ABSENT: Mayor Largen. Acting Mayor Branning called the meeting to order at 7:33 p.m. The Council members and everyone in attendance took part in the pledge of allegiance to the flag. MOTION: of Holton, seconded by Garrison, approving the minutes of the meet- DEC. 10, 1975 ing of December 10th, 1975, as written. Ayes - 2 - Nays - 0 (Branning Abstained). Councilman Hayes attended at this time. MOTION: of Garrison, seconded by Holton, setting the regular Council meet- ings in January for the second and fourth Mondays, January 12th and 26th, 1976, at 7:30 p.m. Ayes - 4 - Nays - 0. SET JANUARY MEETING DATES It was requested that a discussion of the February meeting dates be held on January 12, 1976. MOTION: of Garrison, seconded by Holton, approving the preliminary plat for A.V. SQUARE Apple Valley Square with Outlots F and G as part of Outlot E and PRELIM. PLAT easements for ponding and 153rd Street shown over Outlot E. Ayes - 4 - Nays - 0. MOTION: of Garrison, seconded by Hayes, granting a variance for Lots 22 and VARIANCE 23 of White Oak Ridge Addition permitting one house to be built on WHITE OAK RIDGE the two lots.· Ayes - 4 - Nays - 0. MOTION: of Holton, seconded by Hayes, approving an agreement between the Cities of Apple Valley, Lakeville and Farmington and Midwest Med- Kab, Inc., for ambulance service, subject to the agreement being approved by the other cities; the guarantee amount to be agreed on at a figure between zero and $10,000. Ayes - 4 - Nays - 0. AMBULANCE SERV. AGREEMENT WITH MIDWEST MED-KAB MOTION: of Holton, seconded by Hayes, adopting Resolution No. 1975-186 auth- RES. 1975-186 orizing the purchase of election equipment including a ballot tab PURCHASE machine for $24,000 from Computer Election Systems and waiving the ELECTION EQUIP, requirement for receiving sealed bids since this is the only source of that machine. CITY OF APPLE VALLEY Dakota County, Minnesota December 30, 1975 Page - 2 MOTION: of Holton, seconded by Hayes, adopting Resolution No. 1975-187 auth- RES. 1975-187 orizing the purchase of a Zamboni ice machine for approximately PURCHASE $18,300 in conjunction with School District 196 for the ice arena ZAMBONI MACHINE and waiving the requirement for receiving sealed bids since this is the only source of that machine. Ayes - 4 - Nays - 0. MOTION: of Garrison, seconded by Hayes, approving the claims of Mr. Kirby, SEWER BACKUP $2,659.63, and Mr. Lofsness, $852.00, related to the August 1, 1975, CLAIMS - KIRBY sewer backup, subject to City Attorney drafting paperwork assigning & LOFSNESS their rights of further claims to the City so the City can prosecute. Ayes - 4 - Nays - 0. MOTION: of Garrison, seconded by Holton, adopting Resolation No, 1975-188 RES. 1975-188 setting a public hearing on the liquor license application of John LIQUOR HEARING D. Rezac, Lemon Tree Restaurant, for January 26th, 1976, at 8:00 p.m. REZAC Ayes - 4 - Nays - 0. MOTION: of Holton, seconded by Hayes, adopting Resolution No. 1975-189 closing the County Road 42 and Garden View Drive intersection im- provement account and transferring $243.36 from the General Fund as part of the City's share. Ayes - 4 - Nays - 0. RES. 1975-189 CLOSE G.V. DR. & CO. RD. 42 IMPR. ACCOUNT Councilman Branning asked the staff to pursue the possibility of having the MTC move the bus shelter at Garden View Drive and County Road 42 back from the corner of the intersection. The Clerk commented on not requiring the installation of trees in the boulevard in new subdivisions, but on the front part of the lot instead. As the trees grow larger, they will cause maintenance problems. He said Orrin Thompson called him about several other communities that have tried this and there were some problems with placing trees on the front part of lots also. This item was tabled until more information can be obtained. MOTION: of Hayes, seconded by Holton, accepting Project 75-86, Apple Valley ACCEPT FINAL Square Utilities, as complete and authorizing final payment. Ayes - PROJ. 75-86 4 - Nays - 0. MOTION: of Garrison, seconded by Holton, approving Change Order No. 1 to the CHANGE ORDER 140th Street Project of an additional $3,752.40 for widening the 140TH STREET gravel base to 52 feet. Ayes - 4 - Nays - 0. Councilman Garrison asked why Dakota Electric has installed poles along Hayes Road and 140th Street from Garden View Drive and not put the lines underground. John Gretz said he would check into the matter. MOTION: of Garrison, seconded by Holton, approving bond reductions for THOMPSON BOND Greenleaf 6th from $15,000 to $9,000; Greenleaf 7th and 8th from REDUCTIONS $50,000 to $7,500; Greenleaf 9th from $247,100 to $100,000; Greenleaf 10th from $45,180 to $2,000 cash escrow; Greenleaf Townhouse 6th from $26,035 to $3,000 cash escrow; and Greenleaf 4th and 5th from $3,000 to $1,000 cash escrow. Ayes - 4 - Nays - 0. John Gretz reported on construction progress at the Zoo. No unusual problems have been encountered. The estimated completion dates have not changed, but the estimates of the contractors bidding on the main complex will have a large impact on possible revisions to the completion date. MOTION: of Garrison, seconded by Holton, approving transient merchant lic- enses for A.J. Steam Cleaning, carpet cleaning service, and C.J. Moen, selling art prints. Ayes - 4 - Nays - 0. TRANS. MERCHANT A.J. STEAM CLEAN & MOEN, ART PRINT Notification was received of the Association of Metropolitan Municipalities general membership meeting scheduled for January 8th at 8:00 p.m. in Brooklyn Center. Topic is the 1976 Legislative program. Richard Asleson will be attending. MOTION: of Holton, seconded by Garrison, adopting Resolution No. 1975-193 authorizing filing of an application for a park grant through the State Natural Resources Fund. Ayes - 4 - Nays - 0. PROGRAM MOTION: of Holton, seconded by Garrison, accepting the resignation of COMMITTEE Robert Young and Nancy Sheppard from the Architectural Committee RESIGNATIONS and Tim Crichton from the Park Committee. Ayes - 4 - Nays - 0. There are Committee vacancies now three vacancies on the Park Committee, one vacancy on the Urban Affairs and two vacancies on the Architectural Committee. Appointments to fill these will be considered at the next meeting. MOTION: of Holton, seconded by Hayes, approving the promotion of Dan Sams from Police Officer to Police Sergeant effective January 1, 1976. Ayes - 4 - Nays - 0. SAMS PROMOTION MOTION: of Hayes, seconded by Holton, approving the promotion of Lloyd Rivers RIVERS from Police Sergeant to Police Lieutenant effective January 1, 1976, PROMOTION and approving the job description for the Lieutenant position. Ayes - 4 - Nays - 0. CITY OF APPLE VALLEY Dakota County, Minnesota December 30, 1975 Page - 4 Consideration of the 1976 salary plan was tablgd until January 12th, 1976, meeting. Councilman Garrison commented on a survey conducted by Janet Shickell and Gene Tetrault for an Urban Geography class. One area of the survey was transit and, though this was a limited survey, they found people cannot use the transit system because it does not go where they need to go. Mr. Garrison will be writing to the Metropolitan Transit Commission asking it to conduct its own survey and also if they have any further infor- mation on bus service proposals presented by it earlier in the year.
