Minutes of a meeting of the City Council, City of Apple Valley, Dakota County,
Minnesota, held May 13, 1974.
PRESENT: Mayor Largen; Councilmen Branning, Cozine and Garrison; Clerk Asleson.
ABSENT: Councilman Goodoien.
The Mayor called the meeting to order at 7:3O p.m. All residents attending took
part in the pledge of allegiance to the flag. Mayor Largen gave the invocation.
The Board of Review meeting of May 7, 1974, was continued until 7:30 p.m. on May 13,
1974. The Mayor turned the meeting over to Councilman Branning for the Board of
Review continuation. He asked whether there were any adjustments to be made to the
records. Gordon Daggett of the Dakota County Assessor's office was present and said
there were none.
MOTION: of Cozine, Seconded by Garrison, to close the Board of Review BOARD OF
meeting and approve the valuations as written. Ayes - 4- REVIEW

MOTION: of Cozine, seconded by Garrison, to adopt Resolution No. 1974-62 RES. 1974-62
designating as State Aid street 140th Street from Cedar Avenue STATE AID

ordering the installation of a stop sign at the intersection of

Building permit request for First Federal Savings & Loan was discussed. Staff was
asked to review the location and landscaping and make a recoEmendation at the next
meeting. They were also asked to check the Cedar Avenue right-of-way with the
County.
MOTION: of Garrison, seconded by Branning, to adopt Resolution No. 1974-67
ordering the road improvements projects for Fairgreen Avenue, north
from County Road 42 for two miles; 140th Street, from Cedar Avenue
to Garden View Drive; and the Service Drive On the northwest corner
of Cedar Avenue and County Road 42. Ayes - 4 - Nays - 0.

ordering preparation of plans and specifications for the above
road improvements including a straight alignment of Fairgreen

MOTION: of Branning, seconded by Garrison, ordering the preparation of a
preliminary report for storm sewer improvements on the northwest
corner of Cedar Avenue and County Road 42. Ayes 4- Nays - O.
MOTION: of Branning, seconded by Garrison, directing the Engineer and
Attorney to begin easement negotiations for the road right-of-
ways, as referred to above. Ayes - 4 - Nays - O.
STORM SEWER
PRELIM. REPORT
Routing of the State Road to the Zoological Gardens was tabled until further discussions
have been held with the State and County Highway Department.
Jerry Bell spoke of the problems in finding someone to take the wood from the golf
course site and also the problems in obtaining a burning permit. He will be receiving
further information from the Pollution Control Agency and will report back in two weeks.
MOTION: of Branning, no second, to approve the 1974 licenses and permits as LICENSES &
listed except the Nordic Square excavation permit. Motion Failed PERMITS
MOTION of Garrison, seconded by Cozine, to approve the 1974 licenses end
permits as listed. Ayes - 3 - Nays - 1 (Branning)
A presentation of the Apple Valley Square shopping center was given by H. W. Fridlund
Architects. It is proposed to be built on the 40 acres southwest of Cedar Avenue and
County Road 42. John Voss commented on the Planning Commission's recommendation.
Residents of Jonathan, Fireside, Haralson and McIntosh Drives presented a petition
opposing the construction of a shopping center entrance on Pennock between Jonathan
and Fireside Drives because of the traffic it will create.
MOTION: of Branning, seconded by Largen, to indicate that the City Council
intends to issue a building permit for the Apple Valley Square
shopping center after the Attorney has drawn all details together in

agreement form based on the information presented by the Applicant
plus the addition of an exhibit showing the fence. Ayes - 4 - Nays - O.
Councilmen Garrison and Cozine, however, went on record as being oPPosed to the
shopping center entrance on Pennock Lane. .
A letter regarding traffic flow on 35W was received from Wayne M. Wagner, an
Apple Valley resident The Clerk was directed to answer the letter and forward
a copy to the State Highway Department and the Governor's Office.
Preliminary information of the Five-Year Plan was received.
The April Park Report was received. The Park Director was asked to check into tree
replacement at some of the perks and he will report at the next meeting.
The Gross Payroll Report of May 3, 1974, was received.
Special election considerations on public safety equipment and improvements were
received.
MOTION: of Garrison, Seconded by Cozine, authorizing the painting Of the
water tower on Redwood Drive by Brown Minneapolis in the amount of
$3,850.00. Ayes - 4 - Nays - O.

ary period salary adjustment for Thomas Ingram ($42.00 per month)
effective April 21, 1974, and the promotion of Debra Halbert to

Consideration of Police Dispatcher employees was tabled.
A claim for clothing damage from Mrs. Landais was tabled until an analysis of the
stain is received from a laboratory.
MOTION: of Gariaon, seconded by Cozine, to adopt Resolution No. 1974-69
refunding the amount of the liquor application fees in excess of
$150 to Apple Bowl, Inc., John Rezac and Zvi Liberman and setting
a public hearing on the application of Apple Development, Inc.
for May 28th, 1974. Ayes - 4 - Nays - O.

$3,835 for delivery in 90 days for the Police Department. Ayes

MOTION: of Garrison, seconded by Cozine, to authorize the expenditure of WESTVIEW
up to $265.00 for the construction of a trophy case in the West- TROPHY
view Community Building with the V.A.A. supplying the balance of CASE

Clerk Asleson noted that documents had been received from Dakota Electric Association
and Central Telephone Company outlining their requests for rate increases through the
Public Service Commission.
MOTION: of Branning, seconded by Garrison, directing the Clerk to write a LETTER TO

MOTION: of Cozine, seconded by Garrison, to direct the Planning Commission
to review the Comprehensive Plan in relation to neighborhood
centers, open space and commercial zoning, especially B-6 and
where it should be, compare it to what changes have happened
since the Plan was approved ans suggest any supplemental changes
that might beed to be made. Ayes ~ 4- Nays - O.
