Minutes of the regular meeting of the City Council of Apple Valley, Dakota County, Minnesota,
held January 22nd, 2009, at 8 00 o'clock p.m., at Apple Valley Municipal Center
PRESENT Mayor Hamann-Roland, Councilmembers Bergman, Goodwin, and LaComb
ABSENT Councilmember Grendahl.
City staff members present were City Administrator Lawell, Deputy City Clerk Murphy, City
Attorney Dougherty, City Engineer Manson, Finance Director Ballenger, Recreation Supervisor
Bilek, Public Works Director Blomstrom, Assistant City Administrator Grawe, Parks and
Recreation Director Johnson, Police Chief Johnson, City Planner Lovelace, Police Captain
Marben, Police Captain Rechtzigel, Human Resources Manager Strauss, and Fire Chief
Thompson.
Mayor Hamann-Roland called the meeting to order at 8 00 p.m. Everyone took part m the
Pledge of Allegiance to the flag.
APPROVAL OF AGENDA
MOTION of LaComb, seconded by Bergman, approving the agenda for tonight's meeting as
written. Ayes - 4 -Nays - 0
AUDIENCE
Mayor Hamann-Roland asked if anyone was present to address the Council, at this lime, on any
item not on this meeting's agenda. No one requested to speak.
CONSENT AGENDA
Mayor Hamann-Roland asked if the Council or anyone m the audience wished to pull any item
from the consent agenda. There were no requests.
MOTION of Bergman, seconded by Goodwin, approving all items on the consent agenda

MOTION of Bergman, seconded by Goodwin, adopting Resolution No. 2009-10 approving
issuance of a lawful gambling exempt permit, by the State Gambling Control
Board, to Minnesota Zoo Foundation, for use on Apri125, 2009, and waiving any
waiting period for State approval. Ayes - 4 -Nays - 0
MOTION of Bergman, seconded by Goodwin, approving a change m manager for Blazm
wings, Inc , d/b/a Buffalo Wild Wings Grill and Bar, m connection with the On-
Sale and Sunday Liquor Licenses at 14658 Cedar Avenue, naming Kevin
Etheridge as General Manager; as described m the City Clerk's memo dated

guarantee for CVS Pharmacy (Galaxie) from $6,000 00 to $1,000 00, as listed in
the Community Development Department Assistant's memo dated January 22,

MOTION of Bergman, seconded by Goodwin, adopting Resolution No. 2009-12 directing
the City Engineer to prepare plans and specifications for Project OS-290, Whitney

MOTION of Bergman, seconded by Goodwin, appointing Councilmember Ruth Grendahl to
the Minnesota Valley Transit Authority (MVTA) Board of Directors. Ayes - 4 -

Telemetry and Electrical Controls as final and authorizing final payment on the

END OF CONSENT AGENDA
MID-WINTER FEST 2009
Mr Randy Johnson, Mr Bilek, and Ms. Kristy Hemphill, Event Coordinator, reviewed activities
planned for this year's Mid-Winter Fest celebration. Activities are scheduled at Hayes Park,
Apple Valley Community Center, the Teen Center, the Senior Center, Sports Arena, and
Vahleywood Golf Course. Buttons are required for admission to the events on February 7 and 8,
2009, and are for sale at various locations for $1 00 This year's button was designed by Alex
Neubauer, a student from Apple Valley High School. Mr Johnson also thanked the members of
the business community who support this event.

MOTION of Goodwin, seconded by LaComb, adopting Resolution No. 2009-13
proclaiming February 7 and 8, 2009, as "Apple Valley Mid-Winter Fest 2009" and
encouraging citizens to support and participate m the celebration. Ayes - 4 -Nays

ORDINANCE AMENDING SECTION 155.360 -PROPERTY ADDRESS IDENTIFICATION
Mr Thompson said the Fire Department participates in the Crty Housing Group which is
comprised of staff members from various City departments and meets regularly to identify issues
with housing and to develop strategies for dealing effectively with these issues m order to make
housing safe, attractive, and livable. The Crty Housing Group has found that existing standards
for property identification building address numbers vary and are difficult to enforce The
Housing Group has worked with the Crty Attorney to draft language to amend the City Code to
address this issue. The proposed changes will help emergency responders find addresses more
easily and will help bang buildings up to a single standard for exterior address numbers.
Mr Thompson gave the first reading of the ordinance amending section 155.360 regarding
property address identification.
Councilmember Bergman showed concern of trees blocking the house numbers and how this will
be dealt with.
Mr Thompson stated that the numbers must be plainly visible, and if trees and shrubs are
blocking the legible view from the street or road then the numbers are not plainly visible and the
resident will be notified of the concern.
Mayor Hamann-Roland inquired if a resident had a tree they did not want cut or removed if the
numbers could be displayed possibly on the garage
Mr Thompson stated numbers may be moved away from trees and shrubs so as not to be hidden.
Councilmember LaComb asked if locating addresses has been a problem in the night time.
Mr Thompson stated most emergency personnel use a spotlight for night time assistance but the
most concern is for color contrast of address numbers on the background color to aid in clearly
identifying the emergency location.
The Council accepted the first reading. The second reading will be February 26, 2009
DAKOTA COMMUNICATIONS CENTER (DCC) APPOINTMENT
Mr Lawell addressed the Council regarding the request by Dakota Communication Center
(DCC) for the Crty to confirm the names of the elected officials that serve as the primary and

alternate members to the DCC Board of Directors. He stated originally Councilmember Bob
Erickson was the City's DCC Board member and with his passing, the Council appointed
Councilmember Bergman into that position. He stated Council would be seeking to appoint a
representative on the DCC Board as well as an alternate position. Councilmember Bergman has
indicated that he is interested m continuing to serve as the City's primary representative

primary representative, and Councilmember LaComb as the alternate
representative on the Dakota Communications Center Board of Directors Ayes -

URBAN AFFAIRS ADVISORY COMMITTEE VACANCY
Mr Lawell reviewed the City Clerk's memo dated January 16, 2009, stating Urban Affairs
Advisory Committee Member Robin Curran resigned effective immediately He extended an
invitation to individuals interested m serving on this Committee to submit an application to the
City Clerk by February 27, 2009
MOTION of Goodwin, seconded by Bergman, accepting resignation of Urban Affairs
Advisory Committee Member Robin Curran. Ayes - 4 -Nays - 0
MOTION of LaComb, seconded by Goodwin, authorizing receipt of applications until
February 27, 2009, to fill the vacancy for the two-year term expiring March 1,
2009 Ayes - 4 -Nays - 0
PARKS AND RECREATION ADVISORY COMMITTEE VACANCY
Mr Lawell reviewed the City Clerk's memo dated January 16, 2009, listing applicants for the
Parks and Recreation Advisory Committee vacancy He stated the individual appointed at the
previous Council meeting was unable to accept the position.
The Mayor called for nominations for the vacancy Councilmember Grendahl nominated Marian
Brown, Nancy Dickey, Chris Elvrum, Darnel Monahan, Darrell Retka, and Enc Seurer There
being no further nominations, the Mayor declared the nominations closed.
MOTION of Goodwin, seconded by Bergman, accepting the six nominations for Parks and
Recreation Advisory Committee. Ayes - 4 -Nays - 0
MOTION of Goodwin, seconded by Bergman, amending the previously adopted
appointment process to reduce the number of candidates by selecting two fewer
candidates than total names appearing on the ballot. Ayes - 4 -Nays - 0

The Deputy City Clerk prepared ballots and the City Attorney distributed them to the Council
who were asked to each select four names from the six nominees. After selections were made,
they were talked and the City Attorney announced that four names remained.

process to reduce the number of candidates by selecting one fewer candidate than
total names appearing on the ballot. Ayes - 4 -Nays - 0

Mayor Hamann-Roland thanked all the applicants who applied and expressed interest m the
position.
COUNCIL COMMUNICATIONS
Mr Lawell provided update on the Metropolitan Airport Commission and how the community
could be affected by the merger between Delta Airlines and Northwest Airlines. Some of the
covenants, leases, and agreements that were in place between the Metropolitan Airport
Commission and Northwest Airlines will need to be renegotiated as part of that acquisition. He
has been attending meetings along with Mayor Hamann-Roland and Councilmember Bergman
and will continue to update as time goes on.
Mr Lawell stated the Dakota Communications Center (DCC) plans to celebrate their one year
anniversary and an invitation is extended to the Mayor and Council to tour the facility on January
26, and again on January 30, 2009, in the afternoon and evening hours.
Mr Lawell gave an update on the transition of ALF Ambulance to Allma. Alhna will begin
serving the Apple Valley Lakeville Farmington area on February 1, 2009 All but one of the ALF
paramedics has accepted positions with Allma. The same paramedics will be serving the area as

were previously serving. Headquarters for the operation will be Apple Valley Fire Station No 1
Service availability will remain the same. There will be two other ambulance units, one m
Farmington and one m Lakeville.

included in the City Clerk's memo dated January 16, 2009, and noting that each
event listed is hereby deemed a Special Meeting of the City Council. Ayes - 4 -

MOTION of Bergman, seconded by Goodwin, to pay the claims and bills, check registers
dated January 14, 2009, in the amount of $1,830,915 61, and January 21, 2009, in
the amount of $9,153,704 85 Ayes - 4 -Nays - 0
MOTION of LaComb, seconded by Bergman, to adjourn. Ayes - 4 -Nays - 0
