Minutes of the meeting of the City Council, City of Apple Valley, Dakota County,
Minnesota, held February 25, 1974.
PRESENT: Mayor Largen; Councilmen Branning, Garrison, and Goodoien; Clerk Asleson.
ABSENT: None.
The Mayor called the meeting to order at 7:30 p.m. All residents attending took
part in the pledge of allegiance to the flag. Mayor Largen gave the invocation.
MOTION: of Garrison, seconded by Goodoien, to approve the minutes of the meeting
of February 11, 1974, as amended. Ayes - 4 - Nays - 0.
MOTION: of Garrison, seconded by Branning, to set a special Council meeting for
Monday, March 4, 1974, at 7:00 p.m. Ayes - 4 - Nays - 0.
January Police Report - Received.
Liquor Store Report for 1973 - Received.
February 8, 1974, Gross Payroll Report - Received.
December and January Building Reports - Received.
January Utilities Report - Received.
Cash Financial Statement for 1973 - Received.
Planning Commission Minutes of January 16 and 31, 1974 - Received.
MOTION: of Garrison, seconded by Goodoien, directing the Clerk to send a letter
to Metro Cable and the FCC giving the necessary information and clarifi-
cation requested in Metro Cable's letter of February 4, 1974, and to
request a construction schedule report from Metro Cable in 90 days.

The Mayor introduced Robert Millar of Abbott-Northwestern Hospitals and Raymond
Seaver of Metropolitan Medical Center to discuss the facilities they represent.
They said they would return another time and discuss further plans in Apple Valley
when they have more details.
MOTION: of Garrison, seconded by Goodoien, to pass Resolution No. 1974-18 order-
ing improvement Project 72-29, Valley South. Ayes - 4 - Nays - 0.
MOTION: of Goodoien, seconded by Branning, to pass Resolution No. 1974-19 order-
ing improvement Project 73-53, Valley Commercial Park 2nd Addition streets.
Ayes - 4- Nays - 0.
MOTION: of Goodoien, seconded by Garrison, to pass Resolution No. 1974-20 direct-
ing preparation of plans and specifications by the Engineer for Project

Greenleaf 6th Addition Agreement was tabled.'

7th and 8th Additions subject to Subdivision Agreements on each. Ayes - 4

MOTION: of Garrison, seconded by Branning, to pass Resolution No. 1974-21 direct-
ing preparation of plans and specification by the Engineer for utilities
in Greenleaf 7th and 8th Additions. Ayes - 4 - Nays - O.
MOTION: of Garrison, seconded by Branning, to adopt Ordinance No. 140 rezoning
the area known as Palomino Lakeside Meadows including the golf course area
from Agriculture to M-1 Planned Development. Ayes - 4 - Nays - 0.
MOTION: of Garrison, seconded by Branning, to approve the Phase II Agreement on
Palomino Lakeside Meadows with Palomino Development Corporation and author-
ize the Mayor and Clerk to sign it. Ayes - 4 - Nays - 0.
MOTION: of Garrison, seconded by Goodoien, to pass Resolution No. 1974-22 awarding
Project 72-30, sewer and water extensions in Palomino Lakeside Meadows
Phases II and III, to the low bidder, Hood, Inc., in the amount of
$139,535.35. Ayes - 4 - Nays - 0.
Don Rippel presented drawings for tentative plans for the golf course. He explained
the grading clearing and drainage plans and showed drawings with the details of each
green. A tentative time table for construction would be March 6th bid advertisement,
April 2nd bid opening with construction beginning around May 1st and completion in
July of 1975. The Council decided to begin with a driving range of i0 to 15 stations
to avoid clearing more trees now.
MOTION: of Goodoien, seconded by Garrison, to purchase a projector with zoom lens
and slide caddy, a roll down wall screen and name and date display for
map and plan retrieval system. Ayes - 4 - Nays - 0.
MOTION: of Goodoien, seconded by Garrison, to approve the 1974 licenses and per-
mits on which the applications are complete according to the attached list.
Ayes - 4 - Nays - 0.
Gene Peterson presented concept plans for Tenold Development in the area of Cedar
Avenue and County Road 38 showing one plan with apartments and townhouses and another
with all apartments. A meeting will be held with representatives of Tenold, Apple
Valley and Dakota County to discuss that intersection when the status of a bill in
the Legislature on roads is known.
MOTION: of Garrison, seconded by Goodoien, to approve a building permit for a
clubhouse on the Watrud Golf Course. Ayes - 4 - Nays - 0.
The Lemon Tree Restaurant building permit and Eagan Comprehensive Plan were tabled.
MOTION: of Largen, seconded by Branning, to pass Resolution No. 1974-23 supporting
construction of Cedar Avenue from 35E to the Zoo entrance by the State
of Minnesota. Ayes - 4 - Nays - 0.

Jerry Bell presented a proposal for a pathway along the west side of Galaxie Avenue
from 140th to 132nd Streets and along the east side of Galaxie Avenue from 135th to
133rd Streets to the new Greenleaf School. He was asked to check into obtaining
State funds for the pathway and determining whether the School planned to continue
a sidewalk on its property.
MOTION: of Branning, seconded by Goodoien, to pass Resolution No. 1974-24 award-
ing the purchase of water meter conversion units to the low bidder, Power
Process Equipment, in the amount of $13,834.00. Ayes - 4 - Nays - 0.
MOTION: of Goodoien, seconded by Branning, to pass Resolution No. 1974-25 award-
ing the workmen's compensation insurance to Brandt Agencies, Inc., the
low bidder, in the amount of a net premium of $6,844.00. Ayes - 4 -
Nays - 0.
MOTION: of Garrison, seconded by Branning, to adopt Ordinance No. 141 the revised
City Personnel Ordinance with the addition of the words "if physically
albe" in Section 20.6. Ayes - 4 - Nays - 0.
MOTION: of Goodoien, seocnded by .Garrison, to approve the Dakota Law Enforcement
Association Agreement and authorize the Mayor and Clerk to sign it.
Ayes - 4 - Nays - 0.
MOTION: of Goodoien, seconded by Largen, to advertise for full and part time public
safety dispatching help to determine the interest in it if a program is
developed. Ayes - 4 - Nays - 0.
MOTION: of Goodoien, seconded by Garrison, to table the proposal for a trophy
case for the Westview Community Building. Ayes - 4 - Nays - 0.
MOTION: of Garrison, seconded by Goodoien, to approve the Agreement with Urban
Planning & Design, Inc., for professional services effective March 1st,
1974, and authorize the Mayor and Clerk to sign it. Ayes - 4 - Nays - 0.
MOTION: of Branning, seconded by Goodoien, to release the $6,600.00 performance
bond in full for sidewalk on Ellice Trail and boulevards on Ellice Trail
and Exley Court in Lapaz Addition. Ayes - 4 - Nays - O.
MOTION: of Branning, seconded by Largen, to appoint Mr. P. D. Cozine to fill the
vacancy on the Council effective March l, 1974. Ayes - 3 - Nays - 0
(Garrison abstained).
MOTION: of Branning, seconded by Garrison, to adopt Ordinance No. 142 reestablish-
ing the City Planning Commission and expanding it to 9 members. Ayes - 4-
Nays - O.
MOTION: of Garrison, seconded by Branning, to pass Resolution No. 1974-26 making
appointments to the Planning Con~nission pursuant to Ordinance No. 142.
Ayes - 4 - Nays - 0.
MOTION: of Branning, seconded by Garrison, to pay the claims and bills, checks
numbered 8511 through 8567, in the total amount of $39,675.44. Ayes - 4
Nays - 0.
