HomeMy WebLinkAbout06/24/1974CITY OF APPLE VALLEY Dakota County, Minnesota June 24, 1974 Minutes of the meeting of the City Council of the City of Apple Valley, Dakota County, Minnesota, held on June 24th, 1974, at 7:30 o'clock p.m. PRESENT: Councilmen Branning; Cozine and Garrison; Clerk Asleson. ABSENT: Mayor Largen. Acting Mayor Garrison called the meeting to order at 7:30 o'clock p.m. All residents attending took part in the pledge of allegiance to the flag. Acting Mayor Garrison gave the invocation. MOTION: of Cozine seconded by Branning to approve the minutes of the MINUTES OF meeting of June 10th, 1974, as corrected. Ayes - 3 - Nays-0. JUNE 10TH MOTION: of Branning, seconded by Cozine, to adopt Resolution No. 1974- RES. 74-80 80 setting July 22, 1974, at 7:30 p.m. for the sale of $615,000 BOND SALE temporary improvement bonds and $800,000 general obligation definitive improvement bonds with call features on both issues. AYes - 3 - Nays - O. MOTION: of Cozine seconded by Branning, to adopt Resolution No. 1974- RES. 74-81 81 setting a public hearing for July 8th, 1974, at 8:30 p.m. BEEF 'N' BREW on the on-sale liquor license application of Zvi Liberman, ON-SALE HEARING dba Beef 'N' Brew restaurant. Ayes -3 - Nays - O. MOTION: of Cozine, seconded by Branning to adopt Resolution No. 1974- RES. 74-82 82 setting a public hearing for July 8th, 1974 at 9:00 p.m. LEMON TREE on the on-sale liquor license application of John Rezac dba ON-SALE NEARING Lemon Tree restaurant. Ayes - 3 - Nays - O. MOTION: of Cozine seconded by Branning, to adopt Resolution No. I974- RES. 74-83 83 approving the plans and specifications for a hydraulic GOLF COURSE seven gang fairway unit, a tractor and two triplex mowers EQUIP & BIDS for the golf course and authorizing bids to be received July 15th ,1974 at 2:00 p.m. Ayes - 3 - Nays - O. MOTION: Of Cozine (no second), to approve the transient merchant license for the Minneapolis Recreation DevelOpment organization. Motion Failed. MOTION: of Cozine seconded by Branning to pass Ordinance No. 145 consolidating existing dog control ordinances and requiring an impounding fee for dogs and all animals impounded and increasing the license fee for male and spayed female dogs to $3.00 annually the fee to be effective Janurary 1, 1975. Ayes - 3 - Nays - 0. ORDINANCE 145 DOG &ANIMAL CONTROL DeRUDDER GOLF RANGE - DENIAL MOTION: of Cozine seconded by Branning, denying a conditional use permit for a golf driving range on Cedar requested by Mr. DeRudder, as recommended by the Planning Commission. Ayes - 3 - Nays - O. MOTION: of Cozine seconded by Branning, granting a platting waiver KUBISTA to Tracy Kubista for building a house on three acres of land PLATTING WAIVER at 140th Street and County Road 33 subject to an easement for an access road and a letter saying he will agree to dedicate road rights-of-way on the north and south and his understanding of future utility assessments. Ayes - 3 - Nays - 0. MOTION: of Branning seconded by Cozine granting a sideyard vari- ance at 941 Whitney Drive of seven feet for a garage for Dale E. Larson. Ayes - 3 - Nays - O. VARIANCE AT 941 WHITNEY DR. MIDWEST RELAY LEASE MOTIOIN: of Cozine, seconded by Branning~to authorize the Mayor and Clerk to sign the lease agreement with Midwest Relay for microwave facilities at the Palomino Water Tower site. Ayes - 3 - Nays - O. MOTION: of Cozine, seconded by Branning, to adopt Resolution No. 1974-85 requesting the State Commissioner of Highways to review traffic on Cimarron Road and reduce the speed limit. Ayes - 3 - Nays - O. RES. 74-85 CIMARRON TRAFFIC SURVEY MOTION: of Branning, seconded by Cozine, to adopt Resolution No. 1974-86 requesting the Dakota County Board of Commissioners to request the State Commissioner of Highways to review traffic on Palomino Drive (County Road 38) west of Cedar Avenue and reduce the speed limit. Ayes - 3 - Nays - O. REs. 74-86 PALOMINO DR. TRAFFIC SURVEY CITY OF APPLE VALLEY Dakota County, Minnesota June 24, 1974 Page 3 MOTION: of Cozine seconded by Branning approving the subdivision agreement for Greenleaf 7th and 8th Additions and autho- rizing the Mayor and Clerk to sign the same. Ayes - 3 - - Nays - 0. MOTION: of Branning, seconded by Cozine, approving Change Order No. I for Project 73-44 (132nd Street Utilities) of an additional $216.92. Ayes 3 - Nay - 0. The Engineer and Staff were directed to request the County to repair the curbs along.County Road 42 west of Cedar Avenue which were damaged by snow plows. GREENLEAF 7 & 8 SUBDIVISION AGREEMENTS CHANGE ORDER 1 PROJECT 73-44 FIRE DEPT. BEER LICENSE MOTION: of Garrison, seconded by Cozine to approve a temporary on-sale 3.2 beer license for the Fire Department's 4th of July celebration and waive the license fee. Ayes - 3 - Nays - O. MOTION: of Branning seconded by Cozine to approve an on-sale 3.2 WATRUD CLUBHOUSE beer license for Carl Watrud for the Apple Valley Golf Club BEER LICENSE on 140th Street. Ayes - 3 - Nays - O. MOTION: of Cozine, seconded by Branning, granting permission for '4TH OF JULY the St. Croix Valley Sky Divers to land at Westview Park SKY DIVERS on July 4th and .also to make practice jumps on June 29th, 1974 it being noted they have furnished a liability waiver. Ayes - 3 - Nays - O. MOTION: of Cozine seconded by Branning, granting permission for a HELICOPTER helicopter to land at City Hall Park on July 4th to trans- LANDING port Senator-Humphrey. Ayes - 3 , Nays - O. Planning Commission minutes of May 13th 15th and June 5th, 1974 were received. May Water and Sewer Report and Building Report were received. Gross Payroll Report of June 14th, 1974, was received. The Staff and Councilman Cozine were authorized to interview architects and/or engineers for the design of a fire hall and a golf course maintenance building and to submit their recommendation at an ealy date. MOTION: of Cozine seconded by Branning, to adopt Resolution No. FIRE ALERT 1974-88 authorizing receipt of bids on July 29th, 1974 at PAGER BIDS 2:00 p.m. for 45 pocket fire alert pagers with an option in the bid to purqhase all of the units immediatgly or part of them and additional Units in six months. Ayes - 3 - Nays - 0. Discussion Was held on a Proposal by Mr. Thomas Pederson of Apple Valley- Farmington Ambulance Service, Inc., for ambulance service for the Apple Valley- Rosemount-Lakeville-Farmington area and as it relates to the new Apple Valley Medical Clinic. Jerry Goodoien commented on background of ambulance service and several proposals previously considered. Mr. Pederson said he would be presenting this proposal to the other communities involved and be asking for CITY OE APPLE VALLEY Dakota County, Minnesota June 24, 1974 Page 4 subsidies from all of them. The subsidy requested from Apple Valley would he about $34,000 in the form of an ambulance and communication equipment which probably could be financed by equipraent certificates. Mr. Pederson will report back to the Council July 8th after contacting the other cormmunities. MOTION: of Garrison, seconded by Cozine, to have Jerry Bell TREE check trees on the golf course to see if any could be REPLACEMENT transplanted on the boulevard in the area of Garland where nine trees were vandalized and report in two weeks, if there are none suitable, the City will pay half the cost of a small bare root tree to be planted in the fall. The staff is also directed to study a policy on future tree replacement. Ayes - 2 - Nays - 0 (Branning abstained). MOTION: of Branning seconded by Cozine, to adopt a policy effective in 1975, of 50 percent City participation in replacing all boulevard trees. Both motion and second withdrawn. The Council will receive a proposal for a clubhouse on the Municipal Golf Course site from John Ernst on Monday, July l, 1974, at 8:00 p.m. MOTION: of Branning, seconded by Cozine to pay the claims and CLAIMS & BILLS bills, checks numbered 9435 to 9526 in the total amount of $51,795.05. Ayes - 3 - Nays - O. MOTION: of Branning seconded by Garrison to approve a tem- porary sign permit for one year for Apple Valley Square for a white yellow and blue sign, 200 square feet in size, giving leasing information. Ayes - 2 Rays - O. (Cozine abstained). A.V. SQUARE TEMPORARY SIGN MOTION: of Cozine, seconded by Branning to adopt Resolution RES. 74-87 No. 1974-87 authorizing receipt of street seal coat SEAL COAT BIDS bids on July 15th, 1974~ at 2:00 p.m. Ayes - 3 - Nays -0. Clerk Asleson noted the City has received notice of a lawsuit filed on behalf of Kayla M. Squires who was injured on a City Street. It has been referred to the City Attorney who will be handling it. MOTION: of Cozine, seconded by Garrison, to adjourn. Ayes - 3 - Nays - O. The meeting adjourned at 10:00 o'clock p.m.
