PRESENT: Mayor Largen; Councilmen Garrison, Branning, Pearsall- and Hollenbeck; Clerk Asleson, ABSENT: None The Mayor caled the meeting to order at 7:4O pm Minutes MOTION: of Garrison, seconded by PearsaIl, to approve the minutes of the meeting of June 7, 1972 as amended. Ayes -5 Nays , O. MOTION: of Pearsall, seconded bY Brranning, to approve the minutes of the meeting of June 14, as read. Ayes - 3 - Nays - O; Largen and Garrison abstaining. Received summons from Shakopee Sand & Gravel. Attorney commented, MOTION: Of Pearsall, seconded bY Branning to approve the amendes Contract for Cedar Knolls. Ayes - 5 Nays - O. MOTION: of Garrison, seconded by .Pearsall, to pass ReSolution 1972-94, ordering improve- ments` to the Cedar KnOlls Addition PHase III. AYes, 5 - Nays - O. MOTION: of Hollenbeck, seconded by Garrison, tolapprove the. Development Contract for Oak Ridge Park, with the amendment to Paragraph I.. Ayes-.- 4 - Nays - O; Largen abstaining. MOTION: of Garrison, seconded by Hollenbeck, to approve the final plat for Oak Ridge Park. Ayes - 4 - Nays - O; Largen abstaining. Joint Public Hearings Clark Oil Company, Conditional Use Permit- The Mayor read the affidavit of publication and called the hearing to order. The Planning Consultant described the area involved~ and the petitioner explained his reason for requesting the conditional use. There being no further comments the hearing was declared closed at 8:45 p.m. Apple Valley Baptist Church Rezoning. The Mayor read the affidavit of publication and Called. the hearing to order. The Planning Consultant showed location of the area on the map. Mr. Crawford described their plan briefly. There beingnO further dis- cussion, the hearing was declased closed at 9:00 p.m. MOTION: of Pearsall, seconded by Hollenbeck, to pass Res. 1972-95, setting a public hearing for Apple Valley Baptist Church for July 19 at 8:00 p.m. Ayes - 5 - Nays - 0; Standard Oil Company, Conditional Use Permit- The Mayor read the affidavit of publi- cation and called the hearing to Order. The Planning Consultant lOcated the Property On the map. Mr. McGregor presented the plans There being no further discussion, the hearing was declared closed at 9:30 p,m. Resolution 1972-96, ordering the improvement, as advertised, for water and sewer to the new community building. Ayes - 5 - Nays - O. MOTION: of Branning, seconded by Hollenbeck, to pass Resolution 1972-97, awarding the addendum Bid to Austin P. Keller Company, for the improvement as stated in the previous motion. Ayes - 5 - Nays - O. Meadows Proposal - The Planning Consultant read the recommendation of the planning Commission. MOTION: of Pearsall, seconded by Garrison, to accept the Planning Commission's rec- ommendation and pass Ord. 113, rezoning the property to M-1, with the exception that Palomino Development Corporation use Alternate Plan #2, leaving Reflection Road as a deadend street. After much discussion, Councilman Pearsall withdrew his motion, then the second withdrew. Council requested the Planning Consultant to place discussion of the street system for this property high on his priority list. MOTION: of Pearsall, seconded by Hollenbeck, to pay the claims and bills; check # 4308 through # 4406, in the amount of $224,126.78. Ayes 5 - Nays - O. MOTION: of Branning, seconded by Hollenbeck, to continue this meeting until 7:30 July6, 1972. Umously carried. Adjourned at 12:15 a.m. Meeting of July 5, 1972 reconvened at 7:35.p.m. July 6,~ 1972. PRESENT: Mayor Largen; Councilmen Pearsall, Hollenbeck, Garrison and Branntng; Clerk, Asleson ABSENT: None Human Rights Commission. Proposed Ordinance discussed by Council. MOTION: of Pearsall, seconded by Hollenbeck, to adopt Ordinance # 113, establishing a Human Rights Commission, subject to the review of the Attorney. Ayes - 5 - Nays - O. The Mayor recommended that Mr. Elbert Clark be appointed as Chariman of the Human Rights Commission. MOTION: · of Largen, seconded by Garrison, to appoint Mr Elbert Clark as Chairman of the Human Rights Commission. Ayes - 5 - Nays - O. Computer Election Systems- The Administrator explained that the representative of the Company would not be able to attend this meeting, but would come next Wednesday. Councilman Branning assigned to look at the. proposal in detail. VILLAGE OF APPLE VALLEY Dakota County, Minnesota Page 3 The Mayor discussed the meeting of the Metro Council Referral Committee this afternoon and read the letter he had submitted, The Dakota County Administrator was present and discussed the County Housing and Redevelopment Authority with the Council; requesting ApPle Valley's support. The County Traffic Engineer discussed with the Council the studies they had made on County Road 42 as it pertains to sigmalized intersections and pedestrian crossings. Review appraiser for Galaxie and Westview Parks- MOTION: of Branning Seconded by Pearsall to hire the firm of Gordon Holmquist & Assoc. as review appraisers for the parks, Ayes - 5 - Nays - O. MOTION: of Pearsall, seconded by Hollenbeck, to pass Resolution 1972-98, approving purchase of additional property for Galaxie Park. -AYes - 5 - Nays - O. MOTION: of Pearsall, seconded by Hollenbeck, to pass Resolution 1972-99, approving of the agreement between the Belzer Clinic and Land holding Compan,v. Ayes - 5 - Nays O. Note: It is the intention of the Council, that should there be a change in the .future site, it is the intent of the Village to reclaim the above sit· for civic purposes. The status of the complaint against Frank Dorniden was discussed. MOTION: of Garrison, seconded by Pearsall, to award the bids for the radio equipment to RCA, the low bidder, as outlined in the tabulation-mad recommended by the Administrator. Ayes - 5 - Nays - O. MOTION: of Garrison, seconded· by Pearsall, to issue the 1972 gravel permit to Mc- Namara-Vivant Contracting Company. Ayes - 5 - Nays -0. The Planning Commission was instructed to proceed on the gravel permit for Fischer Construction Co. The Engineer requested confirmation of his advertisement for the 1972 seal coat project. Bids to. be.taken 10:00am, July 12, 1972. MOTION: of Hollenbeck, seconded by Pearsall to confirm the advertisement for seal coat bids. Ayes -5 - Nays- O. MOTION: of Pearsall, seconded by Garrison, to adopt Resolution 1972-103, awarding the contract for the Whitney Drive Street improvements to Alexander Con- struction, the low bidder, in the amount of $15,982.00, as recommended by the Emgineer. Ayes- 5 -Nays - O. MOTION: of Branning, seconded by Hollenbeck, to adopt Resolution 1972-104, awarding improvements to Metro Engineering, the low bidder, in the amount of. $140,925.50, using Alternate # 2 on the tennis court improvements; and to allow Arteka to withdraw their bid. Ayes - 5 - Nays - O. VILLAGE 0F APPLE VALLEY Dakota County, Minnesota Page 4 MOTION: of Branning, seconded by Hollenbeek, to allow Olson Concrete a 30-day extension on the contract for the public works building, as recommended by the Engineer and the building inspector. Ayes - 4 - Nays - 1 (Garrison). The Winkler company requests permission to have Urban Planning & Design prepare a prel- iminary design plan for the Southport Airport area. The Administration recommended they allow it. MOTION: of Pearsall, seconded by Branning, to authorize the study, as mentioned above. Ayes - 5 - Nays - O. MOTION: of Garrison, seconded by Hollenbeck to approve the planning Commission's recommendation to give the variance for the garage at 995 Oriole Drive. Ayes - 5 - Nays - 0. MOTION: of Pearsall, seconded by Garrison, to grant the side yard variance for 107 E. Pony Lane, as recommended by the Planning Commission. Ayes - 5 - Nays - O. MOTION: of Hollenbeck, seconded by Pearsall to Pass Resolution 1972-100, setting a public hearing for August 2, 1972 at 8:00 p.m. on,the development plan for Eaton's Ranch and adjacent area. Ayes - 5 - Nays - O. MOTION: of Pearsall, seconded by Hollenbeck, to pass Resolution 1972-101, setting a public hearing for August 2, 1972 for the proposed development for Cobblestones. Ayes - 5 - Nays - G. MOTION: of Garrison, seconded by Branning, to accept the Planning Commission's rec- ommendations on the Conditional Use Permitfor U-Haul Company. Ayes - 5 - Nays - O. MOTION: of Hollenbeck, seconded by Pearsall, to issue a Conditional Use Permit to Alexander Construction, subject to street easement agreementSo Ayes - 5 - Nays - ~0. MOTION: of Garrison, seconded by Hollenbeck, to approve issuance of a building permit to Alexander Construction Company. Ayes - 5 - Nays - 0. MOTION: of Hollenbeck, seconded by Pearsall, to approve purchase of bleachers, as recommended by the Recreation Director. Ayes - 5 - Nays - O. MOTION: of Pearsall, secondedby Hollenbeck, to authorize treatment of Lake Alimagnst with copper sulphate, in the amount of $225.00; a 1/3 share of the cost. Ayes - 4 Nays 1 (Garrison). Letter from Alimagnet Lake Association pertaining to snowmobile patrol - received. Question from Branning on maintaining of water and-sewer on priVate streets. The Engineer is to prepare a report. May, 1972 water and Sewer report received. MOTION: of Hollenbeck, seconded by Branning, to allow staff to prOceed with temporary summer program hiring, as the need arises. Ayes - 5 - Nays - O. VILLAGE OF APPLE VALLRy Dakota County, Minnesota page 5 Payroll reports for June 16 and June 30, 1972 received. MOTION: of Pearsall, seconded by Hollenbeck, to pass Resolution 1972-102, approving the policy on overtime. Ayes - 5 - Nays - 0. Treasurer's Cash Report for May received. MOTION: of Pearsall, seconded by Hollenbeck, to approve issuance of a transient merchant's license for the U.S. Olympic Committee. Ayes - 5 - Nays - O. MOTION: of Garrison, seconded by Hollenbeck, to approve hiring of Debbie Halbert as temporary employee at $1.60 per hour. MOTION: of Garrison, seconded by Pearsall, to authorize Administrator to prepare a resolution prohibiting parking on the East side of Redwood Drive South. Ayes - 5 - Nays - 0. Councilman Hollenbeck informed Council the bank will be heard from in two weeks, the Golf Committee will be ready to make its presentation on July 19th and that the 4th of July celebration was missed by several people. Councilman pearsall said the CATV Committee will be meeting with Metro Cable this coming Tuesday. He had discussion recently with Erwin Ulrich and John Natwick and there will he a proposal for a skating rink, furniture store and Fiat dealer coming soon.
