ABSENT: Committee Member Josh Gaffke ITEM 1. Committee Chair Strom called the meeting to order at 7:00 p.m. ITEM 2. Approval of Agenda MOTION: by Sullivan, seconded by B. Agenda Items — Proposed Amendments to Park Dedication Requirements Director Bernstein reviewed the revised park dedication fee schedule. After the City retained a real estate valuation service company to research and analyze average market value, it was determined the existing benchmark $89,100 land values did not reflect recent land sales for single-family residential development in the area. Therefore, a single-family benchmark land value for cash -in -lieu of land dedication for public park purposes has been set at $75,000. -lof3- CITY OF APPLE VALLEY PARKS AND RECREATION ADVISORY COMMITTEE July 21, 2016 ITEM 5.B. Agenda Items — Cobblestone Lake Park Director Bernstein reported status of the park development. Metropolitan Grant eligible items must be completed by December 31, 2016. Hoisington Koegler Group, Inc., provided concept design plans were presented for review. Items included location of the restroom, pathways, picnic shelter size, exercise equipment placement, passive area with covered chairs/swings, trestle with grand entrance near the lake with visual effect items/art work. Staff has recommended delineation between private property and park property using landscaping. Staff continues to meet with Tradition Development on the design options and costs to refine the plan. Funding of the park construction includes City funds, Tradition Development's matching contribution, and anticipated Metropolitan grant. As with past park development, staff will work with Tradition Development on the design options, Tradition Development will coordinate construction and then deed the property to the City. ITEM 5.C. Agenda Items — Cortland Neighborhood Park MOTION: by Sullivan, seconded by B. Montgomery, to approve the scheduling of a Special Informal Meeting of the Parks and Recreation Advisory Committee beginning at 6:00 p.m., on Wednesday, August 10, 2016, at Apple Valley Community Center, for the purpose of discussing the future of the Cortland Development park property. VOTE: Yes — 6, No — 0 ITEM 5.1). Agenda Items — Hayes Park — Little Library Dedication MOTION: by Sullivan, seconded by Hammill, to approve the scheduling of a Special Informal Meeting of the Parks and Recreation Advisory Committee beginning at 6:30 p.m., on Tuesday, August 9, 2016, at Apple Valley Community Center for the purpose of a dedication of the Little Library within Hayes Park. VOTE: Yes — 6, No — 0 ITEM 5.E. Agenda Items — Recreation Manager Position Update Director Bernstein noted an offer has been made and accepted for the Recreation Manager position. Appointment is scheduled for the July 28, 2016, City Council meeting. Agenda Items — Division Updates Director Bernstein reported all divisions are very busy. Both pools are doing great, as well as is the golf course. Park Maintenance is busy preparing for several youth athletic association driven tournaments - soccer, baseball, etc. Committee complimented Director Bernstein, Park Superintendent Adamini, and Arena Manager Christianson on their work. Summary Presbyterian Homes & Services Cobblestone Lake Senior Housing Development was presented at the August 25, 2016, City Council meeting. The repositioning to the north of the Outlol designated for public park purposes was handled through vacation and acceptance of easements. Also included at the meeting, Cobblestone Lake Western Park concept plans for said Outlot were presented. These were the same concept plans presented to the Parks and Recreation Advisory Committee in July. Background The Planning Commission has addressed the Cobblestone Lake Senior Complex Addition at multiple meetings since receipt of the application for development in 2008. At the July 6, 2016, Planning Commission meeting the Commission recommended approval of the rezoning, preliminary plat, and site plan/building permit authorization. The Outlot, known as Cobblestone Lake Western Park, is located in the southeast quadrant of the city on the northwest end of Cobblestone Lake. The Outlot is approximately 3.75 acres in size. The developer indicated there will be no net loss of designated park area with the location shift to the north. Hoisington Koegler Group, Inc., has prepared concept plans that include a picnic shelter, restroom building, water feature artwork, outdoor exercise area, and landscaping. The plan was reviewed by the Parks and Recreation Advisory Committee at the July 21, 2016, meeting and recommended it move forward to City Council. Funding of the park construction includes City funds of $300,000, Tradition Development's matching contribution, and anticipated Metropolitan Livable Communities Grant. The approximately $298,000 grant has an expenditure deadline of December 31, 2016, and is earmarked primarily for utility work. The development agreement with Tradition Development is being modified to include various infrastructure items. Summary Staff is seeking recommendation to proceed, through use of Park Dedication funds, with the Cortland Development Park concept plans as presented by Hoisington Koegler Group, Inc. Background Cortland Development is located in the southeast corner of Embry Path and County Road 42. Within it is 5.56 acre designated as public park. Hoisington Koegler Group, Inc., prepared preliminary park design concept plans were presented at a neighborhood public open house Wednesday, August 10, 2016. The meeting was well attended and the plans were adjusted to incorporated feedback received. The plans currently include a pavilion, playground equipment, basketball half -court, volleyball court, landscaping, and more. Funding for this project is proposed through Park Dedication. Attached is a presentation outlining the issues and survey data from area communities. Background The matter of park hours was previously presented at the May 2015 Parks and Recreation Advisory Committee meeting. At that time the Committee recommended an amendment to Chapter 95, Section 95.04 regulating park hours to allow earlier park access. The suggested revision was motivated primarily due to persons entering or utilizing the park to walk or exercise their family pets prior to the 7:00 a.m. park hour restriction. City Council has asked the Parks and Recreation Advisory Committee to revisit their review of Chapter 95, Section 95.04 Regulating Park Hours and recommend any additional changes needed to address the evolution of park users as a whole. The original ordinance was written for the most part in the early 1980s when Apple Valley was a bedroom community with little late night traffic. The community has evolved significantly since then and is now home to many young professionals who keep varied work schedules. They want access to recreational areas during non-traditional hours. The questions is how do we accommodate them and yet advocate public safety. Several area communities were asked to provide their park hours for reference. All surveyed cities have a similar ordinance that closes the parks overnight. A couple of the cities have a central park with special hours. Minneapolis has the in -transit provision that allows travel through the parks at all hours. Staff is seeking a recommendation from the Parks and Recreation Advisory Committee to take to City Council. Note: Some older park signs still have previous language of Sunrise to 10:00 pm creating some confusion for early morning users. 8/24/2016 Other City Park Hours • Eagan: Open 5:00 am to 11:00 pm • Burnsville: Open 5:00 am to 10:00 pm o Nlcollet Commons Park Open 5:00 am to 12:00 am • Lakeville: Open 6:00 am to 10:00 pm • Rosemount: Open 6:00 am to 10:00 pm Erickson Park Open 6:00 am to 11:00 pm • Farmington: Open 7:00 am to 11:00 pm • Minneapolis: Open 6:00 am to 10:00 pm (unlit areas) o Open 6.00 am to 12:00 am areas with lights and pathways o Allows undeloyed travel through parks on lighted paths at other hours • St. Paul: Open Daylight to 11:00 pm • Bloomington: Open 30 Minutes Before Sunrise to 10:00 pm • Eden Prairie: Open 6:00 am to 10:00 pm • Edina: Open 6:00 am to 12:00 am • Minnetonka: Open 5:00 am to 10:00 pm o lighted fields open 20 minutes after end of scheduled game • Woodbury: Open 6:00 am to 10:00 pm a Historical Context • Existing ordinance written at a time when the City was a bedroom community and there was a sense that nothing good would be happening in a park after 10:00 pm. • Early morning activity or use of the park space wasn't as common. • Parks were generally in residential areas and didn't abut commercial properties with later hours of operation d 2 8/24/2016 Rationale for Night-time Closure: Issues for Neighbors • Many parks abut residential properties that could be bothered by noise or light generated in the park (particularly when park parking lots and vehicles are involved) • Some neighborhoods are very sensitive to activity in bordering parks and actively call in violations • Want to discourage undesirable behaviors like public drinking, indecent activity, encampment, or holding late -night parties Rationale for Night-time Closure Issues for Park Users • There are public safety concerns over having people in parks after dark • Parks could become targets for criminals to target unsuspecting park users for assault or robbery • Parks are generally not well lit and the natural terrain offers a wide variety of trip and fall hazards • Low visibility can create surprise and possibly problematic encounters with pets being walked 8/24/2016 Changing Circumstances • Our community has grown significantly with parks very near commercial areas and social norms and behaviors are also changing. • Increased focus on health and wellness has encouraged people to exercise when they have free time, even if it is after dark. • Changes in school enrollment and transportation policies mean more children using paths to get to school bus stops in early morning. • Virtual reality of mobile applications changes how a public space is "used" • New Demands to Use Parks Outside of Current Park Hours • People exercise / walk pets before work in morning • More people using pedestrian / bike pathways as transportation corridors and need to travel outside of the park hours to go to work or school • More clubs / organizations using parks for group activities (exercise groups, churches), some at non- traditional hours • Emerging non-traditional uses like Pokemon Go where users may not be interested in park amenities and expect 24x7 access 4 8/24/2016 Policy Challenges • We need to enforce our ordinances consistently • Residential property owners abutting parks have established expectations of peace and quiet in the parks after 10:00 pm • People looking to use parks outside of existing hours in non-traditional ways will likely be unhappy with ordinance and enforcement efforts Policy Options / Questions • Is a change to the general hours of operation in some or all parks to accommodate emerging non- traditional park use demands necessary? • If a general change is appropriate, what new hours of operation are desirable for what parks? • Should all of the parks have the same hours or operation or should some form of categorization with different hours be implemented? • Is an " in transit" provision used by Minneapolis an appropriate exception to allow undelayed night- time travel through parks? 5 8/24/2016 Minneapolis • General Park Hours • 6 a.m. - midnight )in developed park areas) 6 a.m. - 10 p.m. (in undeveloped park areas) • PARK HOURS are established by Ordinance PB2-33: (a) Except as otherwise provided in the Code, no person shall be In )b) No person shall be in or remain in any undeveloped portion of any park between the hours of 10:00 p.m. and 6:00 a.m. on the following morning unless taking part in an activity conducted by, or pursuant to a permit issued by, the park board. Staff is seeking Committee recommendation as to whether the park hours should remain as presently posted or the draft amendment should proceed to Council. Background Proposed amendment language for the park hours in the City ordinance has been developed (see attached). This revision was motivated primarily due to persons who enter or utilize a park prior to the 7:00 a.m. park hour restriction. These people may be walkers or people who walk their pet. By ordinance, these people would currently be considered violators and could be cited for an ordinance violation.
