PRESENT: Mayor Largen; Councilmen Garrison, Goodoien, Pearsall, and Branning; Clerk Asleson ABSENT: None The Mayor called the meeting to order at 7:30 p.m. All residents attending took part in the pledge of allegiance to the flag. Mayor Largen gave the invocation. Minutes MOTION: of Goodoien, seconded by Garrison, to approve the minutes of the meeting of January 10, 1973 as written. Ayes - 5 - Nays - 0. MOTION: of Branning, seconded by Pearsall, to approve the minutes of the meeting of January 17, 1973 as written. Ayes - 5 - Nays - 0. MOTION: of Branning, seconded by Pearsall, to approve Change Order #2 for utilities in the "Meadows", to accept the contract as complete and authorize payment of $49,463.03. Ayes - 4 - Nays - 0; Goodoien abstaining- MOTION: of Branning, seconded by Garrison, to pass Resolution 1973-15, setting a public hearing for 7.3 acre tract in Palomino Hills for February 7, 1973. Ayes - 5 - Nays - 0. Cobblestones Contract and Plan- discussion on draft as revised by Mr. Crawford. Further revision to be made and presented to Council at a later date. MOTION: of Goodoien, seconded by Branning, to have a study prepared on the feasi- bility and proposed cost of an overpass at C.S.A.H. 42 and Elm Drive. Staff to recommend a qualified firm to do the study. Ayes - 4 - Nays - Pearsall. Motion carried. It was also noted that the study would have to include a study of the children pro- posed to use this overpass. MOTION: of Pearsall, seconded by to have a study as to where, on Co. Rd. 42, an overpass should be placed, and that it should be in conjunction with the new pathway system. No second to this motion. The Park Director was instructed by the Council to prepare a study of the major pathway systems of the Village, with the overpasses (proposed) showing. Planning Commssion minutes of January 3, 1973 received. MOTION: of Garrison, seconded by Pearsall, to approve the preliminary plat for Poppler-Cardarelle's Apple Valley East, with the 40 foot easement for Dodd Blvd. Ayes - 5 - Nays - 0. The Mayor commented that there should be an advance payment required on the water extensions. MOTION: of Pearsall, seconded by Branning, to authorize the Engineer to prepare a preliminary report on water service to Apple Valley East. Ayes - 5 - Nays - 0. VILLAGE OF APPLE VALLEY Dakota County, Minnesota Page 2 Skelly property - waiving of platting rights. Council requests petitioner to appear before the Council to discuss road access. Co. Rd. 42 alignment adjacent to Trans-Union property - communication from County received. MOTION: of Garrison, seconded by Pearsall, to authorize the Engineer to prepare a preliminary report for construction of 132nd Street from Fairgreen to Galaxie. Ayes - 5 - Nay - 0. Mayor also would like a study of the intersection of County Road 33 and County Road 42, as to the widening of County Road 33 if it were to become a major road, rather than Co. Rd. 31. Engineer to contact County relative to above. Letter from Commissioner Murphy relative to Courthouse location received. MOTION: of Garrison, seconded by Pearsall, to authorize a letter of reply be sent to Commissioner Murphy. Ayes - 5 - Nays - 0. MOTION: of Pearsall, seconded by Garrison, to pay the claims and bills; check #5762 thru #5803, in the amount of $33,830.36. Ayes - 5 - Nays - 0.
