HomeMy WebLinkAbout1973/11/28VILLAGE OF APPLE VALLEY Dakota County, Minnesota Minutes of the meeting of the Village Council, Village of Apple Valley, Dakota County, Minnesota held November 28, 1973 PRESENT: Mayor Largen; Councilmen Branning, Garrison, Goodoien, and Pearsall; Clerk Asleson ABSENT: None . The Mayor called the meeting to order at 7:30 p.m. All residents attending took part in the pledge of allegiance to the flag. Mayor Largen gave the invocation. Bids on TemPorary Improvement Bonds were opened and read aloud. James Olsen then proceeded with the bid tabulation. MOTION: of Branning, seconded by Garrison, to approve the minutes of the meeting of November 7, 1973, as written. Ayes - 5 - Nays - O. Discussion on preliminary plan of pedestrian overpass. MOTION: of Goodoien seconded by Pearsall, to postpone any final action On the over- pass until at least 90 days after the signals are operable at County Road 42 and Garden View Drive. MOTION: of Largen, seconded by Branning to amend the previous motion to include that if due to the delay, the estimated costs increase up to 10%; that such increase not be a negative factor in future considerations. Ayes - 3 - Nays - 2 (Goodoien and Pearsall). Motion carried. Question called on first motion. Ayes -4 - Nays - 1 (Branning). Motion carried. MOTION: of Branning, seconded by (no second) to proceed with the final plans as per the engineering contract. With the plans to include alternates related to the Elm Drive closing considerations. MOTION: of Goodoien, seconded by Pearsall, to pass Resolution 1973-197, awarding the bids for $1,070,000 Temporary Improvement Bonds to First National Bank of St. Paul, the low bidder, at a net interest rate of 5.0166%. AyeS. 5 Nays - .0. MOTION: of Garrison, seconded by Branning, to approve the sewer easement of the Lapaz Property between Fairgreen and Greealeaf 6th Addition as drafted by the Village Attorney with the Mayor and Clerk to sign the necessary papers. Ayes - .5 - Nays - O. MOTION: of Branning, seconded by Pearsall, to approve the purchase of the road' easement of Ellice Trail at intersection with Fairgreen Avenue from Marvin Johnson with the Mayor and Clerk to sign the necessary papers. Ayes - 5 - Nays - O. MOTION: of Garrison, seconded by Pearsall, to approve the Joint Powers Agreement with the Village of Rosemount on the TransUnion access from County Road 33 S. as presented. Discussion also from the complaints. Councilman Pearsall left at this time. MOTION: of Garrison, seconded by Branning, to pass Ordinance # 135, regarding On-Sale liquor licensing, with the amendments to Section 9, P.9, Section ll, P.9 and' 22, the change in the opening hours on New Years Day to 8 a.m., the change in the license dates to a calendar year basis, and adding the word "negotiable" where appropriate in relation to government bonds. Ayes - 4 - Nays- O. MOTION: of Goodien, seconded by Branning, to appoint Nick Gillen to the Dakota County Courthouse Committee. Ayes - 4 - Nays - O. MOTION: of Garrison, Seconded by Goodoien, to approve the planneddevelopment agreement for Valley Commercial Park 2nd Addition. Ayes - 4 - Nays - O. MOTION: of Goodoien, seconded by North of 145th Street of Planned Development (PD) Garrison, to pass Ordinance 136, rezoning the area Valley Commercial Park 2nd Addition to B-3 and zoning for the entire plat. Ayes - 4 - Nays - O. MOTION: of Goodoien, seconded bY Garrison, to approve the final plat of Valley CommerCial Park 2nd Addition. Ayes - 4 - Nays - O. MOTION: of Goodoien, seconded by Branning, to Pass Resolution 1973-198, ordering improve- ments for Project 73-49. Ayes - 4 - Nays - O. Nordic Properties Development agreement reviewed. Held for full Council. MOTION: of Garrison, seconded by Branning, to exercise the second option in Ulrich Golf Course land option and to pay the $700.00 option amount. Ayes - 4 - Nays - O. Draft of Civil Defense Plan - tabled. MOTION: Of Goodoien, seconded by Garrison, to concur with the staff recommendation and delete the sidewalk on 137th Street in the ?nland Project. Ayes - 4 - Nays - O. MOTION: of Garrison, seconded by Brauning, to approve the option agreement with an option price of $1,000.00 for the golf course property owned by MFM Corporation (Mr. Mickelson), 40 to 50 acres. Ayes - 4 - Nays - O~ MOTION: of Goodoien, seconded by Branning, to authorize Jerry Bell to work with the Attorney on criteria for proposals for a club house for the golf course. Ayes - 4 - Nays - O. October Police Report received. Gross Payroll report of November 16, 1973 received. Planning Commission minutes of October 17th and November 7, 1973 received. October water and sewer report received. VILLAGE OF APPLE VALLEY Dakota County, Minnesota November 28, 1973 Page 3 MOTION: of Garrison, seconded by Branning, to authorize advertising for bids for accounting equipment as per specs, with bids to be received 12-17-73 at 2:00 p.m. Ayes - 3 - Nays - 1 (Goodoien). MOTION: of Branning, seconded by Garrison, to pass Resolution 1973-199, splitting the assessments on the Inland Property. Ayes - 4 - Nays - O. MOTION: of Branning, seconded by Goodoien, to accept the Public Works Director's recommendation on damage to the liquor store parking lot and accept a settlement of $398.00. Ayes - 4 - Nays - O. MOTION: of Branning, seconded by Goodoien, to waive the bond requirements on check # 2413 (payroll) and check # 7588 (regular check), subject to the payee signing an "Affidavit of lost check", including the notation that we have issued duplicates for check #'s 3562, 3174 and 3431, prior to knowledge of State Statute requirements. Ayes - 4 - Nays - O. MOTION: of Branning, seconded by Garrison, to authorize advertising for recruitment of Street Department employee. Ayes - 4 - Nays - O. MOTION: of Goodoien, seconded by Garrison, to approve mailing the letter on water and sewer connections. Ayes - 4 - Nays - O. MOTION: of Garrison, seconded by Goodoien, to approve the disbursement of checks for the nine paid holidays to the police officers. Ayes - 4 - Nays - O. Salary items tabled for further review. MOTION: of Goodoien, seconded by Branning to pay the claims and bills; check # 7875 thru # 7950, in the amount of $270,067.95. Ayes - 4 - Nays - O.
