HomeMy WebLinkAbout10/23/1974CITY OF APPLE VALLEY Dakota County Minnesota October 23, 1974 Minutes of the meeting of the City Council of Apple Valley, DakOta County, Minnesota, held on October 23, 1974, at 7:30 o'clock p.m. PRESENT: Mayor Largen (attended until 9:40 p.m.); Councilmen Cozine, Garrison and Holton; ·Clerk Asleson. ABSENT: Councilman Branning. Mayor Largen called the meeting to order at 7:30 o'clock p.m. All residents attending took part in the pledge of allegiance to the flag. Mayor Largen gave the invocation. MOTION: meeting of October 9th, 1974, as written. Ayes - 4 - Nays - 0 MOTION: of Garrison, seconded by Cozine, adopting Resolution No. 1974-172 setting a bid opening for $985,000 of Improvement Bonds and $100,000 o£ State Aid Street Bonds on November 13th 1974~ at 7:15 p.m. at the City HalI. Ayes - 4 - Nays - O. MOTION: of Cozine, seconded by Holton, to approve the minutes of the . OCT. 9~ 1974 MINUTES RES. 1974-17~ SET BOND SALE John Gretz commentedon the possibility of the City trading land with Southland Corporation at the corner of Galaxie Avenue and 140th Street. A public hearing is scheduled before the Planning·Commission November 6th, 1974, and further considaration will be given after that time. Possible changes to the Planned Development Agreement for Muir's Cedar Center 1st Addition relating to road access and a drainage easement were discussed. The Council feels the Agreement should remain as it was approved. It will be reconsidered November 13th 1974 along with the final plat, MOTION; of Cozine, seconded by Holton, denying approval of the prelim- BARTH 2ND inary plat for Barth 2nd Addition until access for the 40 acres DENIAL of land east and southeast of it has been determinedl Ayes - 4 Nays - O. MOTION: · Of Cozine, seconded by Garrison, approving a building permit BADEN BOWLING for the Baden Bowling Center in the northeast quadrant of Cedar CENTER BUILDING Avenue and County Road 42 as recommended by the Planning Com- PERMIT mission subject to review of the plans by the Building Inspector and final review of the landscape plan by the Architectural Com- mittee including vine covering on the walls. MOTION: of Garrison, seconded by Holton, approving an excavation permit BADEN BOWLING for the Baden Bowling Center at the petitioner's risk subject CENTER EXCAVATION to final review of the building plans by the Building inspect- PERMIT or. MOTION: of Garrison, seconded by Cozine, approving building permits for ap2rtments in Phase I of Stage II of Wildwood as recom- mended by the Planning Commission subject to a construction agreement. WILDWOOD APARTMENT BUILDING PERMITS CITY OF APPLE VALLEY Dakota County Minnesota October 23, 1974 Page 2 MOTION: of Holton, seconded by Cozine approving a variance for a garage GARAGE VARIANCE addition at 196 Linden Circle which would be set back 24 feet 196 LINDEN CIRCLE from the street, as recommended by the Planning Commission. Ayes - 4 - Nays - O. MOTION: of Garrison, seconded by Holton approving an agreement for ICE ARENA joint City-School operation of the ice arena with School Dist- AGREEMENT riot 196 as amended including wording stating the City will re- ceive interest earned on its share of any idle construction money if such money is not required to finance construction. Ayes - 4 - Nays - O. Mayor Largen left at this time. MOTION of Holton, seconded by Cozine, approving preliminary plans for ICE ARENA PLANS the ice arena. Ayes - 3 - Nays - 0. Mr.Richard Hammel of Hammel, Green & Abrahamson, architects for School District 196, presented a preliminary site model of the Apple Valley Senior High School. MOTION: of Cozine seconded by Holton, adopting Resolution No. 1974-173 approving plans and specifications for the golf course main- tenance building including a revision in the size of the pump room. Ayes - 3 - Nays - O. RES. 1974-173 MAINTENANCE BLDG. GOLF COURSE MOTION: of Holton, seconded by Cozine, adopting Resolution No. 1974- 174 authorizing advertisement for bids on the golf course maintenance building to be received Tuesday, November 1974, at 2:00 p.m. at the City Halls. Ayes - 3 - Nays - O. RES, 1974-174 GOLF COURSE BUILDING BIDS Nan McKay of the Housing & Redevelopment Authority of Dakota County explained the rent subsidy program for elderly and families recently authorized for cities in Dakata County. the rents of qualifying individuals would be paid up to 75 percent of thefair market rent ceiling, including utilities except telephone, by the HRA. Consideration of author- izing this program to operate in Apple Valley will be given at the November 13th meeting after the City Attorney has reviewed it. MOTION: of Holton seconded by Cozine, approving the final plat of Green- GREENLEAF lOTH leaf 10th Addition subject to a development agreement. Ayes - 3 FINAL PLAT Nays - O. MOTION: of Holton, seconded by Cozine adopting Resolution No. 1974- 175 opposing the proposal by the Dakota County Board of Com- missioners to terminate refunds of road and bridge taxes to cities and amend cost sharing on construction of County roads. Ayes 3 - Nays - O. RES. 1974-175 ROAD & BRIDGE FUNDS MOTION: of Cozine, seconded by Holton approving a planned develop- CARROLLW00D ment agreement for Carrollwood Properties located at the north- P.D. AGREEMENT west corner of 145th Street and Pennock Lane which combines all previous agreements as amended. Ayes - 3 - Nays - O. MOTION: of Cozine seconded by Holton, approving a rental agreement with Dakota Electric for a telemetering line on 16 poles at an annual rent of $3.50 per pole and authorizing the Mayor and clerk to sign the same. Ayes - 3 - Nays - O. DAKOTA ELECTRIC POLE RENTAL CITY OF APPLE VALLEY Dakota County Minnesota October 23, 1974 Page 3 MOTION: of Holton, seconded by Cozine, adopting Resolution No. 1974- 176 awarding the contract for Project 72-28 (Carrollwood Utilities and 140th Street Storm Sewer) to Barbarossa & Sons~ the low bidder in the amount of $122,971.50. Ayes - 3 - Nays '- O, RES. 1974-176 AWARDING BIDS PRojECT 72-28 MOTION: of Cozine, seconded by Holton, adopting Resolution No. 1974- 177 setting a public hearing on November 26th, 1974, at 8:00 p.m. for street improvements on Hayes Road from County Road 42 to 140th Street based on the preliminary engineering re- port which was received. MOTION: Of Holton, seconded by Cozine changing the date of the regular SET MEETING Council meeting of November 27, 1974 to November 26, 1974 at ON NOV. 26TH 7:30 p.m. Ayes - 3 - Nays - 0. MOTION: of Holton, seconded by Cozine, accepting the park improvement work on Belmont Park by Metro Engineering as final as recom- mended by the City Engineer. Ayes~- 3 - Nays - 0. ACCEPT PARK PROJECT CHANGE ORDER PROJECT 74-69A MOTION: of Cozine seconded by Holton approving Change Order No. 1 in the amount of $2,651.13 to Project 74-69A on the Contract with Fischer Sand & Aggregate for catch basins on Edgewood Drive. Ayes 3 - Nays - O. The Council directed the City Administrator to contact the Carroll family by telephone to ask whether they have come to a decision on selling land for a fire hall site to the City. If they have not he is directed to request their consideration of donating the 2.4 acre site to the City with future credit on park and ponding dedication to be given and request an answer not later than November 6, 1974. MOTION: of Holton seconded by Garrison adOpting Resolution No. 1974- 178 approving plans and specifications for the proposed Fire Hall. Ayes - 3 - Nays - O. RES. 1974-178 FIRE HALL P. & S. MOTION: of Cozine, seconded by Holton adopting Resolution No. 1974- 179 authorizing advertisement for bids on construction of the proposed Fire Hall to be received December 2nd, 1974, at 2:00 pm. if the bond issue passes. RES. 1974-180 P & S FIRE TRUCK MOTION: of Holton, seconded by Cozine, adopting Resolution No. 1974- 181 authorizing advertisement for bids for a fire truck to be purchased with Revenue Sharing Funds, to be received Friday November 22, 1974, at 2:00 p.m. Ayes 3 - Nays - O. RES. 1974-181 FIRE TRUCK BIDS MOTION: of Cozine, seconded by Holton, adopting Resolution No. 19_74- 182 designating the street in front of Granada 3rd Addition (east side of shopping center) as a fire lane and authorizing signs to be placed there. RES. 1974-152 GRANADA FIRE LANE : CITY OF APPLE VALLEY Dakota County, Minnesota October 23, 1974 Page 4 MOTION: of Cozine, seconded by Holton authorizing hiring Jerome Zimmeth as a part time Liquor Store Clerk replacing Jerome Solinger end John Morgan as a part time standby Clerk at salaries of $2.25, per hour. LIQUOR STORE PERSONNEL MOTION: of Holton, seconded by Cozine, approving a salary increase of $34.00. per month for Daniel Kroyer and the end of the six- months probation period effective November 1, 1974. Ayes - 3 Nays - O. KROYER SALARY REVIEW PAY CLAIM 449 REFLECTION MOTION: of Cozine, seconded by Holton, approving a claim by Mr. M.C. Huffstutler, 449 Reflection Road, related to a sewer back-up in the total amount of $400.00. Ayes - 3 - Nays - O. Planning Commission minutes of October 3, 1974; Water and Sewer Report for August; Water and Sewer Report for September; and Police Report for September were received. MOTION: of Cozine, seconded by Holton, setting a special Council meeting SPECIAL MEETING for wednesday, November 6th, 1974, at 7:00 p.m. to Canvass election results. Ayes - 3 - Nays - O. Councilman Garrison said Senator Howard Knutson would like to meet with members of the City Council and School District representatives to determine necessary legislative items for the next session. The meeting will be October 30th, 1974, at 7:00 a.m. MOTION: of Cozine, seconded by Holton, changing the date of the regular SET MEETING Council meeting of December 25, 1974 to December 30, 1974, at ON DEC. 30TH 7.30 p.m. Ayes - 3 - Nays - O. MOTION: of Cozine, seconded by Holton, adopting Resolution No. 1974- 183 requesting Dakota County to budget funds for the Valley Squadron-Civil Air Patrol as it already does for two other squadrons in the County. Ayes - 3 - Nays - O. REs. 1974-183 REQUEST CIVIL AIR PATROL FUNDS Councilman Cozine said he has made arrangements with the Minnesota Valley Sun to publish artieles~ on a regular basis, about City news and employees, etc. MOTION: of Cozine, seconded by Holton, approving a dance permit for two ROLLERWAY dances at the Apple Rollerway with music by mechanical means, DANCE PERMIT one on November 27th and one in December, for a permit fee of $15.00 Ayes 3 - Nays - O. MOTION: of Holton, seconded by Cozine, accepting as final Project 73-44,ACCEPT 13~ND 132nd Street street improvements from Galaxie Avenue to Green- STREET IMPROVEMENTS leaf 5th addition, as recommended by the Engineer. Ayes - 3 - Nays - O. MOTION: of Holton, seconded by Garrison, to hire Dwayne Bronk as a as a Police patrolman at a monthly salary of $835 effective November 15, 1974. Ayes - 3 - Nays - O. CLAIMS & BILLS MOTION: of Holton, seconded by Cozine, to pay the claims and bills, cheeks numbered 11937 through 12020, in the amount of $243,167.05. Ayes - 3 - Nays - O.
