. Council-
member Savanick asked how much an appeal would cost the City? Jim Sheldon said their
fee would be based on an hourly rate and could total between $1,000 and $3,000. He
said in order for the appeal to be successful, the judge's decision would have to be
proven wrong. :'
Vote was taken on the motion. Ayes - 5 - Nays - 0.
MOTION: of Holton, seconded by Savanick, approving hiring Dennis. HIRE PARTTIME
Hergenroder for park maintenance at $3.50 per hour effective EMPLOYEE
January 3, 1978, Ayes - 5 -Nays - O.
MOTION: of Holton, seconded by Hayes, approving relocation of the RADIO EQUIP.
Police radio antenna, stations and dispatcher console to RELOCATION
the City Hall expansion by Air Comm at a cost of~$2,998.00.
Ayes - 5 - Nays - 0.
MOTION: of Holton, seconded by Hayes, adopting Resolution No. 1977-
264 approving the General Fund and various other City Budgets
for 1978 as shown in the attachments. Ayes - 5 - Nays - 0.

ORDINANCE 194
PERSONNEL AMDT.
MOTION: of Holton, seconded by Hayes, passing Ordinance No. 194 amend-
ing Ordinance No. 141, personnel rules and regulations, pre-
scribing a t2-month probationary period for all new employees
and revising the policy for overtime pay for sworn police
employees. Ayes - 3 - Nays - 2 (Fitzsimmons and Savanick).
Councilmember Savanick said she voted against the above motion because she wanted further
discussion of the holiday policies for clarification.
MOTION: of Hayes, seconded by Holton, adopting Resolution No. 1977-
265 approving the pay rates and policies for 1978 for City
employees.

Mayor Branning said he would recommend the salaries of the Police
Chief and the Police Lieutenant be increased by ten percent for
1978. The motion and second agreed to amend the motion as such.
Vote was taken on the motion. Ayes - 5 - Nays - 0.
MOTION: of Hayes, seconded by Fitzsimmons, to pay the claims and bills
checks numbered 6495 through 6499 and 7456 through 7503, in
the total amount of $66,203.37. Ayes - 5 - Nays - 0.

MOTION: of Savanick, seconded by Fitzsimmons, to adjourn. Ayes - 5 - Nays - 0.
