PRESENT: Mayor Largen; Councilmen Branning Garrison and Pearsall; Clerk Asleson ABSENT: Councilman Hollenbeck The Mayor called the meeting to order at 7:35 p.m. All residents attending took part in the pledge of allegiance to the flag. Pastor Largen of Valley Community Church gave the invocation. Old Business 1. Dakota Electric franchise. The attorney cormmented on the proposed ordinance. Council requested attorney to prepare final draft of contract for consideration February 2, 1972. 2. Brad Lemberg - review of State Aid Streets. He recommended the mile of Fairgreen between County Road 42 and 140th Street be designated as a State Aid Street. The Council is to discuss further what additional mile should be designated. MOTION:of Garrison, seconded by Branning, to pass Resolution 1972-9, designating the one mile between 140th Street and County Road 42 as a State Aid Street. Those in favor Garrison, Branning, Pearsall and Largen - opposed - none. Motion carried. New Business 1. CSAH 9- letter from Dakota County Traffic Engineer. Mr. Lemberg explained. Noted received. 2. Resolution ordering bond sale for public works garage and Whitney Drive improvements. MOTION: of Pearsall seconded by Garrison to pass Resolution 1972-10 ordering the sale of $155,000.00 General Obligation water and sanitary sewer revenue bonds, to be opened February 16 1972 at 6:30 p.m. Those in favor Pearsall, Garrison, Largen and Branning - opposed - none. Motion carried. MOTION:of Branning, seconded by Pearsall, to pass Resolution 1972-11, ordering sale of $100,000.00 Temporary Improvement Bonds, to be opened February 26, 1972 at 6:3( p.m. Those in favor Branning, Pearsall, Largen and Garrison - opposed - none. Motion carried. 3. Lakeville Fire Contract - notice of termination of fire agreement as of April 30, 1972. Received. 4. Final acceptance and payment, Greenleaf 4th Addition water and sewer. Mr. Ross and - Mr. Gretz have inspected this and recommend approval of the project. The Engineer also recommends approval. MOTION: of Branning, seconded by Pearsall, to accept the recommendations above and approve the water and sewer project in Greenleaf 4th Addition and authorize the final payment. Those in favor Branning, Pearsall, Garrison and Largen - opposed - none. Motion carried. Councilman Garrison discussed the numerous complaints he has been receiving about the ordinance on parking over 24 hours The Council requests that the police officers attempt to contact some of the people and warn them once before issuing the tag. VILLAGE OF APPLE VALLEY Jan. 26, 1972 page #2 6. Officer Alderson - police dog discussion. Councilman Garrison and Chief Corrigan commented. Councilman Branning recommended any decision on this be delayed for the present. The rest of the Council agreed. 7. Hennepin County Purchasing - submission of quantities on radios. MOTION: of Garrison seconded by Branning, to authorize the Administrator to request a 4-channel radio from Hennepin County Purchasing. Those in favor Garrison, Branning Largen and Pearsall - opposed - none. Motion carried. 8. Resolution requesting fire underwriters to re-do fire rating. MOTION: of Branning, seconded by Pearsall, to pass Resolution 1972-12~ requesting the fire underwriters to re-do our fire rating. Those in favor Branning, Pearsall, Largen and Garrison - opposed - none. Motion carried. 9. Resolution to release deposit collateral. MOTION: of Pearsall seconded by Branning to pass Resolution 1972-13, releasing $100,000 of the deposit collateral from First State Bank of Rosemount. Those in favor Pearsall, Branning, Garrison and Largen - opposed - none. Motion carried. Reports The attorney reported on the rezoning of the Roberts property. MOTION: of Pearsall, seconded by Branning, to pass Resolution 1972-14 setting the public hearing for rezoning on the Roberts property for February 16 1972 at 8:30 p.m., rezoning from I to R1C and Zone-on-Zone to Temporary Sand and Gravel District. Those in favor Pearsall Branning, Largen and Garrison - opposed - none. Motion carried. 10. Lapaz Addition development agreement. MOTION: of Garrison seconded by Pearsall, to adopt the development agreement for Lapaz Corporation with the changes on Page 1, deleting the words "or front foot as shown in the second draft. Those in favor Garrison, Pearsall Largen and Branning - opposed - none. Motion carried. Engineer 1. Change-Order on Whitney Drive project - Eng. explained. MOTION: of Pearsall seconded by Garrison to approve the Change Order #1 on Whitney Drive Improvements in the amount of $5,466.00. Those in favor Pearsall, Garrison Branning and Largen - opposed - none. Motion carried. Planning Commission & Consultant 1. Minutes of January 5, 12 and 17th received. 2. Briarwood - preliminary development plan - presented to Council. MOTION: of Pearsall, seconded by Branning to approve the Preliminary Plan for PUD~ as attached. Those in favor Pearsall, Branning, and Largen. Councilman Garrison was out of the room at this time. Motion carried. VILLAGE OF APPLE VALLEY Jan, 26, 1972 page #3 3. Special Use Permit for trailer rental- Planning Commission recommends denial of the permit. Council requested the Planning Commission to look at this a little 4. Wakely Watrud & Eaton - item tabled. 5. Proposed hearing - Poppler & Holmquist - Cedar Knolls. MOTION: of Garrison seconded by Branning to pass Resolution 1972-15 setting public hearing on preliminary plat, Cedar Knolls Townhouses for February 167 1972 at 8:30 p.m. Those in favor Garrison, Branning, Largen and Pearsall - opposed none. Motion carried. 6. Seed/Kraemer Progress Report - Planning Consultant discussed the meetings which have been held with them. 7. Recommendation on Comprehensive Plan meeting dates - dates noted and generally agreed upon. Engineer 1. Preliminary report on Eastern Trunk - He recommends hearing to be set for February 24th MOTION: of Pearsall, seconded by Branning, to pass Resolution 1972-16 setting the hearing on the Eastern trunk for March 8, 1972. Those in favor Pearsall, Branning Largen and Garrison - opposed - none. Motion carried. Trunk Storm sewer - Burnsville. Engineer discussed this as storm drainage would be coming from 35E and draining into Lake Alimagnet. Councilman Pearsall was asked to attend a meeting with the State Highway Department about this drainage problem. MOTION: of Garrison, seconded by Pearsall to approve issuance of cigarette licenses, as per attached list. Those in favor Garrison Pearsall Largen and Branning - opposed - none. Motion carried. MOTION: of Pearsall, seconded by Branning, to approve issuance of beer license as per attached. Those in favor Pearsall, Branning, Largen and Garrison - opposed o none. Motion carried. MOTION: of Branning, seconded by Garrison, to approve issuance of filling station licenses as per attached list. Those in favor Branning, Garrison Largen and Pearsall - opposed - none. Motion carried. MOTION: of Pearsall, seconded by Branning, to approve issuance of refuse hauling permits as per attached list. Those in favor Pearsall Branning Garrison and Largen - opposed - none. Motion carried. Administrator's Report 1. Pre-audit Treaurer's Report as of December 31, 1972 received. 2. December Police Report - received. 3. Gross pay list for January 14~ 1972 - received. 4. Building permit application for 2 houses in Scott Highlands 1st Addn0 received from Orrin Thompson. Question on whether or not permits should be issued. Councilman Garrison would like prospective buyer to be notified of situation as far as how close to Cedar Avenue this house would be~ with carbon copy to be sent to the Village. Building inspector to work on another solution. Claims & Bills MOTION: of Pearsall secondd by Branning to pay the bills, check #3352 thru #3431, in the amount of $317,808.86. Those in favor Pearsall Branning, Largen and Barrison - opposed - none. Motion carried. MOTION: of Pearsall seconded by Garrison, to adjourn. Unanimously carried.
