Minutes of the meeting of the Village Council, Village of Apple Valley, Dakota County,
Minnesota held October 10, 1973.
'PRESENT: Mayor Largen; Councilmen Branning, Garrison and Goodoien; Clerk Asleson
ABSENT: Councilman Pearsall
The Mayor called the meeting to order at 7:35 p.m. Ail residents took part in the
pledge of allegiance to. the flag. Mayor Largen gave the invocation.
Minutes
MOTION: of Garrison, seconded by Branning, to approve the minutes of the meeting of
October 3, 1973 as written. Ayes - 3 - Nays - O; Goodoien abstaining.
MOTION: of Goodoien, seconded by Garrison, to pass Resolution 1973-178, providing
Tax Levy Payable 1974. Ayes - 4 - Nays - O.
MOTION: of Branning, seconded by Goodoien, tO pass Resolution 1973-179, splitting
Various assessments on outlots in Palomino Lakeshore Addition for Palomino
Development Corporation. Ayes - 4 - Nays - 0.
MOTION: of Garrison, seconded by Branning, to authorize issuance of 3.2 non-
intoxicating liquor license to John Kelly of Mr. D's Pizza, contingent
upon the new location meeting the necessary requirements. Ayes - 4 -
Nays - 0.
September Police Report received.
August Treasurer's Report received.
MOTION: of Branning, secended by Garrison, to pass Resolution 1973-180, adjusting
and closing various fund balances. Ayes - 4 - Nays - 0.
September Park Report received.
October 5, 1973 order concerning Crystal Lake pumping permit- noted received.
Letter for consideration requesting that appointment be made to a County-wide
committee to determine use of old courthouse. Held until next week.
The Mayor stated he was appointed to the Criminal Justice Council for Dakota County,
to start November 1st.
MOTION: of Garrison, seconded by Branning, to pass Resolution 1973-181, determing
that the Village of Apple Valley should be allowed to issue special on-
sale liquor licenses, and to have an election for the voters to decide the
issue. Ayes - 4 - Nays - 0.
MOTION: of Garrison, seconded by Goodoien, to pass Resolution 1973-182, determining
the necessity and expendiency for the sale of liquor on Sunday, in res-
taurants and motels only, be allowed in the Village of Apple Valley, and
to have an election for the voters to decide the issue. Ayes - 4 - Nays - 0.
MOTION: of Garrison, seconded by Branning, to pass Resolution 1973-183, appointing
the election.judges for the November 6, 1973 election. Ayes - 4 - Nays - 0.

MOTION: of Goodoien, seconded by Garrison, to pass Resolution 1973-184, waiving
subdivision regulations for Outlot C of Greenleaf 4th Addition and OUtlot
A of Greenleaf 1st Addition. Ayes - 4 - Nays - 0.
Public Hearing, Valley South Utilities and Streets- Mayor called the hearing to order
at 8:10 p.m. and read the affidavit of publication. The Engineer described the proposed
improvements. The hearing was then opened to the Council for questions. Mayor Largen
questioned the width df Garrett. Councilman Goodoien asked if there was any other bene-
fitted property and was told that there was the property behind Garrett. Hearing then
opened to the residents. There being no questions, the hearing was declared closed at
8:17 p.m.
Public Hearing, Valley Commercial 2nd Addition Streets and 145th Street on Carroll
property. Mayor called the hearing to order at 8:17 p.m. and read affidavit of
publication. Engineer Rosene described proposed improvement. Hearing was opened
to Council for questions. Mayor asked how far North Pennock was going - 250 feet.
Also, question on Southern 1/2 of 145th Street. It needs to be paid fpr; not to be
on green acres. Discussion on this with Bill Carroll, and Messrs Cottle and Herman.
They also questioned the amount of the assessment on both Pennock and 145th Street and
the timing on the project. There being no further discussion, the hearing was declared
closed at 8:27 p.m.
Valley Commercial Park 2nd Addition ponding easement discussed. To be discussed again
at next meeting.
Letter from Minnesota Zoological Society- re 3rd Family Day. Council invited - Letter
read by Mayor.
MOTION: of Garrison seconded by Goodoien, to authorize the bus shelter at County 42
Garden View as per the drawing submitted, with the Village to put in the
concrete slab, with the costs to be billed back to the MTC. Ayes - 3 - Nays -
1 (Branning).
Councilman Garrison said he would like the problem of Tract Q at Rimrock and Garden
View Drive settled. ''
MOTION: of Goodoien, seconded by Branning, to cancel the meeting of October 31, 1973.
Ayes - 4 - Nays - 0.
Councilman Branning discussed the land acquisition for additional right-of-way on Ellice
Trail,
Mayor Largen reported he had met with Orrin Thompson to discuss road problems in the
forthcoming Greenleaf additions. (Through the 12th).
MOTION: of Branning, seconded by Garrison, to pay the claims and bills; check #7520
through #7645, in the amount of $1,381,392.90 Ayes - 4 - Nays - 0.
Councilman Garrison would like a resolution drawn for the County to run a study for
signal lights at County Road 42 and Pennock and also at Cedar Avenue and 147th Street.
Councilman Branning discussed the decibal rating on the trucks passing by the Carroll
farm on County Road 42.
