PRESENT: Mayor Largen; Councilmen Branning, Garrison, Goodoien and Pearsall; Clerk Asleson ABSENT: None The Mayorcalled the meeting te order at 7:30 p.m. All residents attending took part in the pledge of allegiance to the flag. coUncilman Garrison gave the invocation. MOTION: of Goodoien, seconded by Branning, to approve the minutes of the meeting of October 22, 1973 as written. Ayes.- 3 - Nays - 0; Garrison and Pearsall abstaining. MOTION: of Garrison, seconded by Pearsall, to approve· the minutes of the meeting of · November 2, 1973, as Written. Ayes - 4 - Nays - O; Goodolen abstaining. MOTION: of Branning, seconded by Pearsall, to pass Resolution 1973-196, renumbering Resolution 1973-178 to ResolutiOn 1973-177A. Ayes - 5 - Nays - O. Barbara Savanick discussed with the Council three objections of the Nordic Square proposal, and the petition she submitted requesting an environmental impact study of the area prior to the rezoning. The Council discussed these objections with the residents that were present. The objections were: 1. County Road 46 - she felt the upgrading of the road would be considerably delayed by this. 2. The rerouting of the road, as shown in their plan, did not line up with our Comprehensive Plan. 3. The environmental impact of the black top plant, especially so near a pond open to the water table. Mrs. Jackie Merrill submitted a petition from resients of Apple Valley, opposing any additional gravel operations in the Village , noted received. MOTION: of Garrison, seconded by Goodoien, to amend the July 25, 1973 development agreement with Nordic Square to eliminate reference to the density figures on Exhibit 19, to strike the rest of the sentence on p. 147, Par. 2, after the word "plan", to add a sentence that states the petitioner incur the cost of an environmental impact study to the extent that the law allows, and that the wording on p. 6, regarding the ponding area be rewritten similar to other contracts, by the Village Attorney. Ayes - 4 - Nays - 1 (Branning). Motion carried. MOTION: by Branning, (no second) to request the Council to turn the petition back to the Planning Commission for another public hearing regarding the changesthat have taken place in the plan over the past year. MOTION: of Pearsall, seconded by Garrison, to pass Ordinance # 134, rezoning the Nordic Square proPerty in the S½ of Section 36 to Temporary Sand and Gravel Zoning, over a base zoning of Agricultural. Ayes - 4 - Nays - 1 Branning). Motion carried. VIILAGE OF APPLE VALLEY Dakota County, Minnesota November 14, 1973 Page 2 MOTION: of Goodoien, (no second) to concur with the recommendation of staff regarding the ponding in Apple Valley Commercial 2nd Addition, and approve Exhibit B of the staff memo dated November 5, 1973. MOTION: of Pearsall, seconded by Branning, to refer to the Village Attorney for rec- ommendation on the procedure for the direct purchase of two of the four acres required for ponding in Valley Commercial 2nd, provided Vista Development dedicates one acre and George Lawrence purchases the reminaing acre. Ayes - 5 - Nays - 0. MOTION: of Garrison, seconded by Pearsall, to have the Engineer prepare a preliminary report on utilities for Palomino Cluster Il. Ayes - 5 - Nays - O. MOTION: of Goodoien, seconded by Pearsall, to table the overpass discussion until the Engineer is in attendance.. Ayes -.3 , Nays - 2 (Garrison and Largen). Motion carried. MOTION: of Goodoien, seconded by Garrison, to concur with the park director's rec- ommendation and not purchase the five acres of property owned by Palomino and known as Tract Q, located South of Rimrock Drive along Garden View Dr. Ayes - 5 - Nays - 0. MOTION: of Goodoien, seconded by Garrison, to authorize prepared a preliminary report for additional fire facilities in Apple Valley. Ayes - 5 - Nays - O. MOTION: of Branning, seconded by Pearsall, to approve Phase I of the contract with Don Ripple for the golf course planning, subject to the Attorney's approval of the wording. Ayes - 5 - Nays - 0. The Public Works Director reported that traffic counts had been taken at Pennock and 42, and also at Cedar end 147th, but the counts still do not warrant signals. The County Traffic Engineer is looking into other possibilities. MOT ION: of Branning, seconded by Garrison, to accept the recommendation and award the bid for snow plowing to Fischer Construction Company; Fischer being the only bidder able to meet the specifications in the best interest of the Village. Ayes - 5 - Nays - 0. MOTION: of Garrison, seconded by Pearsall, to authorize advertising for bids for gasoline, to be taken December 3, 1973. Ayes - 5 ~ Nays - O. MOTION: of Pearsall, seconded by Gaodoien, to approve the salary increase for Charlie Kohls in the amount of $30.00 per month, effective November l, 1973. Ayes - 5 - Nays - O. MOTION: of Goodoien, Seconded by Branning, to cancel the Council meeting of November 21, 1973. Ayes - 5 - Nays - 0. MOTION: of Pearsall, seconded by Branning, to approve issuance of a transient merch- ants license to Scout Troop 230 to sell Christmas decorations. Ayes - 5 - Nays - 0.
