HomeMy WebLinkAbout05/18/1976CITY OF APPLE VALLEY Dakota County,~Minnesota Mmy 18, 1976 Minutes of the Board of Review Meeting, City of Apple Valley, Dakota County, Minnesota, held May 18, 1976, at 7:00 o'clock p.m. PRESENT: Councilmen Branning, Garrison, and Holton; Clerk Asleson. ABSENT: Mayor Largen and Councilman Hayes. Acting Mayor Holton called the meeting to order at 7:00 p.m. The City Clerk presented the affidavit of publication to the City Council. It was examined, found satisfactory and ordered placed on file. The City Clerk also advised that he caused notice of the meeting to be posted in accordance with Minnesota Statutes 274.01. The meeting was then turned over to Mr. Jake O'Toole of the County Assessor's Office. Mr. O'Toole asked for general comments from the approximately 15 people present. A discussion ensued related to the 1972 real estate valuation law which resulted in different valuations being on similar property, depending on if the property was invloved in a sales transaction in 1972. Mr. Glen Galles discussed with the Council the action presently underway by the City of Burnsville wherein the City is accepting petitions from all property owners who were affected by the 1972 valuation differences, it being noted that each person so affected in Burnsville who desired to pursue adjustments was signing a petition at the Burnsville City Hall for a fee of $30.00 which included $18.00 for court filing fees and $12.00 to help defray Burnsville's legal expenses. Even though the apparent inequity has been in existence since 1972, it was noted any court ordered changes could affect only taxes payable in 1976 and subsequent years. Also anyone desiring to file a petition appealing their 1975 valuation for taxes payable in 1976 must have their first half of the 1976 taxes paid and file the petition in district court not later than May 28th. The Council indicated, due to the short time period, the City of Apple Valley could not become involved in an organized effort such as Burnsville, but individual property owners desiring to file an appeal could do so. The City Clerk was directed to contact the City Attorney to determine the feasibility of Apple Valley participating as an intervenor in the Burnsville court action. Following this period of general discussion, all persons present were provided the opportunity to review the individual valuation records on their properties with representatives present from the County Assessor's Office. Representatives from the County Assessor's Office, in addition to Mr. O'Toole, included Mr. Grundahl, Mr. Burdorf, Mr. Krier and Mr. Nelson. Mr. Dana Dougherty, 470 Reflection Road, Lot 9 of Block 6 of Palomino Hills Lakeshore Addition, was present and stated he wished to file a formal appeal concerning the valuation of the aforementioned property. The City Council reviewed his request in detail by comparing it to other property in Apple Valley which Mr. Dougherty sug- gested was if a similar nature but was valued differently. No adjustment was ordered by the City Council, however they directed Mr. O'Toole to thoroughly review CITY OF APPLE VALLEY Dakota County, Minnesota May 18, 1976 Page - 2 the valuation on the aforementioned property including making a personal visit to the site. They further directed Mr. O'Toole to advise the Council, at a subsequent date, if, in his opinion, any changes should be made on the valuation of Mr. Dougherty's property. The Council also noted as received a May 17, 1976, letter from M.C. Huffstutler, Jr., 449 Reflection Road, Lot 21 of Block 5 of Palomino Hills Lakeshore Addition. The purpose of said letter was to appeal the 1976 tax statement on the aforementioned property. The Council reviewed the letter and its attachments. MOTION: of Branning, seconded by Garrison, to adjourn. Ayes - 3 - Nays - 0. The meeting adjourned at 9:40 o'clock p.m.
