Minutes of the meeting of the City Cotmcil of the City of Apple Valley, Dakota
County, Minnesota, held on May 28th, 1974 at 7:30 o'clock p.m.
PRESENT: Mayor Largen councilmen Cozine Garrison and Goodoien; Clerk Asieson.
ABSENT: Councilman Branning.
The Mayor Called the meeting to order at 7:30 p.m. All residents attending
took part in the pledge~ Of allegiance to the flag. Mayor Largen gave the
invocation.
MOTION: of Goodoien seconded by Cozine, to approve the minutes of APRIL 15TH
the meeting df April 15th, 1974~ as written. Ayes - 3 - MINUTEs
Nays - 0 (Garvison abstained).
MOTION: of Garrison, seconded by Goodoien, tO approve the minutes APRIL 29TH
of the meeting.of April 29th, 1974, as written. Ayes -3 -~ MINUTES
Nays - 0 (Largen abstained).
Minutes of the Board of Review Meeting of May 7th~ 1974~ were received.
MOTION. of Garrison, Seconded by Cozine to appove the minutes of MAY 13TH
the meeting of May 13th 1974 as written. Ayes - 3 - MINUTES
Nays - 0 (Goodoien abstained).'
MOTION: of Goodoien seconded by Garrison to give conceptual
approval for the rezoningof the Macro proposal at .Pilot
Knob Road and 140th .Street without mobile homes (M-1
Planned Development) with final approval subject to
negotiation of the staging plans and the Attorneys draft-
lng a development agreement. Ayes - 3 - Nay - 1 (Cozine).
MOTION of Goodoien, seconded by Cozine to approve variance of
five feet on the south side of the lot at 952 Beacon Lane
for a garage for Dennis Sandey.' Ayes - 4 - Nays - O.

A status report of Planning. Commission work on zoning ordinance revisions was
received.
Public. Hearing - 8:05 o'clock p.m. - On-Sale Liquor License Application. Mayor
Largen called the hearing to order at 8:05 p.m and read the notice of hearingJ
Clerk Asleson gave the location for the proposed bowling alley-restaurant by
Apple Development Inc. It would be nOrtheaSt of Cedar Avenue and County Road
42 (east of the Bank on Tract H). Mr. Bill Baden of Apple Development, Inc.,
briefly described the proposed facility and said plans call for an opening no
later than September lst, 1975. There being no further questions or comments
the hearing was declared Closed at 8:15 p.m.

Consideration of the building permit for Apple Valley Square was held for two
weeks until all of the plans are complete and staff has had time to review them.
Residents from the area west of Pennock Lane were present and voiced their concerns
about the project. They were asked to appoint a spokesman for their group who could
be notified of happenings on this project.
MOTION: of Garrison, seconded by Cozine, directing the Engineer to PRELIMINARY
prepare a preliminary r8port on the utilities for the Apple UTILITY REPORT
Valley Square area and include storm sewer at County Road 42. A.V. SQUARE
Ayes - 4 - Nays - O.
Discussion of the joint City-School ice facility was tabled.
MOTION: of Goodoien seconded by Largen, authorizing implementation
of 24-hour Police dispatching and hiring Roxy McCouch and
Patricia Rear as fulltime employees at $402.00 per month and
Penny Micklus and Marilyn Oist as parttime employees at $2.32
per hour. Ayes - 4 - Nays - 0.

MOTION: of Garrison seconded by Goodoien approving issuance of a
building permit for First Federal Savings & Loan of Hastings
on the northeast corner of County Road 42 and Cedar Avenue
subject to receipt of an easement for 20 feet along Cedar
Avenue. Ayes - 4 - Nays - O.
April Police Report was received.
April Treasurer's Cash Balance Report was received.
Supplementary staff report on golf course wood chipping was received.
Staff report on park trees was received. Staff was also directed to help the citizens
in the area of 142nd Street make arrangements for replacement of trees damaged by
vandals. Mr. Walter Carpenter of Minnesota Tree Service in Eden Prairie said they
would provide bare-root 1 1/2 inch trees for $35.00.
Memo from Dean Irons of the Planning Commission on review of the Comprehensive
Plan was received. Mr. Cozlne suggested the Planning Commission and staff work to-
gether on this review.
State Highway Department status report of May 16th, 1974, on 35E was received.
MOTION: of Garrison, seconded by Goodoien to approve renewal of a
transient merchant license for Jewel Home Service for one
year. Ayes - 4 - Nays - O.

MOTION: of Garrison seconded by Goodoien, to approve a transient
merchant license for door-to-door sales of farm produce by
George Mahowald. Ayes - 4 - Nays - O.
MOTION: of Cozine, seconded by Goodoien to amend the Greenleaf
Phase III agreement dated September 26 1973, regarding
Thompson's responsibility for roads by substituting the
attached paragraph for paragraph 18. Ayes - 4 - Nays - O.

MOTION: of Cozine, seconded by Goodoien, to approve the agree-
ment concerning payment for public improvements in Green-
leaf 6th Addition and Fhase III-and authorize the Mayor
and Clerk to sign the same subject to receipt of the bond
and to approve the transfer of $59,025 from Fund 599 to
Fund 605. Ayes ~- 4,- Nays - 0.
MOTION: of Garrison seconded by Cozine, to adopt Resolution No.
1974-72 summarizing all fulltime and parttime employees
and adopting a pay schedule for all of them. Ayes - 4 -
Nays - O.

Fast Draw Gun Club to perform in Apple Valley at Christus
Victor Church June 2nd and for the Apple Valley 4th of July

MOTION: of Goodoien seconded by Cozine to authorize hiring of
Jerome Solinger as a parttime stock clerk at the Liquor
Store at a starting salary of $2.00 per hour. Ayes - 4 -

MOTION: of Goodoien, seconded by Garrison, to approve rental of a
garage at the roller rink for one fire truck at $25.00
per month and to direct the Attorney to draft a rental
agreement and authorize the Mayor and Clerk to sign the
same. Ayes - 4 - Nays - O.
MOTION: of Garrison seconded by Cozine authorizing the con-
struction of a keg storage area of rough sawn Cedar
behind the Liquor Store for $495.00 by Leibfried Con-
struction. Ayes - 4 - Nays - O.
Clerk Asleson noted that Metro Cable has begun installation of underground cables
in the Greenleaf area and some citizens had expressed concern over the aboveground
junction boxes. Discussions have been held with Metro Cable and they are now
installing underground junction boxes also.
MOTION: of Garrison seconded by Cozine, to authorize the Mayor to
attend the U.S. Mayors Conference in San Diego June 22nd
through June 26th~ 1974. Ayes - 4 - Nays - O.

MOTION: of Cozine, seconded by Garrison, to authorize hiring of
Richard Ruckdashel as a parttime street maintenance em-
ployee for the summer at a salary of $2.50 per hour. Ayes
4 - Nays - O.
MOTION: of Garrison seconded by Cozine to extend the dance
permit for the Beef 'N' Brew restaurant until the 0rd- BEEF 'N' BREW
inance regulating dance permits has been reviewed and DANCE PERMIT
exempt the restaurant from the provision of havinga police
officer present unless a problem develops. Ayes - 4 - Nays -0.

MOTION: of Garrison seconded by Cozine to adopt Resolution No.
1974-73 accepting the resignation of Jerald R. Goodoien
from the City Council because he will be moving from Apple
Valley, effective June 15, 1974. Ayes - 3 - Nays ~ 0
(Goodolen abstained).
MOTION: of Goodoien seconded by Cozine, to adjourn. Ayes - 4
Nays ~ O.
