Minutes of the meeting of the Village Council, Village of Apple Valley, Dakota
County, Minnesota, held July 11, 1973.
PRESENT: Councilmen Garrison, Pearsall and Goodoien; Clerk Asleson.
ABSENT: Mayor Largen and Councilman Branning.
Acting Mayor Pearsall called the meeting to order at 7:45 p.m. All residents
attending took part in the pledge of allegiance to the flag.
Planning Commission minutes for June 20, 1973, received.
Water and Sewer Report for May received.
Police Report for June received.
Memo on Police radar check received.
Public Works Report for June received.
MOTION:of Garrison, seconded by Goodoien, to approve the issuance of a cigarette
license to Mr. D's Pizza. Ayes - 3 - Nays - 0.
Midwestern Relay proposal discussed. Attorneys to work on final lease agreement.
Public Hearing - Palomino Cluster 1 Utility Improvements - Affidavit of publication
read and hearing called to order at 8:20 p.m. Engineer discussed proposal. Opened
to questions from the Council, then residents. There being no further disucssion,
the hearing was declared closed at 8:25 p.m.
MOTION:of Garrison, seconded by Pearsall, to pass Resolution 1973-116 ordering
preparation of plans and specs for Palomino Cluster I utility improve-
ments. Ayes - Garrison and Pearsall - Nays - Goodoien. Motion carried.
Public Hearing - Lakeside Meadows Phases II through V Utility Improvements - The
hearing was called to order at 8:27 p.m. and the affidavit of publication read.
The Engineer discussed the proposed improvements. Hearing was opened to the
Council and then to the residents. There being no further diseussion, the hearing'
was declared closed at 8:32 p.m.
MOTION:of Garrison, seconded by Goodoien, to pass Resolution 1973-117 ordering
preparation of plans and specs for Lakeside Meadows, Phase II. Ayes -
3 - Nays - 0.
Public Hearing - 132nd Street From Cedar Avenue To Greenleaf 5th Addition - Hearing
was called to order at 8:35 p.m. and the affidavit of publication read. The
Engineer described the proposed improvements. The hearing was opened to the Council
for questions and then to the residents present. See attachment for detail of
questions and answers. There being no further questions, the hearing on the improve-
ments east of Galaxie Avenue was closed and the hearing on the portion of 132nd
Street west of Galaxie was continued until the last Wednesday in September, Hearing
closed at 9:35 p.m.
Public Hearing - Farquar Hills and Adjacent Area Utility Improvements - The hearing
was called to order at 9:45 p.m. and the affidavit of publication was read. The
Engineer described the proposed improvements. The hearing was then opened to the

Council for questions, after which it was opened to the public. See attachment for
details of questions and answers. There being no further discussion, the hearing
was declared closed at 10:15 p.m.
MOTION: of Garrison, seconded by Goodoien, to pass Resolution 1973-118 approving
the plans and spece for Farquar Hills improvements. Ayes - 3 - Nays - 0.
MOTION: of Goodoien, seconded by Garrison, to pass Resolution 1973-119 directing
advertisement for bids for the above improvements to be taken August 14,
1973, at 2:00 p.m. Ayes - 3 - Nays - 0.
MOTION: of Goodoien, seconded by Garrison, to pass Resolution 1973-120 approving
the plans and specs for Project 73-38, Apple Valley Commercial Addition
Utilities, Phase I. Ayes - 3 - Nays - 0.
MOTION: of Garrison, seconded by Goodoien, to pass Resolution 1973-121 to advertise
for bids for August 10, 1973, at 2:00 p.m. on the above project. Ayes - 3 -
Nays - 0.
MOTION: of Garrison, seconded by Goodoien, to pass Resolution 1973-122 approving the
plans and specs for Project 73-46, Valley Commercial Park let Addition
Streets. Ayes - 3 - Nays - 0.
MOTION: of Goodoien, seconded by Garrison, to pass Resolution 1973-123, directing
advertisement for bids on the above project to be taken on August 10, 1973,
at 2:00 p.m. Ayes - 3 - Nays - 0
Recommendation from Urban Affairs Committee on proposed tree ordinance - received
for study.
Palomino Cluster II Preliminary Plat - discussion on problems of emergency vehicles
or delivery trucks,
MOTION: of Goodoien, seconded by Garrison, to table the preliminary plat of Palomino
Cluster II and request the developer to prepare proposed solutions to the
problems discussed. Ayes - 3 - Nays - 0.
MOTION: of Garrison, seconded by Pearsall, to approve the issuance of a building per-
mit for a 7-11 store on Outlot C, Apple Valley 11th Addition, as recommended
by the Planning Commission subject to landscape plans, cedar shakes or plastic
type roofing and enclosing of the garbage area with the sign to be building
mounted. Ayes -3 -Nays - 0.
MOTION: of Garrison, seconded by Goodoien, to grant the building permit for Kentucky
Fried Chicken as recommended by the Planning Commission on Lot 7, Block 2,
Valley Commercial Park 1st Addition, subject to the building inspector's
approval of plans. Ayes - 3 - Nays - 0.
MOTION: of Garrison, seconded by Pearsall, to approve the final development plan for
Phase I, Farquar Hills Addition, subject to the agreement on the phasing

MOTION: of Goodoien, seconded by Garrison, to approve the sideyard setback
variance for two feet to Lot 5, Block 5, Palomino Hills 3rd Addition.
Ayes - 3 - Nays - 0.
MOTION: of Garrison, seconded by Goodoien, to approve the rear yard variance for
115 Chaparral Drive. Ayes - 3 - Nays - 0.
MOTION: of Garrison, seconded by Goodoien, to approve the agreement for bus
shelters subject to the approval of the Village Attorney. Ayes - 3 -
Nays - 0.
MOTION: of Goodoien, seconded by Garrison, to authorize the Park Director to nego-
tiate with the School District to pay a portion for the installation of
a sprinkler at Valley Jr. High when we have the funds available. Ayes -
3 - Nays - 0.
MOTION: of Goodoien, seconded by Garrison, to approve the issuance of an excava-
tion permit for the road portion of Palomino Cluster I development, which
would be a 30-foot cut as recommended by the building inspector, and to
authorize the building inspector to allow them to further excavate. Ayes -
3 - Nays - 0.
MOTION: of Goodoien, seconded by Garrison, to authorize the issuance of an exca-
vation permit for Farquar Hills Addition for the roads. Ayes - 3 - Nays - 0.
MOTION: of Garrison, seconded by Goodoien, to grant a permit for parking of a
mobile home at 13524 Pilot Knob Road subject to periodic review. Ayes -
3 - Nays - 0.
MOTION: of Goodoien. seconded by Garrison, to approve the increase of the salaries
of the Fire Chief and Fire Marshal to $125.00 per month effective July 1,
1973, as recommended by the Administrator. Ayes - 3 - Nays - 0.
MOTION: of Garrison. seconded by Goodoien, to approve the salary increase to
Charles Ross in the amount of $52.00 effective July 1, 1973. Ayes - 3 -
Nays - 0.
MOTION: of Goodoien. seconded by Garrison, to approve the salary adjustment for
Roger Page in the amount of $50.00 effective July 1, 1973, and to terminate
the probationary period. Ayes - 3 - Nays - 0.
MOTION: of Garrison. seconded by Goodoien, to approve the agreement authorizing
the Metropolitan Sewer Board to cross 160th Street to hook up with the
Apple Valley Eastern Trunk. Ayes - 3 - Nays - 0.
MOTION: of Goodoien, seconded by Garrison, to pay the claims and bills, checks
numbered 6878 through 6949, in the amount of $36,929.57. Ayes - 3 -
Nays - 0.
MOTION: of Goodoien. seconded by Garrison, to adjourn. Unanimously carried.
