Minutes of the meeting of the City Council, City of Apple Valley, Dakota County,
Minnesota, held March 25,1974.
PRESENT: Mayor Largen; Councilmen Branning, Cozine, Garrison and Goodoien; and
Clerk Asleson.
ABSENT: None.
The Mayor called the meeting to order at 7:30 o'clock p.m. Ail residents attend-
ing took part in the pledge of allegiance to the flag. Councilman Garrison gave
the invocation.
MOTION: of Branning, seconded by Goodoien, to approve the minutes of the MARCH 4TH
meeting of March 4, 1974, as written. Ayes - 4 - Nays - 0. MINUTES
(Largen abstained).
MOTION: of Goodoien, seconded by Cozine, to approve the minutes of the MARCH llTH
meeting of March I1, 1974, as written. Ayes - 4 - Nays - 0. MINUTES
(Garrison abstained).
MOTION: of Garrison, seconded by Goodoien, to approve a mobile home per- PAYETTE
mit for Mr. & Mrs. John Payette at 12050 Cedar Avenue for one MOBILE HOME
year with renewal subject to surrounding road status. Ayes - 5 PERMIT
Nays - 0.
Kubista building permit was tabled since County would be meeting to discuss
this subject March 26, 1974.
MOTION: of Goodoien, seconded by Branning, to adopt Ordinance No. 143 ORDINANCE 143
rezoning the Shakopee Sand & Gravel property at 140th Street and SHAKOPEE
Fairgreen in accordance with the contract dated April 25, 1973. REZONING
Ayes - 5 - Nays - 0.
Macro Planned Development was tabled.
MOTION: of Garrison, seconded by Cozine, to approve the preliminary plat TRACT Q
for Tract Q subject to walkway dedication, excavation boundaries PRELIMINARY
being set by Engineer and Inspector, covenants, 20-foot setbacks PLAT
on the front and development agreement. Ayes - 5 - Nays - 0.
MOTION: of Goodoien, seconded by Cozine, to grant a conditional use per- STANDARD OIL

Public Hearing - 8:00 o'clock p.m. - Project 74-58 - Wildwood Utilities. The
Mayor called the hearing to order. The Engineer showed the location for the
proposed utilities on the map and commented on the development. They are pro-
posing 76 townhouses and the developer would be installing storm sewer with the
street installation. The Mayor asked for questions or comments from the public
and the Council, there being none, the hearing was closed at 8:05 p.m.

MOTION: of Garrison, seconded by Branning, to approve the Development WILDWOOD
Agreement for Wildwood Phase II of Stage I with the wording, "by DEVELOPMENT
assessment to Developer," in lieu of a bond amount and authorize AGREEMENT

MOTION: of Garrison, seconded by Branning, to adopt Resolution No. 1974- PUBLIC
38 setting a public hearing for April 22, 1974, on road improve- HEARING
ments for Fairgreen Avenue from the north edge of Greenleaf to ROAD
County Road 42, the service drive at Cedar and County Road 42 IMPROVEMENTS
and 140th Street from Cedar to Garden View.
MOTION: of Goodoien, seconded by Branning, amending the previous motion
by adding 140th street from Pilot Knob Road to Garden View, inclu-
sive. Those in favor Branning and Goodoien. Those opposed Largen,
Cozine and Garrison. (Motion Failed)
Councilman Branning then withdrew his second and the original mo-
tion of Garrison was seconded by Cozine. Those in favor Largen,
Cozine and Garrison. Those opposed Branning and Goodoien.
(Motion Carried)
MOTION: of Garrison, seconded by Goodoien, to recommend plan number 1 of ZOO ENTRANCE
the Zoo Entrance Concept with County Road 38 shifted slightly CONCEPT PLAN
north from its closest point to Greenleaf 5th Addition and dir-
ected the Engineer and Planner to draw a more exact alignment
for the road for review. Ayes - 5 - Nays - 0.
MOTION: of Goodoien, seconded by Cozine, to grant a variance to Richard
J. Lee at 344 Walnut Lane for a garage of 21 feet instead of 30
feet from theside lot line, subject to concurrence of the neigh-
bors. Ayes - 5 - Nays - 0.

the low quote of that company and increase the number printed to

Councilman Garrison commented that the Council will be approving an on-sale liquor
license for William N. Baden of Apple Development, Inc., for a bowling alley-
restaurant after working out certain terms and conditions with the Attorney. The
application fees of the other three applicants will be refunded except for $150.00
each.
MOTION: of Goodoien, seconded by Branning, to issue licenses for three
more cabs to the Savage Cab Company. Ayes - 5 - Nays - 0.

PURCHASE
MOTION: of Cozine, seconded by Goodoien, to authorize the purchase of a
transport of gasoline from Jerry Zimmer at approximately 55¢ per
gallon, it being noted that no bids were received for supplying
transport quantities at the last advertisement and the City is
waiting for a determination from the Federal Energy Office on de-
signation of a supplier. Ayes - 5 - Nays - 0.

Jerry Bell commented that a meeting on plans for Faith Park was held with the
residents last year and now that the plans are in a more definite form, he would
like to have another meeting with the residents on Wednesday, April 17, 1974.
MOTION: of Goodoien, seconded by Cozine, to pay the Claims and bills,
checks numbered 8682 through 8746, in the amount of $187,838.45.
