Minutes of the meeting of the City Council of Apple Valley, Dakota County Minnesota,
held on December 11, 1974, at 7:30 o'clock p.m.
PRESENT: Mayor Largen; Councilman Branning, Cozine, Garrison and Holton; Clerk Asleson.
ABSENT: None.
Mayor Largen called the meeting to order at 7:30 o'clock p;m.' All residents attending
took part in the pledge of allegiance to the flag. Mayor Largen gave the invocation.
MOTION: of Branning, seconded by Cozine approving the minutes of the NOV. 26; 1974
meeting of November 26th, 1974 as written. Ayes - 5 ~- Nays,- 0
Councilman Garrison presented the concept for a neighborhood council program, now in
existence in Independence, Missouri, which was first brought to his attention by Mr.
Glen Gilmore. The map he had prepared showed the seven possible neighborhoods, but
for now he suggested five neighborhoods with nine members on each council. This would
be a method for people to become involved in their City and he gave some examples Af
possible projects. Councilman Cozine made several comments on the idea and said he
would like to see it implemented. Councilman Branning agreed but said he would like
sorae time to absorb the information as did Councilman Holton who also said the depart-
ment heads' time scheduling would need some study.

Mrs. Louise Noreen speaking for Cedar Knolls area residents, said they would encourage...
adopting the program Mr. Glen Gilmore commented on the Independence, Missouri Program
and recoramended the City Council express support for the program, send two representatives
to Missouri to meet with officials there and appoint a committee to serve until elections
could be held to implement the program. John Voss commented and said this would be
the start of effectuating the goals and policies of the Comprehensive Plan.
MOTION: of Branning, seconded by Cozine, adopting Ordinance No~ 154 ORDINANCE 154
rezoning the zoo entrance property in the Southwest corner of REZONING ZOO'

MOTION: of Garrison, seconded by Cozine, granting a variance for a 7-11 STORE IN

subject to property owner constructing a sidewalk on the east ~
Or west side of Germane from 125th to 127th Streets; temporarily
waiving platting until a request for another building permit on
the balance of the property is submitted; and granting a building
permit for a residentially compatible style building, as shown on
a sketch. Ayes - 4 - Nays - 1 (Holton)
MOTION: of Holton, seconded by Branning approving the preliminary DIAMOND PATH
plat for Diamond Path Addition including the exception as an PRELIMINARY PLAT
outlot, as recommended by the Planning Commission. Ayes - 5 -

Staff was directed to prepare the construction agreement and final plat for Diamond
Path Addition for consideration.
MOTION: of Garrison, seconded by Holton, adopting Ordinance No. 155 amending ORDINANCE 155
Ordinance No. 92, allowing zoos as planned developments in an ZOOS ~- INSTITUTIONAL
Institutional district. Ayes - 5 - Nays - 0.
MOTION: of Holton, seconded by Branning, authorizing the Engineer to prepare PARK -- 7-11
a grading plan for Scott Highlands Park including the 7-11 store site GRADING PLAN
adjacent to the park to determine the amount of fill required. Ayes -
5 - Nays - O. (The Engineer was also asked to get accurate cost estimates
for moving gill from Fairgreen Avenue to 140th and Galaxie.)
John and George Houston presented a staging plan for the 80-acre site at the northwest
corner of County Road 42 and Pilot Nnob Road (known as the 01d Town Hall site) showing
multiple dwellings and light industrial, The Mayor stated that light industrial in that
area does not fit the Comprehensive Plan. Petitioners said they would agree to a base
zone of M-3 but do not want to preclude industrial if the opportunity came up. The
Engineer commented on the problem of providing a sewer trunk to the property which would
have to go through the Trans Union property. Staff was directed to work with the petitioners
and other land owners on the financial feaibility of the sewer extension.
MOTION: of Cozine, seconded by Branning, setting a special Council meeting for SPECIAL MEETING
6:30 o'clock p.m. on December 18th, 1974, to consider fire truck bids DEC. 18; 1974
and any other items. Ayes - 5 - Nays - 0.
Councilman Garrison stated an informal meeting on the budget would be held December 12,
1974, at his house and it would be an open meeting.
MOTION: of Branning, seconded by Holton, adopting Resolution No. 1974~202 set- RES. 1974-202
ting a public hearing for January 8, 1975, at 8:00 p.m., to vacate a SET VACATION

MOTION: of Branning, seconded by Cozine, adopting Resolution No. 1974-203 RES. 1974-203

Development Act of 1974 and appointing Mayor Largen as the City's
representative on the Ad Hoc Steering Committee. Ayes - 5 - Nays - 0.
MOTION: of Branning, seconded by Garrison, adopting Resolution No. 1974-204
and Ordinance No. 156 on zoning in The Woods 1st and 2nd Additions,
which was not previously published. Ayes - 5 - Nays - O.

WOODS ZONING
State Highway Department approvals on Galaxie Avenue and signing related to Greenleaf
School were reeetved. The speed limit on Galaxie between 133rd and 135th Streets will
be 30 miles per hour when children are present and pedestrian warning signs will be
established with an order expiring December 31, 1975 and subject to review by the
Highway Department at that time.

Jerry Bell said the Apple Valley Country Club would like to donate its building and
facilities to the City but it would include debts of approximately $1,200. The
Council said it would intend to take over the building but Mr. Bell was directed to
determine the costs for bringing the building up to standard, future operating costs
and negotiate attorney's cost in title transfer.
MOTION; of Cozine, seconded by Holt0n, approving the ambulance lease agree- AMBULANCE
ment with Dakota Ambulance Service, subject to the Attorney's review LEASE AGREEMENT
and authorize the Mayor and Clerk to sign the same. Ayes - Nays - 0.
MOTION: of Branning, seconded by Holton, approving the purchase of 3.20 gross FIRE HALL
acres at the northeast corner of County Road 42 and Hayes Road for SITE PURCHASE
approximately $17,250, subject to survey, from the Carrolls for the
fire hall site and authorizing the Attorney to prepare the paperwork.

The Mayor requested staff to check a resolution adopted by the Council relating to
placing property deferred from the tax rolls by the Town Board back on the tax rolls.
MOTION: of Garrison seconded by Largen, making access from the new fire hall FIRE HALL HAYES

A draft of the golf course clubhouse lease agreement was received and reviewed.
MOTION: of Holton, seconded by Cozine, authorizing the City to become a part- APPROVING

MOTION: of Cozine, seconded by Holton approving the revised costs (as shown ALARRMSYSTEM

MOTION: of Garrison, seconded by Cozine, authorizing the installation of a BOOSTER PUMP &
small booster pump and 40-gallon pressure tank by the City at a cost PRESSURE TANK
of approximately $200 per home where requested by the homeowner FOR LOW WATER
because of low water pressure problems as recommended by the Engin- PRESSURE HOMES
eer. The system will be tried in one or two homes first and home-
owners will have to maintain the system after it is installed. Ayes -

MOTION: of Branning seconded by Cozine, authoriming hiring Robert Becka for HIRE SEASONAL
rink maintenance at $4.00 per hour; Kelly Smith, George Seiman, EMPLOYEES
Gerald Prettyman and Craig Westin for warming house attendants at
$2.00 per hour;, and Curt Schmidt Mary Hansen and Scott Mogen for
stand-by attendants at $2,00 per hour for the winter skating season.

MOTION: of Cozine, seconded by Holton, approving end of probation salary in-
creases for Merlyn Olson of $33.00 per month effective Deceraber 1,
1974; Roxy McCouch and Patricia Rear of $20.00 per month effective
December 1st and 15th, 1974 , respectively. Ayes - 5 - Nays - 0.
SALARY REVIEWS
The November Building, Parks and Police Reports; September 1974, Treasuruer's Report;
November 29, 1974~ Gross PayrollReport and Planning Commission minutes of November
20th and December 4th, 1974, were received.
MOTION: of Cozine, seconded by Holton approving the 1975 taxi cab license re- 1975 TAXI
newal for the Apple Valley Cab Company for five taxis subject to LICENSE
receipt of the drivers' checks by the Police Department. Ayes - 5 -
Nays - 0.
Jerry Bell stated the Engineer recommends constructing the guardrail along the Galaxie
Avenue pathway along with the County Road 42 pathway. The Engineer was requested to
obtain prices on the posts and the steel and the City Mould possibly order the steel
now for later delivery.
MOTION: of Cozine, seconded by Branning, increasing the travel allowance for TRAVEL ALLOWANCE
the Public Works Director to $100 monthly effective December l, 1974.'

MOTION: of Cozine, seconded by Branning, to pay the claims and bills, checks
numbered 12265 through 12369, in the total amount of $723,750.59.
