PRESENT: Councilmen Branning, Cozine, Garrison and Goodoien; Clerk Asleson. ABSENT: Mayor Largen Acting Mayor Garrison called the meeting to order at 7:30 p.m. All residents attending took part in the pledge of allegiance to the flag. Acting Mayor Garrison gave the invocation. MOTION: of Goodoien, seconded by Cozine, to approve the minutes of the meet- ing of April 8th, 1974, as written. Ayes - 3 - Nays - 0 (Branning abstained). APRIL 8TH MINUTES RES. 74-55 STATE HWY DEPT TECH. ASST. MOTION: of Branning, seconded by Goodoien, to adopt Resolution No. 1974- 55 approving technical assistance from the State Highway Dept. on State Aid Streets. Ayes - 4 - Nays - O. MOTION: of Cozine, seconded by Branning, to adopt Resolution No. 1974-56 adjusting assessments on 0utlot 2, Palomino Hills Addition. Ayes - 4 - Nays - O. MOTION: of Cozine, seconded by Goodoien, to adopt Resolution 1974-57 proclaiming the week of May 19th to 25th, 1974, as National Public Works Week. Ayes - 4 - Nays - 0. RES.- 74-56 ASSESSMENT ADJUSTMENT RES. 74-57 NATJ PUBLIC WORKS WEEK Pennock Lane right-of-way acquisition was held until the Church Board of Grace Lutheran Church could review it; Councilman Branning will review it with them. MOTION: of Goodoien, seconded by Cozine, to adopt Resolution No. 1974-58 giving preliminary approval of the terms and conditions of the liquor license application by Apple Development, Inc. Ayes - 4 - Nays - O. RES. 74-58 LIQUOR LIC. APPLICATION The Clerk was directed to draft a resolution refunding a portion of the liquor license application fee to the rejected applicants and submit it to the Council in two weeks. March 25, 1974, State Aid Street Report was received and reviewed. Robert Rosene gave a brief review of the background of the State Aid program in Minnesota and how it is apportioned. Public Hearing - Project 72-21 - Fairgreen Avenue from County Road 42 north for two miles. Acting Mayor Garrison called the public hearing to order at 8:05 p.m. The affidavit of publication was noted. (For details of hearing, see attachment). After everyone was given a chance to be heard and there were no further questions or comments, the hearing was declared closed at 9:10 p.m. Public Hearing - Project 74-61 - 140th Street, Cedar Avenue to Garden View Drive. Acting Mayor Garrison called the public hearing to order at 9:25 p.m. The affidavit of publication was noted. (For details of hearing, see attachment.) After everyone was given a chance to be heard and there were not furher questions or comments, the hearing wac declared closed at 9:50 p.m. CITY OFAPPLE VALLEY Dakota County, Minnesota April 29, 1974 Page 2 Public Hearing - Project 74-62 - Service Drive northwest of Cedar Avenue and County Road 42. Acting Mayor Garrison called the hearing to order at 9:50 p.m. The affidavit of publication was noted. (For details of hearing, see attachment). After everyonewas given a chance to be heard and there were no further questions and comments, the hearing was declared closed at l0:07 p.m. Memo on the Greenleaf Elementary School assessments was received. Councilman Branning commented on the ice facilities proposal for the new high school and City participation with the School District. Councilman Garrison commented that no commitment by the City should be made until an election is held. Jerry Bell was directed to have James Olsen of Juran & Moody prepare figures on this proposal before the election question is considered. MOTION: of Cozine, seconded by Goodoien, to authorize the engineer to prepare CEDAR KNOLLS plans and specifications for utilities for 32 mobile home lots in UTILITIES Cedar Knolls. Ayes - 4 - Nays - O. MOTION: of Goodoien, seconded by Branning, directing staff to negotiate option J FIRE HALL on minimum of two acres of land at the northeast corner of County Road LAND 42 and Hayes Road to be purchased with Revenue Sharing Funds for a Fire Hall. Ayes - 4 - Nays - O. MOTION: of Goodolen, seconded by Branning, authorizing the staff to contact FIRE the manufacturer of the demonstrator aerial pumper truck which is now TRUCK available to see if they will hold it for the City; to have the Attorney determine if a conditional sales contract could be used to secure pur- chase; and authorize advertisement for bids for the truck if the Attorney determines bids are necessary. Ayes - 4 - Nays - O. The clerk was directed to prepare a proposal for a bond issue election for the Fire Hall building and the truck. Report on Faith Park was tabled because increased costs have caused a revision of the plans. Several residents of that area in attendance did comment on the park. MOTION: of Garrison, seconded by Cozine, authorizing the expenditure of up to $250.00 for a trophy case to be installed in the Westview Community Building on the condition that should the V.A.A. at some future date remove the case, they reimburse the City. Ayes - 2 - Nays - 2 (Goodoien and Branning) MOTION FAILED. WESTVIEW TROPHY CASE MOTION: of Goodoien, seconded by Branning to bring up the subject of a trophy cage for Westview at the next meeting. Ayes .- 4 - Nays - O. MOTION of Cozine, seconded by Branning, authorizing the expenditure of up to $100.00 for a summer program for the mentally handicapped under the · supervision of Judy Denham with an assistant to be hired and volun- teers from the area to help her. Ayes - 4 - Nays - O. SUMMER PROGRAM FOR HANDICAPPED CITY OFAPPLEVALLEY Dakota County, Minnesota April 29, 1974 Page 3 MOTION: of Cozine, seconded by Goodoien, to temporarily deny an excavation permit to Palomino Development Corporation for Palomino Lakeside Estates (Tract Q) until a development agreement is signed. Ayes - 4 - Nays - O. TRACT Q EXCAVATION PERMIT BLDG. PERMIT BARTH MOTION: of Cozine, seconded by Goodoien, to approve the issuance of a building permit to Duane Barth for Lot 18, Block 3 of Palomino Hills 4th Addition. Ayes - 4 - Nays - O. Application by Zoo for sign permits was tabled until Planning Commission has reviewed the proposal. Planning Commission comments on capital improvements - received. Planning Commission minutes of March 21, 1974 - received. First Quarter Treasurer's Report- received. March Water and Park Reports - received. April 19, 1974, Gross Payroll Report - received Consideration of Golf Course Superintendent applicants - tabled. MOTION: of Cozine, seconded by Branning, to approve hiring the following people: Daniel Kroyer, Parkkeeper I, $687.00 per month, begin May 1, 1974; Orville Netland, Utilities L, $721.00 per month, begin May 15, 1974; JoAnn Hughes, Clerk-Typist I, $402.00 per month, begin May 1, 1974; Linda Wagner, Secretary (part time), SS.lO per hour, begin May 6, 1974; and Merlyn Olson, Custodian I, $654.00 per month, begin approximately June 1. Ayes - 4 - Nays - O. PERS0NNEL HIRINGS MOTION: of Cozine, seconded by Branning, to adopt Resolution No. 1974-59 releasing $100,000 of collateral at the First State Bank of Rosemount. Ayes - 4 - Nays - O. RES. 74-59 BANK COLLATERA MOTION: of Cozine, seconded by Branning, to adopt Resolution No. 1974-60 designatimg the First State Bank of Apple Valley as the official City depository, subject to the bank providing deposit collateral and having checks printed. Ayes - 4 - Nays - O. RES. 74-60 BANK DESIGNATION MOTION: of Cozine, seconded by Goodoien, to adopt Resolution No. 1974-61 authorizing temporary transfer of debt retirement funds. Ayes - 4 Nays - O. RED. 74-61 DEBT FONDS TRANSF~ Councilman Garrison suggested the Golf Course Committee be invited to the golf course groundbreaking ceremonies on May 13th, 1974, at 6:00 p.m. MOTION: of Branning, seconded by Cozine, authorizing Jerry Bell to recruit a supervisor for the summer recreation program at $5.00 per hour. Ayes - 4 - Nays - O. RECREATI ON PROGPAM SUPVR. The Clerk was directed to inform Cottle-Herman, by letter, that the term of their assessments for Pennock Avenue would be 20 years. CITY OF APPLEVALLEY Dakota County, Minnesota April 29, 1974 Page 4 MOTION: of Branning, seconded by Cozine, to authorize proceeding with rough grading of 145th Street to Hayes Road subject to receipt of petitions from the property owners accepting assessments for it and waiving a public hearing. Ayes - 4 - Nays - O. MOTION: of Goodoien, seconded by Cozine, authorizing the advertisement of bids for the purchase of up to two police cars, bids to be received May 13, 1974, at 2:00 p.m. 'Ayes - 4 - Nays -0. MOTION: of Goodoien, seconded by Cozine, to pay the claims and bills, checks numbered 8905 through 91B5, in the amount of $644,185.65. Ayes - 4 - Nays - O. The meeting adjourned at 11:50 o'clock p.m. ROUGH GRADING CITY OF APPLE VALLEY Dakota County, Minnesota April 29, 1974 Detail of Public Hearing on Project 72-21 - Fairgreen Avenue. Robert Rosene gave the details on the proposed improvement and said it was planned to be done in two phases. Initially, Fairgreen would be constructed as a seven-ton street with two lanes and later, upgraded to a nine-ton street. He gave the estimated costs and the amount proposed to be assessed. Phase II is proposed to be constructed with State Aid Funds in the future and not assessed. Acting Mayor Garrison called for com- ments from the public. Ray Natko, 13644 Findlay Avenue, asked who would be assessed, and is a road of this width really necessary in this location. It was answered that a collector street is necessary to move traffic from this neighborhood. Glen Gilmore read a letter from the Lapaz Addition residents and questioned the assessment policies on a collector street. Gary Peterson, 6021 134th Street, asked how far the street would be from his house. It was estimated at about 65 feet from his house. Mike McNamara of McNamara-Vivant Contracting, asked about truck usage of Fairgreen and expressed his concern for the need for more east-west roads. John Hopkins of North Star Concrete said he would rather see County Road 42 upgraded and doesn't see the need for Fairgreen con- aidering the proximity of Pilot Knob Road and Galaxie Avenue. Don Andrusick, 13294 Ellice Court, asked about filling a pothole by Ellice Trail at the time Fairgreen is constructed and also expressed his concern that Fairgreen would be used heavily by trucks. Steve Larson asked about timing and asked when Pilot Knob and Galazie would be completed, and "go somewhere". Bonnie Andrusick said she was also opposed to being assessed for ~a road that goes nowhere and the truck traffic it might carry. Gordon Benson, 13293 Ellice Court, asked when the road would be constructed. He was told it was planned to be con- structed this summer and the assessments would be levied this fall. He also asked why it could not be constructed as only a residential street. Gene McCracken asked when other roads will be built to connect to major highways. Sandra Gilbert asked if another public hearing would be held before Phase II is constructed. Yes, there would be and notice would be sent. Detail of Public Hearing on Project 74-61 - 140th Street. Robert Rosene explained the layout and cost estimates and portions Of the street assessable for Phase I. Patrick Calistro stated he will definitely not donate right-of-way for this street and he also asked what this trunk storm sewer assessment would be. Ne was told that it is based on 1.5 cents per square foot. He also asked what would happen to his fences and was told his property would be restored if anything had to be moved for the street construction. He was also asked if he was eligible for Green Acres exemption from assess- and if he had applied. He said he had received the forms but had not yet mailed in the forms. Attorney McMenomy commented that April 30th was the last day to file for Green Acres for 1975 taxes. Mrs. Calistro stated she felt it was unfair to ask people to assume the financial burden in donating land for the street rights-of-way. Peter Russell asked if he would be assessed for 140th Street. No, his property does not abut the street. Dick Cottle asked when this construction would be done. He was told it is planned for this summer and would be assessed this fall. Detail of Public Hearing on Project 74-62 - County Road 42 Service Drive Robert Rosene showed the location for the proposed service drive on the map and gave the estimated costs. Councilman Branning asked whether the storm sewer culverts could also be put in at the same time. He was told the County has a policy of not psrticiparing in trunk storm sewer and culverts alone, would not be deep enough. John Natwick commented on previous discussions the Town Board had with the county on storm sewer for this area and also asked what his assessments would Do.
