PRESENT: Councilmen Branning, Garrison, Hayes and Holton; Clerk Asleson. ABSENT: Mayor Largen. Acting Mayor Branning called the meeting to order et 7:30 p.m. All residents in Attendance took part in the pledge of allegiance to the flag and Councilman Garrison gave the invocation. MOTION: of Holton, seconded by Garrison, approving the minutes of the meet- JUNE 25, 1975 lng of June 25th, 1975, as written. Ayes - ~ - Nays - O. MINUTES MOTION: of Holton, seconded by Garrison, setting a special Council meeting for July 16th, 1975, at 7:00 p.m. to consider award of street seal coating bids and other items. Ayes - 4 - Nays - O. SPECIAL~E~'I'ING JULY 1~ .1975~ The City Clerk presented a picture depicting the ice arena given to the City by Richard Hamel, the architect, who was unable to be present, and suggest the picture be hung in the ice arena when it is completed. Dr. Droegemueller of the School District office was present to discuss the guardrail for the Galaxie pathway. The Clerk reviewed the Council's discussions concerning the guardrail at the last two Council meetings. Dr. Droegemueller said one of the consi- derations in bussing children to Greenleaf Elementary School last year was the fact that the guardrail had not been installed. Councilman Garrison asked whether the School would not bus children if the guardrail were installed. Dr. Droegemueller said this is a decision of the School Board but it would be a consideration. Councilman Branning asked if the School could consider this question at its July 28th meeting, which he will attend. MOTION: of Garrison, seconded by Holton, approving the contract with the SPECIAL Federal Government to conduct a special census in Apple Valley and CENSUS authorizing the Mayor and Clerk to sign the same. Ayes - ~ - Nays - 0 Public Hearing - Acting Mayor Branning called the public hearing on utilities for Apple Valley Square, Project 75-86, to order at 8:05 p.m. and noted the affidavit of publication. Mr. Rosene showed the location of the Apple Valley Square Development. Utilities for Phase I, consisting of water mains and storm sewer trunks and laterals are estimated at $145,860 and Phase II utilities are estimated at $32,600. The City Clerk commented on the trunk oversizing for storm sewer of which not all will be able to be assessed. The driveway access on County Road 42 is presently shown to be directly across from Granada Avenue and in the future it will be moved slightly farther east. Councilman Garrison asked the Engineer to ask the developer if he would consider installing the driveway access at the eastern location now because of the hazardous intersection it would create with Granada Avenue. John Gretz commented that the developer is ready to break ground Monday. The installation of a narrow median in County Road 42 in front of Granada Avenue was discussed and staff was asked to review it for future Council consideration. Acting Mayor Branning called for any further questions or comments from the audience. Apple Place (Baden's Bowling Alley) deleting the "nightclub" portion PLAN CHANGE of the building and allowing a private pizza parlor operation, in that part of the building. The original restaurant plan will remain un- changed. Ayes - 4 - Nays - 0. Mr. Baden commented that they plan to have the bowling lanes open at the Apple Place about Labor Day, but the restaurant portion will not be completed by that date.- MOTION: of Holton, seconded by Garrison, authorizing the Engineer to prepare a change order for Council consideration to install City water adja- cent to Lot 8 of White Oak Ridge Addition. LOT B ~ITE OAK RIDGE WATER Mike Bassett introduced Carl Vogt of the Minnesota Environmental Science Foundation~ who assists public agencies in long term management and development of park areas. Mr. Vogt gave a slide presentation of some work his company has done in other areas. They would propose to prepare a plan for Lake Alimagnet Park for development of some areas and preservation of other areas of the park. The Council will consider this information and discuss-it-fur{her in the future. Mike Bassett commented on what the. City has been doing thus far to control tree diseases~ and on recent~State legislation providing financial assistance for some disease control. There will be a hearing July 10th on administering the legislative intent of the bill. John Gretz reviewed water problems on the streets in the Woods Addition caused by the recent rain~ He also cormmented on the high water and erosion problems of Long Lake and Farquar Lake. Thompson will be seeding the area around Long Lake, but that will not com- pletely stop.erosion. Farquar Lake is now at a higher lever than ever before and has no outlet. The solution would be a pump to reduce and maintain the level of the lake which would eventually drain into the Vermillion drainage basin. The Engineer was re- quested to determine the cost of a study for solutions to these problems. CITY 0FAPPLE VALLEY Dakota County, Minnesota July 9, 1975 Page - 3 James Nelson asked whether natural gas service could be extended to Farquar Lake Addition. John Gretz said the Gas Company would have au extra charge for installing the service because of the distance involved and the small nu~uber of connections to it. Mr. Goering asked whether the City would treat Fsrquar Lake with copper sulphate. They were asked to submit a letter requesting this to the Park Director and the Council wo~ld consider paying part of the cost of the copper su[lphate as it does for Lake Alimagnet. She Council reviewed information on sidewalk policies from January ~4~ 1973, and decided no change is necessary. John Gretz co~mmented on the space requirements at City Hall. Two holding cells could oe added and the interior rooms could be divided for additional room for the Police Department or only the two holding cells could be added. Either suggestion would only solve the space problems for one to two years. Councilman Garrison said a decision should be made now whether to expand the existing City Hall or build a building at a new location. John Voss will have the Planning Commission review 'the Comprehensive Plan in the next 30 days for a possible relocation site and report back to the Council. £he City Clerk cormnented on the Liquor Store operation and expansion concepts. He said ~ales have continued to increase and that the Manager feels we should be considering ~xpansign to a second location. Cost information is being assembled and will be pre- ~ented to the Council in the near future. Councilman Garrison noted that when the census is complete and recorded at more than 10,000~ the public must vote on the question of retaining Municipal off-sale liquor. DISPATCHER SALARIES CITY OF APPLE VALLEY Dakota County, Minnesota July 9, 1975 Page - 4 MOTION: of Holton, seconded by Garrison, authorizing the Police Chief to post a notice recruiting internally up to two Police Sergeants one for September 1st and one tentatively for January lst; requires 18 months experience with Apple Valley and 36 months experience total. Ayes - 4 - Nays - O. RECRUIT POLICE SERGEANTS Councilman Garrison requested a letter be sent to McDonald's thanking them for having their employees pick up letter in the City. Councilman Garrison said the deadline for Council Table articles will be August 13th. It was also discussed whether to put a questionnaire on City services in the Council Table. Councilmen Branning and Hayes will check some organizations to see if they are in- terested in distributing such a questionnaire. Councilman Hayes asked that a letter be sent to Joe Lieb and John Field c~mmending them for their organization, of the 4th of July celebration. The June Park Report, June Building Report, June 27, 1975, Gross Payroll Report and a letter from Dakota County concerning a meeting held July 9th to consider the establish- ment of a Vermillion River Watershed District were received. MOTION: of Holton, seconded by Hayes, accepting work on the Country Club Pool POOL REPAIRS by Northernaire Pools and Baker Pools as complete and authorizing final payment. Ayes - ~ - Nays - O. MOTION: of Holton, seconded by Hayes, adopting Resolution No. 1975-92 sup- porting the League of Minnesota Municipalities legislation on the open meeting law and authorizing sending copies to the Governor and the Legislature. RES. 1975-92 OPEN MEETING LEGISLATION TEMPORARY 3.2 BEER LICENSE MOT ION: OF Garrison, seconded by Hayes, approving a temporary on-sale 3.2 beer license for Bruce Dinkel for the Softball Tournament at West- view Park July 19th and 20th. Ayes - 4 - Nays - O. Councilman Hayes said people have expressed concern over the lack of lighting at the Westview Building. The problem with the lights is vandalism and the lights are broken almost as soon as they are replaced. Staff was asked to see if some type of protective shields could be obtained and an additional light installed. MOTION: of Holton, seconded by Hayes, approving the updated Civil Defense Plan and authorizing the Mayor and Clerk to sign the same. Ayes - 4 Nays - O.
