Minutes of the meeting of the Village Council, Village of Apple Valley, Dakota
County, Minnesota, held September 26, 1973.
PRESENT: Mayor Largen; Councilmen Branning, Garrison and Goodoien; Clerk Asleson
ABSENT: Councilman Pearsall
The Mayor called the meeting to order at 7:30 p.m. All residents attending took
part in the pledge of allegiance to the flag. Rev. Largen gave the invocation.
MOTION: of Branning, seconded by Goodoien, to approve the minutes of the meeting
of August 29, 1973, with the corrections in the two motions passing
Resolutions 1973-155 and 1973-156 as written. Ayes - 3 - Nays - 0
(Garrison abstained).
MOTION: of Goodoien, seconded by Garrison, to approve the minutes of the meeting
of September 12, 1973, as written. Ayes - 4 - Nays - 0.
Planning Commission minutes of September 5, 1973, were received.
Gross Payroll Reports of September 7th and 21st, 1973, were received.
August Public Works Report, Police Report and Fire Marshal Report were received.
Fire Department letter relating to 4th of July, 1974, and Fire Chief Reports for
March through June were received. Fire Chief was told the Fire Department could
move ahead with plans for 4th of July, 1974.
August Park Report was received.
Attorney's letter on the appointment of a Deputy Forester was received. It was
noted that his responsibilities and duties are as defined by the Forester.
Memo on meeting with Greenleaf residents on proposed walkway in Greenleaf 4th Addition
was received. Councilman Branning commented on the meeting and stated the residents
of that area definitely do not want the walkway. Mayor noted the walkway would not
be built without approval of the residents in that area.
Erwin Ulrich commented on the Tree Disease Ordinance and basically stated that
because the cause of oak wilt disease has not been absolutely pinpointed and
because of the rural nature of Apple Valley, the cost of implementing the tree
removal program would be very expensive if done on an area-wide basis. The Mayor
stated the Council does not intend to remove trees on a large scale but the ordinance
is intended mainly to remove diseased trees in residential areas where they can cause
a problem. Councilman Branning commented on the probability of the County imple-
menting a similar ordinance on a County-wide basis.
Jerry Bell presented the two land options on the property for a proposed golf course
and noted the modifications needed before they could be signed. He then presented
a financial analysis of the bonds prepared by Juran & Moody, Inc. and then
read the proposed question on the bond sale he recommended be placed on the November
6th ballot
MOTION: of Branning, seconded by Garrison, to pass Resolution 1953-173, determining
the necessity of developing a municipal golf course, issuing bonds to pay
for the same and calling an election submitting the question to the voters.

MOTION: of Ooodoien, seconded by Branning, to pass Resolution 1973-174 providing
for street lighting in all new subdivisions. Ayes - 4 - Nays - 0.
MOTION: of Garrison, seconded by Largen, to pass Resolution 1973-175 opposing
liquor price advertising in publications but allowing it on the premises.
Ayes - 3 - Nays - 1 (Goodoien).
Attorney Sieben commented on the status of the on-sale liquor ordinance and stated
a draft should be ready for the October 3rd meeting. He was directed to prepare
a proposed question for on-sale liquor and also a question for Sunday Liquor Sales
to be considered for the November 6th ballot.
John Voss was asked to prepare a memo on the commercial area ordinance status with
particular reference to proposed sites for liquor sales.
MOTION: of Garrison, seconded by Goodoien, to approve the Planned Development
Agreement for Greenleaf Phase III with the individual costs of Fairgreen
Avenue, 140th Street and Pilot Knob Road to be inserted. Ayes - 4 - Nays - O.
MOTION: of Goodoien, seconded by Garrison, to approve the Development Agreement
for Greenleaf 6th Addition. Ayes - 4 - Nays - 0.
MOTION; of Garrison seconded, by Branning, to approve the Development Agreement
for Palaomino Cluster I with the addition of the $300.00 per acre sanitary
sewer charge related to the Burnsville Agreement and the zoning change to
RCL rather than M-1. Ayes - 4 - Nays - 0.
Status report on Valley Commercial Park 2nd Addition - tabled.
MOTION: of Branning, seconded by Garrison, to adopt Ordinance No. 132 changing
the zoning from RCL Planned Development in Palomino Cluster I. Ayes -
4 - Nays - O.
Letter from Palomino Development concerning five acrea of land (Tract Q) at Rimroek
Road and Garden View Drive was received, Jerry Bell was directed to report on the
feasibility of the property and the cost.
Items on utilities in Outlot C, Apple Valley East - tabled.
MOTION: of Goodoien, seconded by Garrison, to approve the remaining portion of
Wildwood Phase I final development plan, subject to the phasing agreement
to be submitted for Council action at a later date. Ayes - 4 - Nays - 0.
MOTION: of Goodoien seconded by Garrison, to deny the petition of First Federal
Savings & Loan for Hastings for remodeling the service station at 42 and
Cedar because adequate plans and specifications were not presented nor did
petitioners appear at Planning Commission meeting. Ayes - 4 Nays 0.
MOTION: of Branning, seconded by Ooodoien, to pass Resolution 1973-176, directing
preparation of plans and specifications for utilities to serve an additional
76 townhouses in Wildwood. Ayes - 4 - Nays - 0.

MOTION: of Garrison, seconded by Goodoien, to approve the final plat of Barth 1st
Addition subject to payment of the Burnsville sanitary sewer charge and
a cash donation for park purposes in lieu of land. Ayes - 4 - Nays - 0.
MOTION: of Branning, seconded by Garrison, to approve the installation of a street
light on the County Road 42 frontage road in the vicinity of 84 County
Road 42. Ayes - 4 - Nays - 0.
Further consideration of the Civil Defense ordinance was tabled.
MOTION: of Branning, seconded by Goodoien, to approve the rate amendment to the
engineering contract with Bonestroo, Rosene, Anderlik & Asaociates, Inc.,
to be effective October 1, 1973. Ayes -4 - Nays - 0.
MOTION: of Garrison, seconded by Branning, to participate in the lake water quality
sampling program the Village of Eagan is carrying out with the Minnesota
Department of Natural Resources for one test of Farquar, Long Lake and
Alimagnet Lake costing approximately $450.00. Ayes - 4 - Nays - 0.
Salary review for Ronald Bray was held for further review.
MOTION: of Garrison, seconded by Branning, to approve a salary increase for James
Heidemann in the amount of $25.00 per month effecfive September l, 1973.
Ayes - 4 - Nays - 0.
MOTION: of Goodoien, seconded by Garrison, to approve promotion of Neal Heuer to
a permanent position in Water and Sewer Maintenance at a salary of $735.00
per month effective October 1, 1973. Ayes - 4 - Nays - 0.
MOTION: of Branning, seconded by Goodoien, to approve, effective October 1, 1973,
an annual salary increase of $818.00 per year for the Park Director, Jerry
Bell, with the additional job duties of Administrative Assistant and a
subsequent increase.of $327.00 annually effective January 1, 1974. Ayes -
3 - Nays - 1 (Largen; who noted he agreed with the salary adjustments, but
not the Administrative Assistant job title addition.)
MOTION: of Goodoien, seconded by Branning, to approve a salary increase for Kirk
Hawes in the amount of $21.00 per month effective September 22, 1973, with
another salary review December 31, 1973. Ayes - 4 - Nays - 0.
Mayor read letter from State Senator Clarence Purfeerst regarding Senate Subcommittee
of Highways hearing to he held September 27, 1973, at Faribault on highway and trans-
portation problems. John Gretz was asked to attend that. meeting
MOTION: of Goodoien, seconded by Garrison, to approve a transient merchant's
license for The Music Staff to give music lessons in homes. Ayes - 4 -
Nays - 0.
MOTION: of Goodoien, seconded by Garrison, to approve purchase of 1973 Ford demon-
strator car with police package and warranty by Westdale Ford up to 20,000
miles for $2,977.97 and radio for $53.62 from Westdale Ford to be paid by
Police Relief Funds. Ayes - 4 - Nays - 0.

Councilman Branning commented on September 25, 1973, meeting with Zoo Board he,
Jerry Bell and John Gretz attended. He stated then had planned to have the Zoo
property fenced this fall but because of slow acquisition process, will not be
done.
MOTION: o4 Goodoien, seconded by. Garrison, to. pay the claims and bills, gheck
numbers 7458 to 7497 in the amount of $62,408.80 Ayes - 4 - Nays - 0.
MOTION: of Goodoien, seconded by Branning, to adjourn. 'Ayes - 4 -Nays - 0.
