Minutes of the meeting of the City Council of 'Apple Valley, Dakota County, Minnesota,
held August 25, 1976, at 7:00 p.m.
PRESENT: Mayor Largen; Councilmen Branning, Hayes and Holton; Clerk Asleson.
ABSENT: Councilman Garrison.
Mayor Largen called the meeting to order at 7:00 o'clock p.m. The Council members and
everyone in attendance took part in the pledge of allegiance to the flag. Mayor Largen
gave the invocation.

The Clerk briefly reviewed a proposed ordinance related to conduct of persons on school
property and said some revisions to it were needed. It was temporarily tabled.
John Gretz showed the plans for the Big Wheel Auto Store approved by the Council August
11, 1976, and said the reason for bringing it to the Council now was to make them aware
of the delivery entrance on the east side of the building facing County Road 42. This
was always shown on the plans, but was not specifically mentioned at the August 11th
meeting. Councilman Branning questioned the conditional use in that area and the Council
discussed the action taken at the August llth meeting. John Voss briefly reviewed the
landscape plan.

Don Anderson, of Palomino Development, reviewed a proposal for amending the Cobblestones
Planned Development Agreement. They are proposing building single family homes rather
than townhouses for a total of 596 dwelling units rather than the originally proposed
804 units. The Mayor commented that future buyers of the single family homes should be
informed there are apartments proposed for certain areas also. John Voss reviewed the
preliminary plat and the parkland near Alimagnet Lake. He said the Planning Commission
was concerned about vehicular access to the park and viewing the Lake from the park.
The Council discussed various means of getting vehicular access for the park. It was
also noted that the developers have acquired the strip of property in Burnsville along
the Lake. Mr. Anderson said there is a flat area north of this property that could
possibly be used for parking. The plans will be redrafted and the Council asked if
this could be reviewed at a joint Planning Commission-Council meeting. They said one
concern was to maintain as much public lakeshore property as possible.
Consideration of an ordinance related to conduct of persons on school property was tabled
and will be reviewed by the City Attorney.
PUBLIC HEARING - The Mayor called the public hearing on Project 76-13, Pemtom. Development
utility and street improvements, to order at 8:45 p.m. The Clerk said he recommends this
hearing not be closed tonight because of unanswered questions related to assessments,
particularly the water reservoir which is part of it. The Mayor read the public hearing
notice. Robert Rosene reviewed the utilities, proposed for the area to serve 365 single
family lots and noted the proposed reservoir. The storm water in the southeast corner
will flow toward the east and the rest will flow north to a ponding area before going
into the Whitney Drive storm sewer and finally to Keller Lake. The total cost of the
project including the water reservoir is $2,296,100.00. Branning asked about having
the storm water flow west into Lac Lavon. Mr. Rosene said Lac Lavon is a ground water
table lake and is very clean now. The storm water would carry silt into it and the pre-
sent drainage pattern in the area is toward the nort and east and should not be changed.
The Mayor called for any questions or comments from the Council and public; there being
none, the hearing was continued indefinitely at 9:03 p.m.
Councilman Branning announced that Sam Emond is playing the organ at Apple Place this
week to set a record for the Guiness Book of World Records and also soliciting donations
for muscular dystrophy.
Mayor Largen brought up the revisions to the Big Wheel Auto Parts conditional use permit.
Mr. Art Leibfried, representing the store, said they would like the delivery entrance
on the south side because the rear of the building will be only 30 feet from the lot line
and there would not be enough room for a truck to back into it.

Robert Rosene reviewed the water pressure problems some of the homes in the area of
Alimagnet Lake are having. He said this area is quite a long distance from the water
reservoirs and is also at a higher elevation. Now about 15 to 20 homes are invloved,
but as the area grows, especially Timberwick 2nd Addition, more homes will have water
pressure problems. Individual pressure tanks could be installed in each house at a cost
of $250 each, or pressure reducing stations could be constructed, in the water mains.
When the area has been completely developed, three pressure reducing stations, at $7,000
each, would be needed, but at the present time installing one in the Hayes Road water
main would handle the problem.

The Clerk reviewed information on ambulance operations and the figures Of Midwest Med-
Kab's financial information. He also said Burnsville and Eagan calls do not have the
surcharge because they never received primary service from the original ambulance ser-
vice or the existing one, but have always usea other ambulance services. Rosemount
has always received primary ambulance service from Franke and Midwest Med-Kab. The
surcharge does not apply to any ambulance Calls originating in the cities of Apple
Valley, Lakeville or Farmington.

The Council reviewed a draft Of the proposed liquor election brochure and suggested
some changes. It was agreed that Councilman Holton would work with the Clerk to
rewrite it.
The Clerk reviewed statistical data on the proposed bond issue for City Hall expansion
and compared it with the 1971 park bond issue. The Council reviewed the brochure pre-
pared by the architects and suggested some changes.

Councilman Hayes asked about installing some additional stop signs near the golf course
and possibly a "dangerous intersection" sign. Mr. Bassett will review this.
