HomeMy WebLinkAbout1969/01/20 Village of Apple Valley Dakota County, Minnesota Minutes of the Regular Meeting of the Apple Valley Village Council held on January 20, 1969 at 7:30 p. m. PRESENT: Mayor Largen Councilmen: Pearsall, Garrison, Branning & Ho1.].enbeck Clerk, C. Strunk Mayor Laxgen called the meeting to order. All attending participated in the Pledge of Allegiance to the Flag. Reverend Gerhard Knutson presented the Invocation for the meeting. MOTION of Pearsall, seconded by Hollenbeck, the minutes of the Regular Meeting of January 6, 1969 be accepted as written. Said minutes to be published in the next issue of the Dakota County Tribune. Lotion duly carried. Mayor Largen read the attached letter of greeting from the Mayor, Council and Staff of the Village of Burnsville. Our staff extending a "thank you" to Burnsville for their correspondence. Attorney McMenomy discussed the petition as submitted by Mrs. Agnes Scott requesting the name of LEBANON be restored to the community - as the Village of Lebanon. McMenomy pointing out the leek of the required number of names on said petition. MOTION of Garrison, seconded by Pearsall, McMenomy be authorized to return the petition to Mrs. Scott along with a letter from the attorney explaining the legal interpretation of the law regarding petitions for the changing of the name. Motion duly carried. MOTION of Hollenbeck, seconded by Branning, tabling action on the changing the bonding of village employees, pending further discussion. Motion duly carried. Attorney McMenomy informed the council and mayor the 1969 census figures would be determined at 5,143 in accordance with the findings of the Minnesota Municipal Commission Incorporation Order. MOTION of Pearsall, seconded by Garrison, instructing the village engineer to contact the State Highway Department pertaining to participation in the Municipal Street Aid Program. Motion duly carried. Attorney McMenomy submitted material on an ordinance covering salaries of the mayor and councilmen. MOTION of Branning, seconded by Pearsall, unanimously passed, to adopt Ordinance #55, Establishing the Salaries of the Mayor and Councilmen. Mayor to receive $200 per month and councilmen $150; retroactive to January 1, 1969. Motion as passed in the minutes of the meeting of January 6, 1969 is hereby rescinded. Motion duly carried. j MOTION of Branning, seconded by Pearsall, unanimously passed, to approve the letter of intent - January 20, 1969 - copy hereto attached; submitting said letter along with the signed Burnsville-Lebanon Sewer Agreement. Branning ammending said motion making it subject to the Utilities Commission approval. Motion duly carried. Village of Apple Valley Minutes of Meeting of January 20, 1969 Page 2 V McMenomy submitted to the Council the deed to Outlots D and E, Apple Valley 11th Addition and Outlot A, Apple Valley 12th Addition. Said acceptance having been authorized subject to additional work being done by Land Holding Com~ahy, and the approval of the Park Commission. Recess was called at 8:45 to enable the Utilities Commission to review the proposed water loop of the Apple Valley and Palomino Hills Water Systems. MOTION of Hollenbeck, seconded by Garrison, unanimously passed, a Public Heaxing be set for Wednesda~r, February 5, 1969 at 7:30 p. m. to consider the overall development plan for Scott Highlands Greenleaf Addition No. III. Motion duly carried. MOTION of Hollenbeck, seconded by Pearsall, unanimously passed, to hold a Public Hearing on February 5, 1969 at 7:30 p.m. for the rezoning of the Ray Brown property from Agricultural to Residential and Multiple classifications. Motion duly carried. MOTION of Garrison, seconded by Branning, to hold a Public Hearing on February 13th 1969 at 7:3o p.m. for the vacation of the utility easement between Lots 4 and 5, The Woods Addition. Joint requests of the developer and purchaser of said lots. Motion duly carried. MOTION of Branning, secoY~ded by Pearsall, the Deed as submitted by Land Holding Company bn that part of Outlot A _ Apple Valley 9th Addition be rewritten as a street easement dedication instead. Authorizing Attorney McMenomy to clear the title to the easement and file same with the Dakota County of Register of Deeds. Motion duly carried. Erwin Ulrich, Chairman of the Planning Commission, presented material on the proposed zoo for the adjoining Village of Apple Valley and Town of Eagan areas. MOTION of Pearsall, seconded by Garrison, to take the study of the zoo under advise- ment; to come back with council recommendation at the next council meeting of February 13, 1969. Motion duly carried. Jim Niesen of the Utilities Commission submitted their approval of the water loop for the connection of the Apple Valley and Palomino Hills area water systems to the council. MOTION OF Pearsall, seconded by Branning, changing the date of the next regular sche- duled council meeting from February 12th - a holiday - to a Special Meeting on Thursday, February 13th at 7:30 p.m. Motion duly carried. ~ MOTION of Hollenbeck, seconded by Pearsall, unanimously passed, to approve the Plans and Specifications for the Apple Valley and Palomino Hills Water Loop Construction authorizing the engineer to advertise for bids to be received on February 13, 1969 at 3:00 p. m. at the Municipal Building, in accordance with the resolution hereto attached. Action on said bids to be taken at the meeting of February 13, at 7:30 p. m. Motion dtaly carried. MOTION of Branning, seconded by Hollenbeek~ unanimously passed, ordering a Public Hearing for said water=l~line utilities improvements to be held on February 13' 1969 at 7:30 p.m., in accordance with the motion hereto attached. Motion duly carried. MOTION of Garrison, seconded by Pearsall, unanimously passed, establishing a Police Advisory Committee to advise the council. Motion duly carried. MOTION of Pearsall, seconded by Garrison, instruction be given to members of the Police Advisory Committee to begin work on the items hereto attached. Motion duly carried. MOTION of Hollenbeek, seconded by Braxaning, to dissolve the present Urban Affairs Committee as it now stands. Motion duly carried. MOTION of Pearsall, seconded by Branning, to establish a new Urban Affairs Committee. Motion duly carried. MOTION of Hollenbeck, seconded by Branning, to appoint the following five members to the Urban Affairs Committee at the present time. Designating Don Adamson as Chairman of the Committee. MOTION of Garrison, seconded by Pearsall, ordering the committee to begin immediately on drawing up a dance ordinance to cover the establishment of the Teen Center and other similar types of establishments. Motion duly carried. MOTION of Branning, seconded by Garrison to establish a Medical Facilities Committee, appointing Joe Milbauer as Chairman of the committee. Motion duly carried. MOTION of Hollenbeck, seconded by Pearsall, unanimously passed, to appoint Mr. Stephen J. Delaney as Weed Inspector for the Village of Apple Valley. Motion duly carried. MOTION of Ho1l.enbeck, seconded by Branning, authorizing the payment of payroll and bills as submitted by the Clerk. Also construction bills - listing hereto attached. Motion duly carried. MOTION of Garrison, seconded by Pearsall, unanimously passed, that equipment certificate warrants be issued for the proper amounts for the police, fire and maintenance equipment purchased by the township. Said amounts to be submitted to Mr. Jim Olsen of Juran and Moody, Inc., to enable him to prepare the necessary certificates. Motion duly carried. A bona-fide bidder is one who actually signs and submits a bid. No money will be refunded to any per- son who obtains plans and specifications and does not submit a bid to the Owner. The Village Council reserves the right to reject any and ail bide, to waive irregu- larities and informalities therein and further reserves the right to award the con- tract to the best interests of the Village.
