Minutes of the special Council meeting of the City Council of Apple Valley, Dakota
County, Minnesota, held on September 24th, 1975, at 7:00 o'clock p.m., as set by
the City Council on August 27th, 1975.
PRESENT: Mayor Largen; Councilmen Branning, Hayes, Holton and Garrison (attended
at 7:10 p.m.); Clerk Asleson
ABSENT: None.
Mayor Largen called the public hearing on proposed 1975 assessment rolls to order
at 7:02 p.m. and noted the affidavit of publicatioD. The City Clerk reviewed roll
number 96, engineering fees for preparation of plans and specifications for utility
improvements in Leanin' Tree and Apple Valley East Phase 2, in the total amount of
$14,363.54. The Mayor called for any questions or comments from the audience.
There were none.
The City Clerk reviewed roll number 97, street improvements on Granada Drive and
the service drive on the north side of County Road 42 from Pennock to Cedar and
north from Cedar to 149th Street, in the total amount of $50, 604.56. The Mayor
called for any questions or comments from the audience. There were none.
The City Clerk reviewed roll number 98, street and related storm sewer improvements
on Fairgreen Avenue from County Road 42 north to approximately one-half mile north
of Ellice Trail, in the total amount of $315,616.32 of which $214,303.84 are assessed
and the balance paid by the City and State Aid funds. He also said Mr. Roberts of
Shakopee Sand & Gravel may be filing an objection to the assessments because of
the elevation of the road, but it does meet the grades shown on the grading plan
of Shakopee Sand & Gravel on file with the City. The Mayor called for any questions
or conm~ents from the audience. (Councilman Garrison attended at this time.)
Mrs. Don Andrusick asked about Fairgreen becoming a state road because of the loca-
tion of the Zoo. The Clerk said Fairgreen would have been constructed at this time
whether the Zoo was planned or not and any further improvements or widening of the
road will not be assessed- Mike Kelly asked about traffic from the south using the
road to get to the Zoo. It is not intended to encourage Zoo traffic on Fairgreen
and most traffic will be on Cedar Avenue. Mrs. Andrusick asked if the state took
over the road, would the property owners assessed for it now receive some remuneration
from the state? The Mayor said no, the state is very reluctant to take over roads
now. The Clerk said it is hoped that the road will be upgraded by state money before
the opening of the Zoo. Charles Curry asked if the state is assessed for the por-
tion of road abutting its property? It is not assessed but the state does pay for
the improvements.
The City Clerk reviewed roll number 99, street and related storm sewer improvements
on 140th Street from Cedar Avenue to Garden View Drive, in the total amount of
$200,691.67 of which $124,305.60 are assessed and the balance paid by the City and
State Aid funds. The Mayor called for any questions or comments from the audience.
The Clerk presented a letter from Mr. Calistro's attorney objecting to the assess-
ments. Mr. McMenomy, the City Attorney, commented on the condemnation proceedings
and the driveway problem with Mr. Calistro at Cedar Avenue. He said he believes
the matter should be taken to the Court and ask that the owners refrain from using
that access because of the safety hazard. Mr. Calistro said he objects to changing
the driveway from Cedar Avenue to 140th Street. The Attorney was directed to file

a motion with the Court asking that the driveway access to Cedar Avenue be closed.
There were no further questions or comments on this assessment roll.
The City Clerk reviewed roll number 100, Nordic Properties reassessment, in the
total amount of $119,353.83. The Mayor called for any questions or comments from
the audience. Mr. Volstad, attorney for Nordic Properties, requested that the
assessments be spread over five years.
The City Clerk reviewed roll number 101, grading of the County Road 42 and Cedar
Avenue service drive, in the total amount of $4,573.84 of which $2,286.92 is assessed
and the balance paid by the City. The Mayor called for any questions or comments
from the audience. There were none.
The City Clerk reviewed roll number 103, Valley Con~ercial Park 2nd Addition
street improvements, in the total amount of $11,345.64. The Mayor called for any
questions or comments from the audience. There were none.
The City Clerk reviewed roll number 104, storm sewer in the County Road 42 and
Cedar Avenue service drive from Pennock along County Road 42 and north on Cedar to
149th Street, in the total amount of $46,543.28 of which $30,995.10 is assessed
and the balance paid by the City. The Mayor called for any questions or comments
from the audience. There were none.
The City Clerk reviewed roll number 105, sanitary sewer, water and storm sewer im-
provements in Palomino Hills 6th Addition, Palomino Lakeside Estates and some storm
sewer in Palomino Lakeside Meadows, in the total amount of $169,746.64. The Mayor
called for any questions or comments. There were none.
The City Clerk reviewed roll number 106, sanitary sewer, water and storm sewer im-
provements for Carrollwood Village 1st Addition, also storm sewer in 140th Street
and backup water lines to the Zoo, in the total amount of $164,555.05 of which
$71,117.24 is assessed now and the balance will be assessed in 1976. The Mayor
called for any questions or comments from the audience. There were none.
The City Clerk reviewed roll number 107, street improvements for Hayes Road, 145th
Street, Carrollwood Village 1st Addition and Palomino Lakeside Estates (only the
last two additions are being assessed this year), in the total amount of $43,711.68.
The Mayor called for any questions or comments from the audience. There were none.
The City Clerk reviewed roll number 108, street improvements on Hayes Road from
140th Street to 490 feet south of 145th Street with sidewalk on the east side to
145th Street and 145th Street from Carrollwood 1st Addition east to Hayes Road with
sidewalk on the north side, in the total amount of $164,288.32. The Clerk noted
this is an estimate and if the costs are significantly different when the project
is completed, an adjusted assessment roll will be filed next year. The Mayor called
for any questions or comments from the audience. There were none.
The City Clerk reviewed roll number 109, utility improvements in Phase II of Apple
Valley Commercial Addition, Townhouse 6th Addition and four lots on Fairgreen Avenue,
in the total amount of $308,330.38. This includes $61,848.05 for Greenleaf 10th
Addition which will be paid in a lump sum by Thompson. The Mayor called for any
questions or comments from the audience. There were none.

After all assessments were reviewed and everyone present given an opportunity to
be heard, the hearing was declared closed at 7:44 o'clock p.m.
MOTION:
of Branning, seconded by Hayes, adopting Resolution No. 1975-123
adopting the 1975 assessment rolls with number 100 being spread
for five years and noting the objections to the rolls as filed.
