Minutes of the special Council meeting of the City of Apple Valley Dakota
County Minnesota held on May 25th 1974 at l0:00 o'clock a.m.
PRESENT: Mayor Largen; Councilmen Branning, Cozine, Goodoien and Garrison;
Clerk Asleson and representatives from the Apple Valley Merchants
Association and a representative from the Dakota County Tribune.
ABSENT: None.
Mayor Largen called the meeting to order at lO:O0 o'clock a.m.
MOTION: of Garrison seconded by Branning, to authorize a dance DANCE PERMIT
permit to be issued to the Apple Valley Merchants Associa- FOR MERCHANTS
tion pursuant to the terms of Resolution 1974~71, that the ASSOCIATION
permit fee be $5.00 it being construed that the purpose of
the Apple Valley Merchants Association is a nonprofit associa-
tion and that based on the statement of the Apple Valley
Merchants Association that the dance has liability insurance
coverage in the amount of $1,000,000 from Mr. Zvi Liberman.
Ayes - 5 - Nays - O.
MOTION: of Garrison seconded by Branning, to issue a dance permit
to the Beef 'N' Brew restaurant on 147th Street pursuant
to their application dated May 24th, 1974, that said permit
shall be good only on May 25th 1974 that the proprietors
of Beef 'N' Brew agree to have one City of Apple Valley
Police Officer present during the dance and to pay said
Police Officer for services rendered as an agent of the Beef
'N' Brew facility. Further, the City Clerk shall refer to the
City Attorney for a report at the Council meeting of May 28th
1974~ City of Apple Valley Ordinance No. 59 to determine if the
type of dances to be conducted at the Beef 'N' Brew restaurant
fall within the meaning of a public dance as defined in
Ordinance No. 59 and M.S.A. 624.42 through 624.54, particularly
as to the requirements of having an officer of the peace present
at every dance. Ayes - 5 - Nays - o.

The City Clerk then discussed with the Council that according to his reading
of the City Ordinance and the applicable State Statutes, the fact that in any
establishment where intoxicating liquors are sold the laws appear to forbid
dancing and prohibit the City Council from issuing dance permits. The Clerk
then indicated that he would request the Attorney to clarify this point as to
future applicability to Apple Valley since dances are commonly held in other
communities in establishments where intoxicating liquors are sold.
MOTION: of Branning, seconded by Garrison to adjourn. Ayes - 5 - Nays - O.
The meeting was adjourned at 10:20 o'clock a.m.
