HomeMy WebLinkAbout06/10/1974CITY OF APPLE VALLEY Dakota County, Minnesota June 10, 1974 Minutes of the meeting of the City Council of the City of Apple Valley, Dakota County, Minnesota, held on June 10th, 1974 at 7:30 o'clock p.m. PRESENT: Councilmen Branning, Cozine Goodoien and Garrison (attended at 7:33 p.m.); Clerk Asleson. ABSENT: Mayor Largen. Councilman Goodoien Called the meeting to order at 7:31 p.m. attending took part in the pledge of allegiance to the flag. All residents MOTION: of Branning, seconded by Cozine, to appoint Councilman Goodoien as Acting Mayor for this meeting. Ayes - 3 ~ Nays - O. MOTION: of Branning seconded by Cozine to approve the minutes of the meeting of May 25th, 1974, as written. Ayes - 3 - Nays -0 APPOINT ACTING MAYOR MAY 25TH MINUTES Councilman Garrison arrived at this time. Councilman Branning opened the discussion on the proposed ice facility and listed the different methods of financing available. Jerry Bell commented on the facility and noted it would lose money. Mr. Wes Sorenson of Hammel, Green & Abrahamson, Inc., architects, commented on plans for the building and some possible uses other than hockey and skating. He said the School presently plans to build half a hockey facility. The total building with seating would cost about $900,000. Jerry Bell said an operation and maintenance agreement would be worked out between the School District and the City before construction. Councilman Branning als0 asked what other ice arenas this firm has designed and Mr. Sorenson said he would.provide the names and addresses Of the arenas for him. Mr. James Olsen of Juran & Moody, Inc. commented the financing and Said he felt the best type would be General Obligation Bonds or General Obligation Gross Revenue Bonds. MOTION: of Branning seconded by Cozine to authorize the staff to ICE ARENA proceed with preparation of the details for a bond issue DETAILS referendum for the ice arena on September 10th, 1974. Ayes - 4 - Nays - O. MOTION: of Cozine, seconded by Goodoien, to approve the minutes of MAY 28TH the meeting of May 28th, 1974, as written. Ayes - 3 r Nays MINUTES - 0 (Branning abstained). Mr. John Fritz 854 Jonathan Drive, represenbing the South Apple Valley Citizen's Committee, asked to be heard before a vote is taken on the Apple Valley Square Building permit. Garrison summarized the background of the shopping center proposal thus far for the residents in attendance. Mr. Fritz said his Committee does not oppose the shopping center as a whole but doesn't feel it coincides with the New Town concept and he referred tO the area at 98th and Normandale in Bloomington as an example of traffic problems with medians in the streets. He then read a petition from residents of the City expressing concerns over the traffic and holding pond, and especially the need for a two-lane internal perimeter road around the shopping CITY OF APPLE VALLEY Dakota County Minnesota June 10, 1974 Page 2 center. John Voss commented on Bloomington's experience with holding ponds and fences several years ago. Robert Rosene explained the engineering report for storm sewer showing drainage from the north side of County Road 42 and the shopping center proposal to the pond and the ponding concept in using storm water. He recommend the holding pond be sealed. MOTION: of Goodoien seconded by Cozine to adopt Resolution No. RES. 74-74.1 1974-74.1 setting a public hearing for Project 74-69 (storm PUBLIC HEARING sewer for southwest quadrant of Cedar-4.2) for July 8th, 1974PROJECT 74-69 at 8:00 o'clock p.m. Ayes - 4 - Nays - O. Robert Rosene presented two proposals for closing Jonathan and Fireside Drives from outside traffic for consideration. These were prepared at the request of Councilman Cozine who also said there may be some other alternatives for diverting traffic. MOTION: of Cozine seconded by Branning directing the staff STUDY OF Council and homeowners to meet and explore alternatives for TRAFFIC PROBLEM isolating the area adjacent to the proposed shopping center from traffic. Ayes - 4 - Nays - O. John Gretz read a letter from Norman Podas an engineer who researched questions on controlling lighting in the parking lot of the shopping center. His opinion is that both high and low lights can be controlled equally well but a review of the final specifications is recommended. MOTION: of Cozine, seconded by Goodoien to approve the development APPLE VALLEY agreement for Apple Valley Square in accordance with the SQUARE AGREE- Planning Commissions recommendation and including a review MENT AND of the entrance on Pennock when centerline medians are BUILDING PERMIT installed on 42 or Cedar: if alternatives on traffic in the residential area are considered in the future Apple Valley Square will be asked for some participation in the project to be agreed on then and a redwood fence, three to five feet in height shall be constructed on three sides of the pond concurrent with construction of.the shopping center and the Mayor and Clerk are authorized to sign the same. Also to approve a building permit subject to final plans and specifications for Apple Valley Square. Ayes - 4.- Nays - 0. MOTION: of Branning, seconded by Cozine, to adopt Resolution No. RES. 74-74.2 1974-74.2 transferring $10,000.00 of profits from Liquor TRANSFER Fund (701) to the General Fund (100). Ayes - 4 - Nays - O. MOTION: of Goodoien seconded by Cozine, to adopt Resolution No. 1974-75 granting an on-sale liquor license to Apple Devel- opment Inc. for a bowling alley-restaurant in the Apple Valley Commercial Addition if terms of said resolution are complied with. Ayes - 4 - Nays - O. APPLE DEV. ON-SALE LICENSE CITY OF APPLE VALLEY Dakota County, Minnesota June 10, 1974 Page 3 MOTION: of Garrison, no second, to adopt ResolutiOn No 1974 setting BEEF 'N' BREW a public hearing for consideration of an on-sale liquor LIQUOR APPLICATION license for the Beef 'N' Brew restaUrant subject to receipt of fees and liability bond before the hearing~ for June 24~ 1974. Motion failed. MOTION: of Cozine, Seconded by Goodolen, denying a Public hearing for -the on-sale liquor 'application for Beef 'N' Brew restaurant until all terms of Ordinance 135 are complied with. Ayes - 3 Nays - I (Garrison). MOTION: of Goodoien seconded by Branning to adopt Resolution No. 1974-76 designating planned Use of Revenue Sharing for the 5th Entitlement Period Allocation of $42,314.00 for public safety. Ayes - 4.- Nays - o. MOTION of Goodoien, seconded by Branning tO adopt Resolution No. 1974-77 concerning the proposed rate increase by Central Telephone Company in the State of Minnesota and Apple .Valley. Ayes - 4 - Nays - O. RES. 74-76 REVENUE SHARING RES. 74-77 CENTRAL TELE- PHONE RATES A status report On the location of a new Fire Hall site was received. Carrolls have retained Midwest Planning to prepare a concept plan for their property and a decision will be given in approximately 60 days on their property. Staff stated preparation of building plans for the Fire Hall would be basically the same whereever it is located and they would suggest an architect selection procedure at the next meeting. Request for a temporary mobile home permit on the King farm was tabled since petitioner was not present. MOTION: of Goodoien, seconded by Cozine, to accept the Planning REGIONAL SHOP- Commission's recommendation on the regional shgpping center PING CENTER proposal of the Robert Muir Cbmpany and direcb the staff to PROPOSAL ibegin preparation of the agreement for review at a joint Planning Commission-Council meeting June 27th, 1974, at 7:00 p..m. at City Hall. Ayes - 4 - Nays - O. MOTIO of Cozine seconded by Branning to grant a two and one-half VARIANCE AT foot side-yard variance for a garage ab 984 Oriole Drive for 984 ORIOLE DR. Ron Wolf. Ayes - 4 ~ Nays- O. May Park. Building and Water & Sewer Reports Were received. Metroplitan Cotuncil comments on Eagan's Land Use and Park Guides were received. Gross Payroll Reports of May 17th and 31st 1974, were received. A report on sanitary sewer service by the City of Eagan for the zoo area was received. The Administrator was directed to draft a letter to Eagan stating it would not be necessary for it to oversize sanitary sewer extensions to serve areas in Apple Valley other than those shown on Apple Valley's Master Sanitary Sewer Plan as draining into Eagan. CITY OF APPLE VALLEY Dakota County Minnesota June 10, 1974 Page 4 A report from the State of Minnesota on Apple Valley's municipal water supply was received. Minutes of the Planning Commission meetings of April 17th and May 1st 1974 were received. Transient merchant license application from Minneapolis Recreation Development was tabled until June 24th, 1974, and Councilman Garrison said he would draft letter to the Mayor and Council of Minneapolis on behalf of this group if they desired. Mr. Law said he did not believe it would-be desired. MOTION: of Cozine, seconded by Goodolen, to hire Curt Schmldt at SUMMER $1.90 per hour as a playground assistant and Robert Luse EMPLOYEES Joseph Schmidt and Steven Wehrenberg at $2.50 per hour for park and street maintenance for the summer. Ayes - 4 - Nays - O. MOTION: of Branning, seconded by Cozine, to adopt Resolution No. 1974-78RE8. 74-78 approving plans and specifications for street improvements in VALLEY COMM'L Valley Commercial Park 2nd Addition including sidewalks accord- 2ND STREETS ing to the Development Agreement. Ayes - 4 - Nays - O. MOTION: of Goodoien, seconded by Cozine to adopt Resolution No. 1974- RES. 74-79 79 authorizing advertisement for bids for street improvements BID ADVER. in Valley Commercial Park 2nd Addition to be received on July VALLEY 2ND 8th, 1974, at 2:00 oclock p.m. Ayes - 4 - Nays - 0. STREETS The Engineer reported on the status of plans for the 1974 road projects. Soil borings for 140th Street have been sent to the State for approval and the 42-Cedar service drive plan will be presented for approval in the near future. The Administrator stated the report on the trip to the Zoos should be completed before the next meeting. MOTION: of Cozine, seconded by Goodoien, to authorize the Police Chief LABOR RELATIONS to attend a seminar on Labor Relations June 21st 1974. Ayes - SEMINAR 4 - Nays - O. MOTION: of Cozine, seconded by Branning authorizing the repair of the street at Ridgeview and Walnut Lane, caused by a water main break, by McNamara-Vivant Contracting Corp. for $1,939.00 based on their low quote. Ayes - 4 - Nays - O. STREET REPAIR JAYCEE CARNIVAL MOTION: of Goodoien, seconded by Branning to authorize barricading of 149th Street between Pennock and Granada for a carnival sponsored by the Apple Valley Jaycees which will be set up beginning June 17th and the carnival will be June 19th through 23rd, 1974. Ayes - 4 - Nays - O. The sign permit application by First Federal Savings & Loan of Hastings for a time and temperature sign behind their new building at County Road 42 and Cedar Avenue was referred back to the Architectural Committee for further consideration and recommendation for Council review at the June 24th, 1974, meeting.
