Minutes of the meeting of the Village COuncil, Village of Apple Valley, Dakota
County, Minnesota, held September 19, 1973.
PRESENT: Mayor Largen; Councilman Branning, Garrison, Goodoien and Pearsall
(attended at 7:05 p.m.); Clerk Asleson.
ABSENT: None.
The Mayor called the meeting to order at 7:00 p.m.
Public Hearing - assessments for storm sewer, Valley Commercial Park, Apple Valley
Commercial and adjacent areas - The Mayor called the hearing to order at 7:00 p.m.
and read the affidavit of publication. The Administrator described the assessments.
The hearing was opened to the Council and then to the public.
Councilman Pearsall attended at this time.
Ray Brown - protested his assessment. He felt his property was not benefited.
There being no further discussion, the hearing was declared closed at 7:20 p.m.
Public Hearing - assessments - Pennock Avenue utilities - called to order at 7:20 p.m.
and affidavit of publication noted. The Administrator described the area involved.
Councilman Branning questioned the double footage assessments on 147th Street and
Pennock which were explained. There being no further discussion, the hearing was
declared closed, at 7:25 p.m.
Transient Merchant's License for The Music Staff, held.
MOTION: of Goodoien, seconded by Branning, to pass Resolution 1973-167, proclaiming
the week of September 24 through September 30, 1973, as Crime Prevention
Week. Ayes - 5 - Nays - 0.
Discussion on Burnsville letter to Palomino Development Corporation regarding drain-
age from Lakeside Meadows into Lake Alimagnet. Discussion on possible meeting to be
arranged.
Public Hearing - Street Improvements - Pennock, 149th, and 147th Streets - called to
order at 7:35 p.m., and affidavit of publication noted. The Administrator described
the improvements assessed. There being no discussion, the hearing was declared
closed at 7:40 p.m.
MOTION: of Garrison, seconded by Branning, to pass Resolution 1973-168, ordering
the 132nd Street utility improvements, Project 73-52. Ayes - 4 - Nays -
1 (Goodoien),
MOTION: of Branning, seconded by Pearsall, to pass Resolution 1973-169, directing
the Engineer to prepare plans and specifications for Project 73-52. Ayes -
4 - Nays - 1 (Goodoien).
MOTION:of Pearsall, seconded by Branning, to pass Resolution 1973-170, approving
the plans and specifications on 132nd Street, Project 73-52. Ayes - 4 -
Nays - 1 (Goodoien).

MOTION: of Pearsall, seconded by Branning, to pass Resolution 1973-171 authorizing
advertisement for bids for Project 73-52 to be received at 2:00 p.m. on
October 23, 1973. Ayes - 4 - Nays - 1 (Goodoien).
MOTION: of Pearsall, seconded by Branning, to authorize the Engineer tO include
water trunks and laterals to the School property on 133rd Street and
Galaxie in the above bid advertisement. Ayes - 4 - Nays - 1 (Goodoien).
Public Hearing, Valley Commercial Park - previously unassessed trunks and treatment
plant charges - hearing called to order at 7:40 p.m. and affidavit of publication
noted. The Administrator described the roll. There being no discussion, the hear-
ing was declared closed at 7:50 p.m.
MOTION: of Pearsall, seconded by Branning, to pass Resolution 1973-172 approving
the four assessment rolls. Ayes - 5 - Nays - 0.
MOTION: of Goodoien, seconded by Garrison, to pay the claims and bills, checks
numbered 7420 through 7457, in the amount of $127,699.41. Ayes - 5 -
Nays - 0.
MOTION: of Branning, seconded by Goodoien, to waive the building permit fee for
the School District to $1.00 plus the SAC charge and the surtax for the
new school on Galaxie Avenue. Ayes - 5 - Nays - 0.
MOTION: of Pearsall, seconded by Branning, to adjourn. Unanimously carried.
