PRESENT: Mayor Largen; Councilmen Goodoien, Garrison, Pearsall and Branning (attended at 7:05 p.m.); Clerk Asleson. ABSENT: None. The Mayor called the meeting to order at 7:00 p.m. Minutes MOTION: of Pearsall, seconded by Garrison, tO approve the minutes of the meeting of June 20, 1973, as written. Ayes - 4 - Nays - 0; Mayor abstaining. Planning Commission minutes of June 6, 1973, received. Gross Payroll Report of June 29, 1973, received. May Treasurer's Report received. May Fire Marshall's Report received. May Park Report received. Councilman Branning attended at this time. Notification of Minnesota AAA Pedestrian Safety Award - received. Overpass report, discussion to be held July 25, 1973, and public notified. Memo on tree protection received. Request to park mobile home at 13524 Pilot Knob Road - tabled. MOTION: of Garrison, seconded by Goodoien, to approve the agreement with Leanin' Tree properties, subject to the Attorney's opinion on the rewording changes. Ayes - 5 - Nays - 0. MOTION: of Goodoien, seconded by Pearsall, to pass Ordinance No. 127 rezoning the above property as recommended by the Planning Commission with publication of the Ordinance to be held until the agreement is executed. Ayes - 5- Nays - 0. MOTION: of Garrison, Seconded by Goodoien, to approve the preliminary plat for Leanin' Tree contingent on the signing of the agreement. Ayes - 5 - Nays - 0. Apple Valley Baptist Church - tabled. MOTION: of Goodoien, seconded by Branning, to appoint William Holton as CiVil Defense Director as of July 1, 1973, at a salary of $25.00 per month. Ayes - 5 - Nays-0. Dakota County Civil Defense Organization resolution - held for review. MOTION: of Garrison, seconded by Branning, to pass Resolution 1973-110 regarding the various road and utilities easements with the owners of the Valley Chrysler property, and to grant the necessary variance for an addition to the existing building, if requested. Ayes - 5 - Nays - 0. MOTION: of Pearsall, seconded by Goodoien, to approve the agreement for storm sewer easements with Fischer Construction Company wherein in consideration of re- ceiving the storm sewer easement, the gravel operation may operate from 5:00 a.m. to 11:00 p.m. except Sundays subject to the restrictions contained in the agreement. Ayes - 5 - Nays - 0. VILLAGE OF APPLE VALLEY Dakota County, Minnesota July 5, 1973 Page 2 MOTION: of Garrison, seconded by Branning, to pass Resolution 1973-111 ordering the Greenleaf 6th Addition improvements (Project 73-37). Ayes - 5 - Nays - 0. MOTION: of Pearsall, seconded by Goodolen, to pass Resolution 1973-112 approving the plans and specs on the above improvements. Ayes - 5 - Nays - 0. MOTION: of Goodoien, seconded by Pearsall, to pass Resolution 1973-113, to authorize advertising for bids on improvements to Greenleaf 6th Addition for August 3, 1973, at 2:00 p.m. Ayes - 5- Nays - 0. MOTION: of Pearsall, seconded by Goodolen, to pass Resolution 1973-114 ordering prep- aration of plans and specs for the Farquar Hills improvements. Ayes - 5- Nays 0. MOTION: of Garrison, seconded by Pearsall, to authorize the building inspector a travel allowance of $50.00 per month effective June 1, 1973. Ayes - 5- Nays - 0. Councilman Pearsall discussed the Crystal Lake problem and what recommendations he had received from the Village Attorney. MOTION: of Pearsall, seconded by Garrison, to state, for the record, that Apple Valley will not participate in any outlet from Crystal Lake to the north. Ayes - 5 - Nays - O. Mayor Largen discussed briefly some of the highlights of the Mayor's Convention and his full report was received. Councilman Goodoien requested the Village to investigate the erection of "Slow - Children" signs near park areas. The Mayor commented on the 4th of July celebration and commended the Fire Department for its organizational work. Councilman Garrison presented a draft of a letter requesting consideration of a branch post office in Apple Valley. MOTION: of Garrison, seconded by Branning, to pass Resolution 1973-115 requesting a branch post office and approving the draft of the cover letter. Ayes - 5 - Nays - 0. Council recessed at 8:05 p.m. to attend the Planning Commission public hearings. Reconvened at 9:50 p.m. with all members present except Councilman Pearsall. Discussion of Phillips easement and agreement. MOTION: of Branning, seconded by Goodoien, to approve the agreement with Phillips, as ammended. Ayes - 4 - Nays - O. MOTION: of Garrison, seconded by Branning, to approve the Meadows Phase II agreement. Ayes - 4 - Nays - 0. Valley Commercial Park mall project discussion. for Village approval. Developer will prepare final plans VILLAGE OF APPLE VALLEY Dakota County, Minnesota Page 3 July 5, 1973 MOTION: of Goodoien, seconded by Branning, to pay the claims and bills; check # 6820 through #6877, in the amount of $1,013,855.92.
