Minutes of the meeting of the City Council of Apple ValleY, Dakota County, Minnesota
held on November 26, 1974, at 7:30 o'clock p.m
PRESENT: Mayor Largen Councilmen Branning, Cozine, Garrison and Holton; Deputy
Clerk Mueller.
ABSENT: None.
Mayor Largen called the meeting to order at 7:30 o'clock p.m. All residents attending
took part in the pledge of allegiance to-the flag. Councilman Garrison gave the
invocation

MOTION: of Branning seconded by Holton adopting Resolution No. 1974- RES. 1974-198
198 determining the form and details of $985,000 Improvement $985,000 BONDS
Bonds of 1974 (Series B), providing for their payment from a
sinking fund and levying taxes and pledging assessments for the :
payment thereof. Ayes - 5 - Nays - O.
MOTION: of Cozine, seconded by Holton, adopting Resolution No. 1974- RES. 1974-199
199 establishing form and details and authorizing execution ~100,000 STATE-
and delivery of $100,000 State-Aid Street Bonds of 1974~ AID BONDS
appropriating state-aid street allotments to their payment
and pledging the full faith and credit to the City. Ayes -

of $156.69 on assessments levied September 9, 1974, to In-

Apple Valley's position on the improvementof Cedar Avenue
to be presented along with previous resolutions on the sub-
ject, by Mr. Rosene at a public hearing on the subject Dec-

MOTION: of Holton seconded by Branning approving an agreement to
establish a county-wide Civil Defense organization in Dakota
County and authorizing the Mayor and Clerk to sign the same

MOTION: of Branning, seconded by Holton authorizing the installation of a SECURITY
burglar alarm system to be rented to subscribers and a lift station ALARM SYSTEM
monitoring system by Trans-Alarm, Inc., at an installation
charge of $35.00 per module and rent of $2.00 per month. Ayes
5 - Nays - 0.
Public Hearing - Proposed Hayes Road Street Improvements. The Mayor called the hearing
to order at 8:00 o'clock p.m. and noted the affidavit of publication. Robert Rosene
showed the location of the proposed improvements on the map and said the City should
consider building 145th Street from Valley Commercial Park 2nd Addition to Garden View
Drive and the northern portion of Hayes Road from 145th Street to 140 th Street. John
Gretz commented on this suggestion and said the portion of Hayes Road from 145th Street
to the Westview Community Building entrance should also be considered for improvement.
He also said another public hearing would be needed to consider these improvements. The
Mayor then called for questions or comments from the public. Mr. J. W. Hendrickson,
an attorney representing property owners along Hayes Road, presented a petition contain-
ing their objections to the street improvements. Councilman Branning said if the council
considered the above suggestions, Hayes Road in front of their property would not be
affected. There being no further questions or comments, the Mayor declared the hearing
closed at 8:17 o'clock p.m.
MOTION: of Branning seconded by Cozine, directing the Engineer to prepare
a preliminary report on improvement of 145th Street from Valley
Commercial Park 2nd Addition to Garden View Drive and Hayes Road
from 140th Street to the Westview entrance giving both alterna-
tives of a full road and a temporary mat. Ayes - 5 - Nays - O.

MOTION: of Garrison, seconded by Branning, approving the Planned Develop~
merit Agreement for the 160 acres southeast of Cedar Avenue and
County Road 42 including paragraph 5 as amended in the attached
memo with access on Cedar Avemue and County Road 42, 660 feet
from the intersection; a reference to the ponding agreement in
paragraph 4; an additional paragraph on procedures after paragraph
l; an option for a street easement at 153rd Street on which a pri-
vate driveway shall be allowed but built to City specifications and
authorizing the Mayor and Clerk to sign the agreement. Ayes - 5 "Nays ~ O.
MOTION: of Garrison, seconded by Holton, approving the Construction Agree-
ment for Muir's Cedar Center First Addition as amended in para-
graphs 5 and 6 by the attached memb and approving the final plat
for Muir's Cedar Center First Addition and authorizing the Mayor
and Clerk to sign the Agreement and plat subject to Muir Company
signing the Agreement, Planned Developement Agreement and obtaining
a ponding agreement. Ayes - 5 - Nays - O.

The Council received a draft of a letter to be sent to all homeowners in Greenleaf 5th
Addition concerning implementing the street lighting system in their Addition. The Council
directed that the letter be changed so as to include the cost breakdown between the cost
of electricity and the cost of the equipment installation.
A status report on land acquisition for the new fire hall was received and Councilman
Branning was appointed to work with the Fire Chief and City Attorney in negotiating with
the land owners. The Council said the order of preference on the sites is first at the
corner of County Road 42 and Hayes Road second east of the Carroll farmstead and third
west of the Carroll farmstead. They also viewed the plans for the building and agreed
the exterior should be break-off block.
The Mayor commented on a meeting he and John Gretz attended with Dakota County repre-
sentatives on the grade at 140th Street and Fairgreen Avenue. The County agreed to share
in the cost of lowering 140th Street (or County' Road 40) on the 55/45 basis and use the
material to fill in east of Fairgreen Avenue. He also said the County was working on a
design for the intersection of County Road 42 and FairgreenAvenue.
The October Police Report, October Water and Sewer Report and Gross Payroll Report of
November 15th, 1974, were received.
MOTION: of Garrison, seconded by Cozine authorizing the installation of
"No Parking" signs along 123rd Street between Cedar Avenue and
195th Street. Ayes - 5 - Nays - O.

Councilman Garrison commented that he and Jerry Bell had met with people interested in
building a clubhouse at the Golf Course during the past week.
A thank you letter was received from Nick Wagner for a plaque presented to him by the
City Council for his work at Lake Alimagnet Park over the years.
MOTION: of Holton seconded by Cozine, to pay the claims and bills,
checks numbered 12197 through 12264, in the total amount of
$787,890.18. Ayes - 5 - Nays - O.
