Minutes Of the meeting of the Village Council, Village of Apple Valley, Dakota
County, M/nnesota, held April 26, 1972.
PRESENT: Mayor Largen; Councilmen Garrison, Hollenbeck and Branning; Clerk
Asleson.
ABSENT: Councilman Pearssll. ·
The Mayor called the meeting to order at 7:30 p.m. All residents attending
took part in the Pledge of allegiance to the flag. Pastor Strom of Mt. Olivet
Assembly of. God gave the invocation.
Minutes
MOTION: of Branning, seconded by Garrison, to approve the. minutes of the meeting
of April 5, 1972, as written. Ayes - 4, Nays - O.
MOTION: of Garrison, seconded by Hollenbeck, to approve the minutes of the
meeting of April 12, 1972, as written. Ayes - 4, Nays - O.
MOTION of Branning, seconded by Hollenbeck, to approve the minutes of the
meeting of April 17, 1972, as written. Ayes - 4 Nays - O.
WWTC Proposal
MOTION: of Garrison, seconded by Hollenbeek, to go on record as being willing
to help WWTC Radio with any assistance they may need, to cooperate with
them and the Zoo Board on this program and to instruct the Police Chief
to help in the traffic and crowd control. Ayes - 4, Nays - O.
MOTION: of Garrison, seconded by Largen, to table the cat ordinance. Ayes - 2,
Nays - 2 (Brauning & Hollenbeck).
MOTION:. of Hollenbeck, .seconded by Branning, to discuss the cat ordinance
later on this evening. Ayes .~ 3, Nays - i (Largen).
MOTION: Of Branning, secondedby Hollenbeck, to pass Resolution 1972-58, which
states, based on present information, the Council's favored location
for C.R. 38, between Garden View-Drive and C.R. ll. Ayes - 4, Nays - O.
Engineer Rosene reported on a meeting held April 20th regarding Burnsville Cross,
town. He was instructed to draft a letter for the Council approval at the next
meeting.
Whitney Drive street Vacation - Public Hearing. The Mayor Called the hearing
to order at 8:00 p.m. and read the affidavit of-publication. The portion of
the street to be vacated Was located On the map. The Attorney brought up the
legal limitation on the lapse of time between the hearing and the actual vaca-
tion of the street, and sale it would be too long. He suggests we actually
va6ate the street and just use it until such time as the Village wants it Closed.
There being no further disctbssion, the hearing was declared closed at 8:15 p.m.
Coast-to-Coast Outside Sales. Tabled until later in the evening.
Water & Sewer Report for March received.

MOTION: of Garrison, seconded by Branning, to approve the issuance of a transi-
ent merchant license for the Church of the Risen Savior. Ayes - 4~ Nays - O.
Payroll Report for April 21, 1972~ received.
Hiring of policeman tabled for one week.
MOTION: of Garrison, seconded by Branning, to authorize the Administrator to
hire William B. Smith, Jr., for temporary summer accounting help. Ayes -
3, Nays - O Hollenbeck abstaining.
MOTION: of Garrison, seconded by Branning to renew the gravel permit for North-
western Sand & Gravel for the 1972 calendar year. Ayes - 4, Nays - O.
Engineer's Report
1. Schmidthuber Letter - grading problem - staff to get more details about this.
9. Gradingplan on well site.
MOTION: of Branning, seconded by Hollenbeck, to authorize the Engineer to prepare
the grading plan for the well site so that the gravel can be removed per
our agreement. Ayes - 4, Nays - O.
3. Fairgreen Avenue - state aid status reviewed.
Planning Commission and Consultant
t. Report on outside sales - The opinion of the Planning Commission is as follows:
a. Sidewalk sales allowed on a limited basis. (Twice a year.)
b. Carload sales, etc. - on a similar basis as above.
c. Outdoor sales in retail commercial district - also should be allowed,
as a .conditional use, but should be screened, controlled and orderly,
and to go with the architecture of the building.
2. Minutes of the Planning Commission meeting of April 12, 1972, received.
3. Griswold-White preliminary plat approval.
MOTION: of Hollenbeck, seconded by Branning, to pass Resolution 1972-59, approving
the preliminary plat of the Griswold-White property as recommended by
the Planning Commission. Ayes - 4, Nays - O.
4. Minnehaha Falls Nursery temporary building permit. Planning Commission opinion
on this was read. Council concurs with the action of the Planning Commission.
MOTION: of Hollenbeck, seconded by Branning, to pass Resolution 1972-60, setting
a public hearing for May 17 1972, for subdivision and conditional use
permit for Alexander Construction Company. Ayes - 4~ Nays - O.
Councilman Garrison read the cover letter for the Council's application for the
C. C. Ludwig Award for Distinguished Municipal Service. They are nominating Mr.
Erwin Ulrich, Chairman of the Planning Commission for this award. He also noted
the many support letters that had been received.

MOTION: of Garrison, seconded by Branning, to submit the application nomina-
ting Erwin Ulrich for the. C.C. Ludwig Award. Ayes - 4, Nays - O.
Mayor Largen left at this time.
MOTION: of Garrison seconded by Branning, to nominate Mr. Hollenbeck to be
acting Mayor. Ayes - 3, Nays - O.
MOTION: of Branning, seconded by Garrison, to grant a 15-foot variance to
Coast-to-Coast, at the recommendation of the Planning Commission.
Ayes - 2, Nays - 1. (Hollenbeck)
MOTION: of Garrison seconded by Branning, to approve the conditional use per-
mit to January l 1975, subject to yearly review and the other details
outlined in the Planning Commission motion attached. Ayes - 2, Nays -
1. (Hollenbeck)
Planning Commission recommends denisl of the permit for U-Haul Trailers.
Councilman Brmnning said this is a needed service for our community.
MOTION: of Hollenbeck, to deny the permit as recommended by the Planning
Commission. No second.
MOTION: of Branning, seconded by Garrison, to grant the conditional use permit
to U-Haul Company on the basis of a time period to January l, 1973,
subject to revocation of the permit by a lO-daywritten notice and to
refer this back to the Planning Commission for the details of the per-
mit. Ayes - 2, Nays - 1. (Hollenbeck) Motion carried.
Cat Ordinance - Coancil and Admin/strator reviewed ordinance together. To be
on next week's agenda.
Councilman Branning reported on the meeting of the long and short range plan-
ning committee for the School District on April 25th.
MOTION: of Garrison, seconded by Branning, to adjourn. Unanimously carried.
